Windom downloaded the material, and other members of Smith\u2019s investigative team began downloading it within an hour, according to the materials released by Grassley.<\/p>\n<p class=\"wp-block-paragraph\">Accompanying the Tuesday release was a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.grassley.senate.gov\/imo\/media\/doc\/doj_to_grassley_-_arctic_frost_filter_team.pdf\">Trump DOJ letter<\/a> to Grassley that said Smith\u2019s office \u201capparently bypassed\u201d a filter team that was supposed to screen the NARA materials for attorney-client and work-product privilege before prosecutors assigned to the Trump investigation gained access.<\/p>\n<p class=\"wp-block-paragraph\">That detail is at the center of the most recent controversy. The DOJ\u2019s filter team was supposed to act as a firewall between potentially privileged communications and the prosecutors building the case against Trump. If Smith\u2019s team accessed the messages before screening was completed, his investigators may have seen material that should have been withheld, segregated, or subjected to further legal review before prosecutors could use it, raising additional separation-of-powers concerns because members of Congress had their communications secretly accessed.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The disclosure comes as the DOJ continues to face questions about how the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/biden-administration\/\">Biden administration<\/a>\u2019s Arctic Frost investigation \u2014 which then-Attorney General Merrick Garland later placed under Smith\u2019s authority \u2014 aggressively collected sensitive material while pursuing Trump and his allies.<\/p>\n<h2 id=\"h-smith-s-text-collections-came-one-month-before-receipt-of-phone-toll-data\" class=\"wp-block-heading\">Smith\u2019s text collections came one month before receipt of phone toll data<\/h2>\n<p class=\"wp-block-paragraph\">The NARA materials are separate from the phone toll data Smith\u2019s team and the FBI obtained during the same 2023 phase of Arctic Frost. Toll data shows who contacted who and when, but does not show the content of messages or phone calls.<\/p>\n<p class=\"wp-block-paragraph\">On Oct. 6, 2025, Grassley <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.grassley.senate.gov\/news\/news-releases\/biden-fbi-spied-on-eight-republican-senators-as-part-of-arctic-frost-investigation-grassley-oversight-reveals\">first revealed<\/a> that the FBI had obtained phone toll data for eight Republican senators and one House member. The data was collected in 2023, and FBI officials in Washington had call logs from those lawmakers\u2019 personal phones by Sept. 27, 2023. The public did not learn of the collection until the October 2025 disclosures.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Subsequent disclosures expanded the known scope of what Smith had done to dig into the private communications of sitting lawmakers. Grassley and Sen. Ron Johnson (R-WI) on Feb. 10 <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.grassley.senate.gov\/news\/news-releases\/grassley-demands-answers-from-telecom-companies-who-turned-congressional-phone-records-over-to-jack-smith\">identified 84 Arctic Frost-related subpoenas<\/a> to telecommunications companies, including 10 seeking toll records connected to at least 20 current or former Republican members of Congress.<\/p>\n<p class=\"wp-block-paragraph\">The toll data showed such information as the numbers involved, timing, duration, and general location of calls. It did not reveal the content of calls or messages. But the NARA materials revealed this week did, raising questions about whether Smith was totally transparent when he suggested in congressional testimony last year that his team did not probe beyond toll records.<\/p>\n<p class=\"wp-block-paragraph\">The full scope of Smith\u2019s access, the extent of prosecutors\u2019 review, and whether the text message content was used in Arctic Frost or Smith\u2019s federal election case remain unclear.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<h2 id=\"h-legal-questions-intensify\" class=\"wp-block-heading\">Legal questions intensify<\/h2>\n<p class=\"wp-block-paragraph\">Robert Luther III, an associate professor at Antonin Scalia Law School at George Mason University, said the newly disclosed details about Smith\u2019s access to message content present a more serious legal issue than the earlier toll data disclosures.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWhen we\u2019re at the point where a special counsel with no oversight is seeing the content of members of Congress\u2019s private exchanges without their knowledge,\u201d Luther told the <em>Washington Examiner<\/em>, \u201caside from just the obvious outrageousness of it on its face, that violates the speech or debate clause of the Constitution.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The speech or debate clause protects lawmakers from executive branch intrusion into legitimate legislative activity, including some communications involving staff, constituents, and official work.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Luther argued in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/94466aeb-e8bf-feb0-1eb8-9f68d0fa28b0\/2025-12-03_Testimony_Luther.pdf\">prepared testimony<\/a> for a Jan. 7 Senate Judiciary Committee subcommittee hearing that <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title2-section6628&#038;num=0&#038;edition=prelim\">2 U.S.C. \u00a7 6628<\/a> generally requires telecommunications providers to notify members of Congress when their records are subpoenaed, allowing lawmakers an opportunity to raise legal defenses.<\/p>\n<p class=\"wp-block-paragraph\">The Biden DOJ did not provide that notice when it sought lawmakers\u2019 phone toll data. Chief U.S. District Judge James Boasberg, an Obama appointee who was assigned to the case, was <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/3889533\/senators-ask-dc-circuit-suspend-james-boasberg-pending-impeachment-vote\/\">also not told that subpoenas<\/a> at issue concerned members of Congress.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIf the judge is saying he didn\u2019t know, he didn\u2019t know because the lawyers didn\u2019t tell him,\u201d Luther said. \u201cWhat lawyers didn\u2019t tell him? Special counsel\u2019s office.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Republicans have also alleged that Smith misled Congress <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.foxnews.com\/politics\/veteran-dem-breaks-party-line-jack-smith-spying-scandal-grips-capitol-hill\">when he denied during a Dec. 17 deposition<\/a> that he had looked at the content of lawmakers\u2019 communications.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI saw the transcript, and I saw a question\u201d about it, Luther said. \u201cSo I don\u2019t know how that\u2019s not applicable.\u201d<\/p>\n<p class=\"wp-block-paragraph\">A closer look at the transcript may provide an opportunity for Smith to \u201csplit hairs,\u201d former DOJ ranking official Jeff Clark <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/JeffClarkUS\/status\/2077787893917978889\">said<\/a> in an interview on <em>The Matt Gaetz Show<\/em> Wednesday evening.<\/p>\n<p class=\"wp-block-paragraph\">Smith was asked directly: \u201cDid the toll records that you requested from the senators, did they include the content of the phone calls?\u201d The former special counsel said \u201cno.\u201d When asked whether \u201cthe records that you requested, the toll records from the member of Congress, include the content of text messages,\u201d Smith also said \u201cno.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Clark suggested Smith could argue that technically, the subpoena he was being asked about did not seek message contents, and that investigators had reviewed text messages through different means at a different point in the investigation.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHe\u2019s going to try to say that \u2018Look, I subpoenaed information that got me \u2026 who called whom on cell phone records, and that that did not get the content of the information from the members of Congress and senators,&#8217;\u201d Clark said, but added, \u201cgood luck with that defense.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Luther said Smith\u2019s potential exposure is not limited to whether his testimony meets the legal standard for perjury.<\/p>\n<p class=\"wp-block-paragraph\">\u201cEven if he didn\u2019t commit perjury, why is he securing the content of senators\u2019 text messages without notice?\u201d Luther said.<\/p>\n<h2 id=\"h-security-concerns-create-a-second-front\" class=\"wp-block-heading\">Security concerns create a second front<\/h2>\n<p class=\"wp-block-paragraph\">The text message disclosure landed less than a week after another release raised questions about classified security practices inside Smith\u2019s Biden-era special counsel office.<\/p>\n<p class=\"wp-block-paragraph\">Last week, Grassley <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.grassley.senate.gov\/news\/news-releases\/biden-doj-personnel-exposed-classified-materials-while-special-counsel-jack-smith-prosecuted-trump-records-show\">released<\/a> internal DOJ messages in which officials privately described their uncertainty over Smith\u2019s access to classified material, raised questions about the movement of sensitive items, and discussed an apparent security <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4640537\/doj-records-reveal-possible-classified-security-lapses-jack-smith-office-trump-prosecution\/\">\u201cviolation and incident\u201d<\/a> after a DOJ sensitive compartmented information facility was left unsecured. The incident discussed in the messages occurred on April 18 and April 19, 2024, while Smith\u2019s office was prosecuting Trump over his alleged unlawful retention of classified documents.<\/p>\n<p class=\"wp-block-paragraph\">Grassley has asked the department to answer by July 22 whether any classified material was compromised, whether evidence in Smith\u2019s prosecution was affected, and whether Trump\u2019s legal team or the court were notified. The DOJ said it was reviewing the concerns and takes the protection of classified information seriously.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4649584\/todd-blanche-confirmation-hearing-jack-smith-arctic-frost-investigation\/\">TODD BLANCHE CONFIRMATION HEARING TURNS TO SMITH BOMBSHELLS: \u2018DID JACK SMITH READ MY EMAILS?\u2019<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">Together, the two disclosures over the past two weeks have sharpened questions about Smith\u2019s legacy and the Biden administration\u2019s decision to give him authority over both of the federal prosecutions over Trump. Grassley has also indicated Smith could soon be brought forth to the Senate for questioning, saying this week \u201cI intend to have him before the Senate Judiciary Committee in the coming months to hold him accountable.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The controversy has also resonated beyond Capitol Hill.
