Female inmates from a separate suit, <em>Fleming v. Warden T. Rule<\/em>, previously secured <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.199.0.pdf\">a first-of-its-kind protective order<\/a> that created the \u201cminiature men\u2019s prison\u201d inside FMC Carswell, as the DOJ had described the separation arrangement.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-1\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-1\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-15\" data-wex-ad=\"art-dsk-inart-1\"><\/div>\n<\/div>\n<\/div>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">In <em>Fleming<\/em>, U.S. District Judge Sidney Fitzwater, an appointee of former President Ronald Reagan, approved the unit\u2019s establishment that completely cordons off the male inmates at FMC Carswell and simultaneously remedies the men\u2019s fear of sexual violence claims.<\/p>\n<p class=\"wp-block-paragraph\">In <em>Blanche<\/em>, the biological males obtained <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/glad-org-wpom.nyc3.cdn.digitaloceanspaces.com\/wp-content\/uploads\/2026\/05\/20260608_Doe-v-Blanche_PI-Order.pdf\">a preliminary injunction<\/a> that temporarily blocks their reassignments to men\u2019s facilities on grounds that \u201cthey are likely to suffer imminent and irreparable harm absent injunctive relief.\u201d The men\u2019s main argument centers on them facing the threat of rape, as \u201ctransgender women,\u201d if they were relocated.<\/p>\n<p class=\"wp-block-paragraph\">U.S. District Judge Royce Lamberth, another Reagan appointee, specified in his decision at the time that the injunction \u201cmerely enjoins\u201d the government from transferring the 14 men to male-designated penitentiaries. \u201cIt does not, at this juncture, require that Plaintiffs be housed alongside cisgender female inmates or share common spaces,\u201d Lamberth stated.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">In the advance notice announcing the government\u2019s transfer plans, the DOJ cited Lamberth\u2019s clarification that the June 7 court order does not instruct the department to place the male petitioners in living quarters with female inmates. Four of the <em>Jane Doe<\/em> plaintiffs, who are housed at FMC Carswell, were already moved to the special cellblock in compliance with the <em>Fleming<\/em> order, which also mandates separate showering schedules and other measures \u201cas necessary\u201d to prevent any overlap between biologically male and female inmates during daily prison life.<\/p>\n<p class=\"wp-block-paragraph\">The male litigants have since filed <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.183.0.pdf\">an emergency motion<\/a> to enforce Lamberth\u2019s preliminary injunction irrespective of the <em>Fleming<\/em> order, arguing that his \u201cclear and unambiguous\u201d ruling requires the BOP to \u201cmaintain and continue\u201d each plaintiff\u2019s \u201chousing status in women\u2019s facilities.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Represented pro bono by the National Center for LGBTQ Rights and the GLBTQ Legal Advocates &#038; Defenders, the plaintiffs accused the government of acting in contravention of Lamberth\u2019s \u201cbinding\u201d restraint and running with a far-reaching interpretation of Fitzwater\u2019s ruling.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The men claimed that the \u201cquasi-solitary unit [at FMC Carswell] impedes access to medical and legal visits and strips them of virtually all programming, education, recreation, and meaningful social contact, far exceeding any measure necessary to comply with the <em>Fleming<\/em> order.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In support of the motion, legal counsel attached <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.183.2.pdf\">declarations<\/a> from the four co-plaintiffs confined to the special housing unit, alleging that they are \u201csuffering severe and escalating harm, including resurgent gender dysphoria, loss of clinical progress achieved over years in general population, deteriorating mental health, and, for at least one Plaintiff, the resurgence of suicidal ideation.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Urging immediate intervention by the court, the male plaintiffs asked that Lamberth prevent the remaining biological men\u2019s imminent transfers to FMC Carswell, order the return of the four male inmates to the general population at other women\u2019s prisons, or at least restore their out-of-unit movement.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\">The front entrance of the Federal Medical Center prison in Fort Worth, Texas.<\/p>\n<p>&#8221; data-image-caption=&#8221;<\/p>\n<p>The front entrance of the Federal Medical Center prison in Fort Worth, Texas, Saturday, May 16, 2020.
