The piece argues that birthright citizenship should be reconsidered to safeguard the nation&#8217;s integrity and security.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>If you\u2019ve been wondering why America\u2019s 250th feels so hollow, the Supreme Court\u2019s June 30 <a href=\"https:\/\/apnews.com\/live\/birthright-citizenship-decision-supreme-court-updates-06-30-2026\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> on birthright citizenship should provide ample clarity. If anyone, from anywhere in the world, can travel to America and give birth to an \u201cAmerican\u201d citizen, then American citizenship is meaningless and based purely on the happenstance of birth.<\/p>\n<p>As Justice Samuel Alito <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> in his dissent, this system of \u201csoil and servitude\u201d was emphatically rejected by our Founders in the Declaration of Independence. Yet, the Court has once again saddled our nation with this ancient understanding, negating everything the Founders pledged their lives, fortunes, and sacred honor to reject, and resurrected a form of medieval English feudal rule.<\/p>\n<p>At the center of this debate is the 14th Amendment, which was drafted to ensure that freed slaves were recognized as full citizens, given that, as Justice Clarence Thomas argues in his <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">dissent<\/a>, freed slaves \u201chad no other homeland\u201d and were \u201cliable to be called upon to defend [America] in time of war.\u201d<\/p>\n<p>The Constitution\u2019s Citizenship Clause demands that one not only be born in the United States but also be \u201csubject to the jurisdiction thereof.\u201d Legal scholars who reject universal birthright citizenship under consent theory <a href=\"https:\/\/www.nationalaffairs.com\/publications\/detail\/the-question-of-birthright-citizenship\" target=\"_blank\" rel=\"noreferrer noopener\">argue<\/a> that full jurisdiction requires <em>mutual<\/em> political consent.<\/p>\n<p>Sen. Lyman Trumbull, a principal architect of Reconstruction-era legislation, <a href=\"https:\/\/www.heritage.org\/the-constitution\/report\/defining-citizens-congress-citizenship-and-the-meaning-the-fourteenth\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a> that the phrase \u201csubject to the jurisdiction thereof\u201d meant \u201cnot owing allegiance to anybody else\u201d and \u201csubject to the complete jurisdiction of the United States.\u201d<\/p>\n<p>To this point, Justice Thomas explained in his <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">dissent<\/a> that this jurisdictional requirement was historically understood as demanding a legal domicile, meaning a <em>permanent<\/em> home, rather than a fleeting visit to our shores by tourists, temporary foreign workers, or illegal aliens.<\/p>\n<p>This conclusion stands in direct contrast to Justice Ketanji Brown Jackson\u2019s \u201cuniversalist\u201d <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/jackson-thomas-offer-dueling-history-of-birthright-citizenship\" target=\"_blank\" rel=\"noreferrer noopener\">vision<\/a> of citizenship.<\/p>\n<p>The author of the Citizenship Clause, Sen. Jacob Howard, <a href=\"https:\/\/claremontreviewofbooks.com\/digital\/birthright-citizenship-a-response-to-my-critics\/\" target=\"_blank\" rel=\"noreferrer noopener\">stated<\/a> during the Senate debates over the 14th Amendment that automatic birthright citizenship would not \u201cinclude persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons.\u201d<\/p>\n<p>The Supreme Court majority\u2019s response to Howard\u2019s assertion is to argue over commas, insisting \u201cforeigners\u201d and \u201caliens\u201d merely describe diplomat families. But if diplomat families are foreigners by definition, why even list foreigners and aliens separately? Should birthright citizenship truly rest on grammatical semantics?<\/p>\n<p>By ignoring the plain words of the amendment\u2019s own authors, the court\u2019s majority has enshrined a historical lie. For decades, open-borders advocates have repeatedly told the American public that this debate was permanently settled in 1898 by the Supreme Court\u2019s <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/169\/649\/\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a> in <em>United States v. Wong Kim Ark<\/em> because this understanding benefits the left demographically and electorally.<\/p>\n<p>When the children of illegal aliens and birth tourists turn 18, they are eligible to vote in our elections. When they turn 21, they unlock the power of chain migration, allowing them to sponsor their foreign parents for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-pushes-congress-to-pass-bill-allowing-11-million-immigrants-to-gain-citizenship\/\" title=\"Biden Pushes Congress to Pass Bill Allowing 11 Million Immigrants to Gain ...\">legal permanent residency<\/a>. One only needs to look at the wave of Democratic Socialist <a href=\"https:\/\/www.nbcnews.com\/politics\/2026-election\/democratic-rift-partys-future-widens-lefts-new-york-victories-rcna351737\" target=\"_blank\" rel=\"noreferrer noopener\">victories<\/a> in recent municipal <a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/melat-kiros-becomes-28th-far-left-candidate-to-win-a-democratic-primary-this-year-as-socialists-amass-power\/ar-AA26Z77A?ocid=BingNewsSerp\" target=\"_blank\" rel=\"noreferrer noopener\">elections<\/a>, driven by rapidly shifting urban demographics, to see where this leads.<\/p>\n<p>But the current understanding of Wong Kim Ark is wrong, and the dissenting opinions take direct aim at this lie. As Justice Alito thoroughly <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a>, the holding in <em>Wong Kim Ark<\/em> was explicitly limited to children whose non-citizen parents had established a \u201cpermanent domicil and residence\u201d in the United States.<\/p>\n<p>Because the legal category \u201clawful permanent resident\u201d did not exist in 1898, Wong\u2019s parents were considered \u201clawfully domiciled\u201d in the U.S. under common law because there was no statute making their presence unlawful. Additionally, being Chinese, they could not apply for naturalization.<\/p>\n<p>They had done, as Justice Alito stated, \u201ceverything within their power to express their desire and intent to become Americans.\u201d As such, they were fully part of the national community to the extent that the law allowed at the time.<\/p>\n<p>The promise of American citizenship remains a massive incentive for illegal immigration, while the subversive \u201cbirth tourism\u201d industry will continue to profit openly from the Court\u2019s refusal to defend the nation.<\/p>\n<p>In 2023 alone, mothers who were unauthorized immigrants or held only temporary legal status <a href=\"https:\/\/www.pewresearch.org\/short-reads\/2026\/03\/31\/about-9-of-us-births-in-2023-were-to-unauthorized-or-temporary-legal-immigrant-mothers\/\" target=\"_blank\" rel=\"noreferrer noopener\">accounted<\/a> for an astounding 320,000 births in the United States, representing 9 percent of all U.S. births. If the restrictions of President Trump\u2019s executive order had been properly upheld, roughly 260,000 of those children would not have qualified for automatic citizenship.<\/p>\n<p>Even more alarming is the strategic weaponization of this loophole by adversarial nations such as China. As Peter Schweizer has documented in his <a href=\"https:\/\/www.c-span.org\/program\/washington-journal\/peter-schweizer-on-the-invisible-coup\/675035\" target=\"_blank\" rel=\"noreferrer noopener\">book<\/a>, <em>The Invisible Coup<\/em>, we are currently facing what he terms \u201ccivilizational warfare.\u201d<\/p>\n<p>Wealthy Chinese nationals, sometimes with ties to the Chinese Communist Party, exploit visa loopholes in U.S. territories like Saipan, turning them into tropical maternity wards.<\/p>\n<p>A sophisticated industry <a href=\"https:\/\/nypost.com\/2026\/03\/19\/us-news\/us-territory-where-thousands-of-chinese-moms-give-birth-to-american-babies\/\" target=\"_blank\" rel=\"noreferrer noopener\">charging<\/a> more than $45,000 coaches these birth tourists on how to deceive customs officials so they can deliver their children on American soil and instantly secure a U.S. passport. The result is the creation of what Schweizer <a href=\"https:\/\/nypost.com\/2026\/01\/29\/opinion\/how-china-supercharged-birth-tourism-and-scammed-american-citizenship-for-up-to-1-5-million-babies\/\" target=\"_blank\" rel=\"noreferrer noopener\">calls<\/a> a \u201cManchurian Generation.\u201d<\/p>\n<p>There are an estimated 750,000 to 1.5 million of these \u201cAmerican citizens\u201d currently being raised and indoctrinated in mainland China, taught to hate America and Western civilization as a whole.<\/p>\n<p>As Justice Alito <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5947944-alito-dissent-birthright-citizenship-supreme-court-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">warned<\/a>, this ruling continues to allow a person whose only connection to this country is a brief stay on American soil at birth to travel the world on a U.S. passport, enter our country freely, vote in our elections, run for political office, and retain citizenship even if they harbor deep hatred for America or actively plot to harm it.<\/p>\n<p>If an adversarial government can effectively manufacture U.S. citizens at will through birth tourism, then birthright citizenship needs to be seen as the massive national security threat that it is. The American Revolution itself was premised on the idea that governments derive just powers from the <em>consent<\/em> of the governed, which means citizenship and government must be considered a two-way relationship.<\/p>\n<p>As Justice Alito pointed out, while Congress holds the power to confer citizenship on others by statute, the Constitution itself does not mandate the degradation of American citizenship for everyone who happens to cross our borders.<\/p>\n<p>Birthright citizenship was never intended to serve as a constitutional loophole for trespassers, temporary tourists, or hostile foreign powers. American citizenship is a priceless inheritance, not a cheap commodity to be harvested by those who wish us harm.
