pfTrackEvent(&#039;Judge Blocks Charlie Kirk Family\u2019s Request For Transparency In Hearing Evidence&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">As the preliminary hearing in the case of Charlie Kirk\u2019s alleged assassin continues this week, Judge Tony Graf has effectively <a href=\"https:\/\/x.com\/BreccanFThies\/status\/2075244789159890997?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> Erika Kirk\u2019s request that the victim\u2019s family be able to \u201cmeaningfully observe\u201d evidence as it is presented before the court.<\/p>\n<p class=\"wp-block-paragraph\">In a <a href=\"https:\/\/x.com\/BreccanFThies\/status\/2075237270031138848?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">Supplemental Notice<\/a> filed July 8, Kirk family attorney Jeffrey Neiman requested that all exhibits that have been admitted into evidence be made available to everyone in the courtroom, and that all evidence presented in the remainder of the hearing be \u201cdisplayed openly and in real time.\u201d<\/p>\n<div id=\"fdrlst__b89e9-393395167\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cAt certain points throughout the preliminary hearing, the Kirk family sat in the room while evidence was admitted but not presented for their viewing,\u201d Neiman wrote. \u201cThey were present in body, yet denied the very thing their presence was meant to secure: their ability to <em>meaningfully <\/em>observe the preliminary hearing.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Neiman suggested that the victim\u2019s legal right to be present at the hearing \u201cis hollow if the victim or his representative is physically in the room but is prevented from seeing the evidence the Court is receiving.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The judge denied this request from the Kirk legal team, saying that the publication of exhibits remains in the Court\u2019s discretion. <\/p>\n<p class=\"wp-block-paragraph\">\u201cTransparency is an important principle, but it must be maintained in a manner consistent with the constitutional rights and protections afforded to all parties,\u201d Graf said. \u201cThe court does not make a blanket ruling as it relates to any exhibit, and as previously stated, each exhibit will be afforded its own due in weighing whether it shall be published to the courtroom, or beyond, or not.\u201d<\/p>\n<p class=\"wp-block-paragraph\">One of the major pieces of evidence that the Kirk family would like to be made available is the recorded interview of defendant Tyler Robinson\u2019s roommate and alleged trans-identifying partner Lance Twiggs. Twiggs\u2019 testimony <a href=\"https:\/\/abcnews.com\/US\/alleged-gunman-tyler-robinson-wrote-letter-opportunity-charlie\/story?id=131913171\" target=\"_blank\" rel=\"noreferrer noopener\">discusses<\/a> messages between himself and Robinson in the aftermath of Charlie Kirk\u2019s <a href=\"https:\/\/thefederalist.com\/2025\/09\/10\/inspirational-conservative-charlie-kirk-assassinated-during-speech-at-utah-valley-university\/\" target=\"_blank\" rel=\"noreferrer noopener\">assassination<\/a>. The FBI has also <a href=\"https:\/\/x.com\/BreccanFThies\/status\/2074586262795616668?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">revealed<\/a> in the hearing that Twiggs\u2019 DNA was found on the towel wrapped around the rifle allegedly used by Robinson.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-x wp-block-embed-x\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"7N6uJVkJRxt5nDjpQNG7BVnfsFcjfxo9k0umXwrHp4EIoeYATEZWKCmdPOlRqvPcH1izS0aWQ52aLzlFIT1\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">KIRK family attorney Jeffrey NEIMAN is advocating for the full publication of the TWIGGS interview.<\/p>\n<p>\u201cI want to be clear as to what the Kirk family&#39;s position is on all of this. Thies (@BreccanFThies) <a href=\"https:\/\/x.com\/BreccanFThies\/status\/2074980983175082079?ref_src=twsrc%5Etfw\">July 8, 2026<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p class=\"wp-block-paragraph\">Neiman notes that Utah law gives victims and their legal representatives, the Kirk family in this case, the right to \u201cbe informed of, be present at, and to be heard at important criminal justice<br \/>hearings related to the victim,\u201d and that the victim\u2019s rights deserve to be protected at least as vigorously as the defendant\u2019s.<\/p>\n<p class=\"wp-block-paragraph\">Furthermore, the Kirk family argued that full transparency in this case is necessary to combat conspiracy theorists who continue to <a href=\"https:\/\/nypost.com\/2026\/07\/06\/us-news\/how-tyler-robinson-hearing-is-an-attempt-to-end-vile-charlie-kirk-conspiracy-theories-once-and-for-all\/\" target=\"_blank\" rel=\"noreferrer noopener\">point<\/a> fingers at anyone but the man who <a href=\"https:\/\/abcnews.com\/US\/tyler-robinson-set-face-formal-charges-shooting-death\/story?id=125614396\" target=\"_blank\" rel=\"noreferrer noopener\">confessed <\/a>to the murder.<\/p>\n<p class=\"wp-block-paragraph\">\u201cTo receive evidence in a manner shielded from those seated in the courtroom \u2014 as<br \/>happened today \u2014 is not transparency,\u201d the filing said. \u201cAnd in the absence of transparency, speculation and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-holds-hearing-on-capitol-break-in-security-failures\/\" title=\"House holds hearing on capitol break-in security failures\">conspiracy theories related<\/a> to the tragic assassination of Mr. Kirk will continue to proliferate in the public domain, breeding doubt and distrust in the judicial system.
