This cooperation aims to protect voters\u2019 rights despite the shortened timeline. The special election features candidates such as graham\u2019s sister, Darlene Graham, and other Republican contenders, with candidate filing closing shortly before the election. The agreement includes provisions for instant runoff voting and ensures communication with overseas voters to facilitate ballot transmission. Experts highlight ongoing concerns about voting security under UOCAVA, especially regarding eligibility and identification for overseas voters, with calls for legislative reforms to strengthen ballot protections and prevent potential misuse by non-residents.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Department of Justice has come to terms with the state of South Carolina to make sure uniformed and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >overseas voters receive absentee ballots<\/a> in advance of a rapidly approaching special election following the recent death of incumbent Republican Sen. Lindsey Graham, according to a DOJ memo exclusively obtained by The Federalist.  <\/p>\n<p>DOJ officials have signed the Memorandum of Agreement with Conway Belangia, executive director of the South Carolina State Election Commission, and the agreement is expected to bring the state into compliance with the <a href=\"https:\/\/www.justice.gov\/crt\/uniformed-and-overseas-citizens-absentee-voting-act\" target=\"_blank\" rel=\"noreferrer noopener\">Uniformed and Overseas Citizens Absentee Voting Act.<\/a> UOCAVA stipulates election officials must send <a href=\"https:\/\/www.justice.gov\/crt\/uniformed-and-overseas-citizens-absentee-voting-act\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cvalidly-requested <\/a>absentee ballots to UOCAVA voters no later than 45 days before an election\u201d \u2014 including a special election \u2014 for a federal officeholder if the request is received at least 45 days before Election Day. <\/p>\n<p>But South Carolina election administrators don\u2019t have the luxury of that kind of time. <\/p>\n<h2>Crowded Field <\/h2>\n<p>South Carolina\u2019s special primary election must occur on Aug. 11, in accordance with state law. A runoff primary election, if necessary, is to take place two weeks later. <\/p>\n<p>Graham, <a href=\"https:\/\/www.lgraham.senate.gov\/public\/index.cfm\/biography\" target=\"_blank\" rel=\"noreferrer noopener\">first elected <\/a>to the Senate in 2002, <a href=\"https:\/\/www.wbtv.com\/2026\/07\/21\/late-sen-lindsey-grahams-funeral-new-details-revealed-south-carolina-washington-events\/\" target=\"_blank\" rel=\"noreferrer noopener\">died suddenly <\/a>on July 11 after suffering a cardiac incident. He was 71. <\/p>\n<p>South Carolina Gov. Henry McMaster, a Republican, quickly appointed the Republican senator\u2019s sister, Darlene Graham, to serve out the remaining months of her late brother\u2019s term. She has the endorsement of President Donald Trump. She recently announced that she will campaign for a full six-year term in November\u2019s election. The senator was in the middle of his reelection campaign when he died. <\/p>\n<p>Darlene Graham is not the only candidate running in the Republican primary. South Carolina <a href=\"https:\/\/thehill.com\/homenews\/campaign\/5978093-fry-seeks-graham-senate-seat\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep. Russell Fry,<\/a> a Trump ally, announced this week that he was throwing his hat in the ring. <a href=\"https:\/\/thehill.com\/homenews\/house\/5981324-mace-endorses-norman-senate-graham\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep. Ralph Norman <\/a>has signed on, as well as businessman <a href=\"https:\/\/www.lynchforsenate.com\" target=\"_blank\" rel=\"noreferrer noopener\">Mark Lynch<\/a>, who lost to Sen. Lindsey Graham in this year\u2019s primary.  <\/p>\n<p>\u201cA number of other Republicans are mulling runs as well, including former Gov. Mark Sanford and Lt. Gov Pam Evette, who lost her own bid for governor a few weeks ago in spite of Trump\u2019s endorsement,\u201d Politico <a href=\"https:\/\/www.politico.com\/news\/2026\/07\/21\/south-carolina-trump-graham-test-01005834\" target=\"_blank\" rel=\"noreferrer noopener\">reported.<\/a> <\/p>\n<h2>\u2018To Safeguard Voting Rights\u2019<\/h2>\n<p>In South Carolina, candidates seeking to fill a Senate seat left vacant by the death of a senator must file a statement of intention of candidacy, a filing period clock that starts the \u201csecond Tuesday after the death,\u201d according to the memo. Candidate qualifying closes on July 28, next Tuesday. <\/p>\n<p>\u201cThe special primary election must then occur \u2018on the second Tuesday immediately following the close of the filing period,\u2019\u201d the agreement notes. <\/p>\n<p>It\u2019s all kind of morbid, but it is the law. <\/p>\n<p>So the expedited schedule forces election officials to hold the special primary election and runoff well before UOCAVA\u2019 s 45-day requirement in which uniform and overseas citizens need to request their absentee ballots. <\/p>\n<p>The agreement between the Department of Justice and the State Election Commission allows for the shorter timeline and avoids the \u201cburden and expense of litigation,\u201d the memo states. <\/p>\n<p>\u201cAs consideration for this Agreement, the United States has agreed to forgo litigation under UOCAVA as to the August 11, 2026, Federal special primary election and any August 25, 2026, Federal special runoff election subject to compliance with the terms of this Agreement,\u201d the document states. <\/p>\n<p>Under the terms, \u201ceach ballot also includes instant runoff voting,\u201d a DOJ press release noted, so UOCAVA voters will be able to choose a candidate should a runoff election be needed on Aug. 25. Election officials will have to contact UOCAVA voters without standing requests for ballots to inform them of the special election deadlines \u201cand offer to send ballots by electronic mail if they would like to participate.\u201d <\/p>\n<p>Assistant Attorney General Harmeet K. Dhillon of the Justice Department\u2019s Civil Rights Division said the memorandum of agreement reflects the DOJ\u2019s commitment \u201cto protecting the right to vote for members of our armed forces deployed around the world, their families, and U.S. citizens overseas, and ensuring that these voters are afforded a meaningful opportunity to vote in all federal elections.\u201d <\/p>\n<p>\u201cSouth Carolina officials worked with the department immediately to find a resolution to safeguard voting rights for the state\u2019s military and overseas voters in the upcoming primary election and potential runoff,\u201d she said in a press release. <\/p>\n<h2>Securing UOCAVA<\/h2>\n<p>The election integrity challenge is to ensure that only eligible voters receive ballots under UOCAVA. The law originally was designed to serve only active military and federal government employees residing outside of the United States, but today mostly nonmilitary citizens use it, The Federalist has <a href=\"https:\/\/thefederalist.com\/2024\/12\/12\/five-ways-to-start-fixing-the-uocava-mess-that-lets-people-abroad-cast-insecure-votes-in-swing-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported.<\/a> <\/p>\n<p>Election integrity groups such as the Michigan Fair Elections Institute and the Election Integrity Network have called on lawmakers to <a href=\"https:\/\/thefederalist.com\/2024\/12\/12\/five-ways-to-start-fixing-the-uocava-mess-that-lets-people-abroad-cast-insecure-votes-in-swing-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">reform the law <\/a>to include key ballot protections. Congress, they say, should require civilians overseas to send photocopies of their passports or other acceptable identification with their hand-signed ballots, and the application reform should require citizenship verification. <\/p>\n<p>As The Federalist has reported,<a href=\"https:\/\/thefederalist.com\/2025\/08\/04\/new-bill-targets-uocava-loophole-that-lets-overseas-voters-use-outdated-addresses\/\" target=\"_blank\" rel=\"noreferrer noopener\"> several states<\/a> allow civilians residing overseas to vote in elections in a state in which they have never lived \u2014 with <a href=\"https:\/\/thefederalist.com\/2026\/06\/29\/rnc-sues-colorados-tds-afflicted-elections-chief-for-violating-state-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\">some states <\/a>allegedly doing so in violation of their state constitutions. The Republican National Committee has filed multiple <a href=\"https:\/\/thefederalist.com\/2026\/06\/29\/rnc-sues-colorados-tds-afflicted-elections-chief-for-violating-state-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits <\/a>over so-called <a href=\"https:\/\/thefederalist.com\/2026\/06\/29\/rnc-sues-colorados-tds-afflicted-elections-chief-for-violating-state-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cnever residen<\/a><a href=\"https:\/\/thefederalist.com\/2026\/06\/29\/rnc-sues-colorados-tds-afflicted-elections-chief-for-violating-state-constitution\/\">ts\u201d<\/a> allowed to vote in federal elections. <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
