Bagley recounted that he observed Kirk slump after hearing a gunshot, which sounded like a rifle, and saw crowd members running in panic. He took measures to preserve the crime scene,including moving people away from the area and noting gravel disturbances indicative of a sniper\u2019s position on a nearby roof,which he believed was used to fire at Kirk.<\/p>\n<p>during the hearing, Robinson\u2019s lawyers questioned Bagley about campus security protocols at the event, noting limited police presence and lack of coordination. The weeklong proceedings are part of efforts to establish probable cause for Robinson\u2019s trial, which could result in the death penalty. The difference is a handgun is more of a short bang-pop sound. With a rifle, you have it more of a longer violent bang or crackle sound. It\u2019s more of a violent kind of sound. It\u2019s longer. That\u2019s why I recognize it,\u201d he added.<\/p>\n<p class=\"wp-block-paragraph\">Bagley then said he noticed the Losee building on campus had a \u201cdirect line of sight\u201d to where Kirk had been speaking and decided to investigate the roof of the building. He said when he got to the roof of the building, the gravel appeared to have the markings of someone who had lain down and aimed a firearm at Kirk\u2019s tent.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI could see this disturbance of gravel. The maximum punishment for the charges against\u00a0Robinson\u00a0includes the death penalty, which prosecutors have said they intend to pursue.
