Ron DeSantis\u2019s 2022 Individual Freedom Act \u2014 commonly referred to as the \u201cStop WOKE Act\u201d \u2014 ran up against a legal roadblock when the U.S. Court of Appeals for the 11th Circuit upheld a preliminary injunction blocking the state from enforcing certain provisions of it.<\/p>\n<p><a href=\"https:\/\/justthenews.com\/government\/courts-law\/appeals-court-upholds-injunction-against-florida-stop-woke-act-restrictions\" target=\"_blank\" rel=\"noopener\">Just The News<\/a> reported Thursday on the 2-1 decision which came out Monday. When the Florida Legislature passed <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2022\/7\" target=\"_blank\" rel=\"noopener\">the law<\/a> in 2022, the intent was to stop an array of left-wing ideologies and their curricula from permeating classrooms at the K-12 level, college level, and in workplace trainings.<\/p>\n<p>The law barred instruction that \u201cespouses, promotes, advances, inculcates, or compels\u201d students to believe a set of concepts about race, nationality, color, or sex.<\/p>\n<p>Just The News noted some of the concepts laid out in the legislation\u2019s language.<\/p>\n<p>\u201cThose prohibited concepts include the ideas that one race or sex is morally superior to another, that individuals bear responsibility for historical wrongs committed by members of their race or sex, or that values such as merit, hard work, or colorblindness are inherently racist or sexist,\u201d the outlet wrote.<\/p>\n<p>The state of Florida argued that restrictions on educators\u2019 speech are permissible on the grounds they are government employees, but the court rejected this.<\/p>\n<p>The <a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202213992.pdf\" target=\"_blank\" rel=\"noopener\">majority opinion<\/a> by Judge Britt Grant said, \u201cWhen several groups of professors challenged Florida\u2019s new restrictions, the State cast about for an existing case or doctrine that could support its speech ban in the university setting. Finding none, it tried to marry public-employee speech cases with government speech doctrine, resulting in a new rule: if the government pays a professor\u2019s salary, it has total control over her classroom speech.\u201d<\/p>\n<p>\u201cThat is not a blessed union.\u201d<\/p>\n<p>Grant called Florida\u2019s law a \u201csalary-for-speech rule\u201d that was a \u201cbreathtaking assertion of power\u201d in order to \u201cban unpopular ideas from public discourse in the very places the State\u2019s own statutes recognize as centers of inquiry \u2014 classrooms where students are trusted to puzzle through ideas that are good and bad, easy and hard, ideally getting ever closer to the truth.\u201d<\/p>\n<p>Dissenting Judge Barbara Lagoa addressed First Amendment concerns about the law. \u201cTo be clear, the First Amendment protects all viewpoints in the public square, whether they are conventional or controversial. But it does not compel all viewpoints to be worthy of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/florida-appeals-court-blocks-desantiss-anti-woke-law\/\" title=\"Florida appeals ... blocks DeSantis&#039;s &#039;Anti-WOKE&#039; ...\">state-sponsored endorsement<\/a>.\u201d<\/p>\n<p>The decision allows racist leftist professors to continue espousing anti-white rhetoric in class to the faces of white students.<\/p>\n<p>What would be stopping professors from assigning work in which students must condemn the white race, contemplate their own privilege, or bow down before the shrine of racial equity?<\/p>\n<p>What\u2019s stopping professors from outright racial discrimination masquerading as instruction?<\/p>\n<p>Lagoa homed in on this concern by the state, but pivoted back to her argument that professors\u2019 words constitute state-sponsored speech.<\/p>\n<p>\u201cAnd if the government has a compelling interest in eradicating racial discrimination in a private university, how much greater is Florida\u2019s interest in eradicating what it deems to be racial discrimination in its own classrooms?\u201d she wrote.<\/p>\n<p>\u201cWe need not agree or disagree with Florida that the viewpoints at issue here <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-supreme-court-could-soon-hand-republicans-a-massive-redistricting-boost\/\" title=\"The Supreme ...
