Not enough,\u201d Cooper said. \u201cIt\u2019s just frustrating that people are hesitant to do anything.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The criticism marks a growing divide within California\u2019s Democratic Party over public safety, an issue Republicans have highlighted for years as they argue Democratic policies have contributed to crime and disorder.<\/p>\n<p class=\"wp-block-paragraph\">Much of Cooper\u2019s frustration centers on <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/3177311\/california-proposition-36-stiffer-penalties-criminals-fentanyl\/\">Proposition 36<\/a>, the 2024 ballot measure that passed overwhelmingly, with nearly 70% of the vote in every California county, despite opposition from Newsom and most Democratic leaders.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The measure increased penalties for repeat retail theft and certain drug crimes, including fentanyl trafficking, while creating a treatment-mandated felony that allows judges to require eligible offenders to complete drug or mental health treatment in exchange for having a felony dismissed. It also rolled back portions of <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/559058\/proposition-47-at-a-glance\/\">Proposition 47<\/a>, the 2014 initiative that reduced penalties for many theft and drug possession offenses and has long been criticized by law enforcement as adding to repeat offending.<\/p>\n<p class=\"wp-block-paragraph\">\u201cNot one statewide official supported it. However, budget documents show only $50 million is specifically dedicated to helping courts and pretrial services handle the additional workload created by the measure.<\/p>\n<p class=\"wp-block-paragraph\">Even so, Cooper said retailers are already reporting fewer thefts.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cIt is working,\u201d he said. \u201cBut without funding, it doesn\u2019t go anywhere.\u201d<\/p>\n<p class=\"wp-block-paragraph\">He said many offenders continue to cycle through the system because treatment programs envisioned under Proposition 36 are not fully available.<\/p>\n<p class=\"wp-block-paragraph\">Cooper also took aim at California\u2019s mental health diversion program, which allows eligible defendants to receive treatment instead of traditional criminal penalties. He warned that legislation expanding diversion to include additional theft offenses would undermine Proposition 36 by allowing repeat offenders to avoid accountability.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cIt would water it down,\u201d Cooper said, adding that some lawmakers \u201cdon\u2019t want anybody held accountable.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Although Newsom recently signed legislation tightening eligibility for mental health diversion, Cooper argued the changes do not go far enough. He said offenders accused of crimes such as felony child abuse or sexually violent offenses should never qualify.<\/p>\n<p class=\"wp-block-paragraph\">The sheriff also criticized California\u2019s treatment of domestic violence under state law, noting it is not classified as a violent felony in many cases despite the severity of the crimes.<\/p>\n<p class=\"wp-block-paragraph\">He recalled investigating cases in which one man allegedly beat his former wife for three days until she lost consciousness and another gouged out his partner\u2019s eyes.<\/p>\n<p class=\"wp-block-paragraph\">\u201cDomestic violence goes on every day,\u201d Cooper said. \u201cIt doesn\u2019t matter if you\u2019re rich or poor. It happens in every neighborhood.
