Recently, it upheld laws in Idaho adn West Virginia that prohibit biological men from competing in women\u2019s sports, ruling these laws as lawful under Title IX and the equal protection clause. This decision follows a similar 6-3 ruling that supported Tennessee\u2019s ban on transgender surgeries and medication for minors.<\/p>\n<p>One important case involves Washington state\u2019s law allowing minors to undergo gender-affirming surgeries without parental consent and shielding these actions from parents-raising questions about parental rights and state authority. The Supreme Court will hear this challenge, brought by parents and advocacy groups, who argue the law impedes their ability to make decisions for their children.<\/p>\n<p>Other prominent issues include school policies that conceal student gender transitions from parents. The court previously issued a temporary halt on California\u2019s secret transition policies and signaled concern over parental rights to no and participate in their children\u2019s mental health and gender-related decisions.<\/p>\n<p>Additionally, several cases are pending that challenge state laws permitting biological males to participate in female sports, with some ongoing litigation led by conservative organizations. Heco<\/em>x<\/em> and <em>West Virginia v. B.P.J.<\/em>, upholding laws in Idaho and West Virginia, respectively, that ban biological men from women\u2019s sports as lawful under Title IX and the equal protection clause. The ruling came nearly a year after the Supreme Court <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3445518\/supreme-court-upholds-tennessee-ban-transgender-procedures-minors\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3445518\/supreme-court-upholds-tennessee-ban-transgender-procedures-minors\/\">ruled 6-3 in <em>United States v. The high court said Monday it will hear <em>International Partners for Ethical Care, Inc. v. Ferguson<\/em> in its upcoming term, weighing whether parents may sue over Washington state\u2019s law that \u201cdeliberately displaces their decisionmaking role as to \u2018gender transitions\u2019 of their children, and in so doing creates present and likely future impediments to their ability to parent their children as they deem best for them.\u201d<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-1\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-1\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-15\" data-wex-ad=\"art-dsk-inart-1\"><\/div>\n<\/div>\n<\/div>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">The case centers on a law in Washington that allows runaway minors to get transgender surgeries without parental permission, in addition to not requiring the state to inform the parents of their child\u2019s location and condition, by making it a \u201cprotected heal care service.\u201d The petition filed by a parental rights group and a coalition of parents urged the high court to reverse lower court rulings, which had tossed out the lawsuit for lacking standing.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe Ninth Circuit determined that the very objects or targets of the relevant statutes \u2014 parents who do not wish to affirm their children\u2019s gender confusion \u2014 lack standing to challenge those statutes. And it did so despite Petitioners\u2019 alleging current injuries to their ability to parent and the risk of catastrophic future injuries to that ability, and despite the requirement that these allegations must be taken as true at the pleading stage,\u201d the petition to the Supreme Court said.<\/p>\n<p class=\"wp-block-paragraph\">\u201cTo paraphrase Hamlet, \u2018something is rotten\u2019 in standing doctrine when parents who are the object of a \u2018gender-transition\u2019 law have to wait for the (likely) irreparable injury of their child\u2019s actual transition before they can sue. Only this Court can excise the rot,\u201d the petition continued.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">America First Legal, one of the groups supporting the parents in their legal fight against the state, said they are looking forward to the high court hearing the case and are confident the Supreme Court will side with the coalition.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWashington State built a legal regime that targets fit parents, encourages their children to run away, and then keeps mom and dad in the dark while the state takes over,\u201d AFL senior counsel Nick Barry said in a statement. \u201cParents should not have to wait until the irreversible damage is done before they are allowed to walk through the courthouse doors. We are grateful the Supreme Court has agreed to hear this case, and we are confident the Court will agree that parents are injured when the government targets their children like this.\u201d<\/p>\n<h2 id=\"h-challenges-to-state-laws-allowing-biological-men-in-women-s-sports\" class=\"wp-block-heading\">Challenges to state laws allowing biological men in women\u2019s sports<\/h2>\n<p class=\"wp-block-paragraph\">The Supreme Court\u2019s ruling in <em>B.P.J.<\/em> left several questions unanswered about transgender policies, including on sports policies, as Jonathan\u00a0Adler, a professor at William &#038; Mary Law School, noted at a Federalist Society panel following the ruling.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cIt was not deciding the question of whether \u2014 which is pending in some lower courts \u2014 or not there could be a Title IX violation if a state or school fails to exclude biological males from female sports in certain circumstances,\u201d Adler said. \u201cSo there are these cases where claims about how things like locker rooms and stuff are handled, whether that could create a hostile educational environment. The court says it wasn\u2019t deciding that.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The ruling this week affects the 27 states where <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-to-decide-if-title-ix-protections-include-employees\/\" title=\"... to decide if ... protections include employees\">laws barring biological men<\/a> from women\u2019s sports were upheld, but for the other states, where biological males are allowed to compete against biological women in women\u2019s sports, another case would need to be taken up by the Supreme Court to determine whether those other states are breaking the law. Several such cases are working their way up through the judiciary.<\/p>\n<p class=\"wp-block-paragraph\">Alliance Defending Freedom, a conservative law firm that helped bring the pair of cases on women\u2019s sports decided by the high court on Tuesday, has multiple cases challenging state policies allowing biological men in women\u2019s sports moving through lower courts. Last month, the group filed its latest lawsuit, challenging Washington\u2019s policy after a female participating in a high school girls\u2019 wrestling tournament claimed she was sexually assaulted by a biological male fighter she competed against. She said officials did not inform her that her opponent was a biological male who identified as a woman, and she <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/adflegal.org\/wp-content\/uploads\/2026\/06\/kmk-v-washington-interscholastic-activities-association-2026-06-09-complaint.pdf\" type=\"link\" id=\"https:\/\/adflegal.org\/wp-content\/uploads\/2026\/06\/kmk-v-washington-interscholastic-activities-association-2026-06-09-complaint.pdf\">sued<\/a> by claiming the policy is a Title IX violation.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cA 15-year-old girl was sexually assaulted because of political cowardice. Washington state officials insist on pushing gender ideology at all costs \u2014 even at the expense of girls\u2019 safety and privacy,\u201d ADF senior counsel Kate Anderson said in a statement. \u201cOur client\u2019s story is proof of the grave harms caused by lying about biology. This must end \u2014 otherwise, girls will continue getting hurt and violated.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe are urging the court to require state officials to change their policy to ensure that girls\u2019 privacy and safety are protected when they compete in the sports they love. No girl should have to unknowingly wrestle a boy. And at a minimum, parents must be notified before their daughters are matched against male opponents,\u201d Anderson added.<\/p>\n<h2 id=\"h-school-secret-gender-transition-policies\" class=\"wp-block-heading\">School secret gender transition policies<\/h2>\n<p class=\"wp-block-paragraph\">One of the major disputes in the realm of transgender legal battles that appears poised to reach the Supreme Court is school policies that hide student\u00a0gender\u00a0transitions from their parents. The <a href=\"https:\/\/amzn.to\/3YuVZYV\" >policies involve school officials actively hiding<\/a> a student\u2019s use of a different name, pronouns, and bathroom facilities from his or her parents.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Earlier this year, the Supreme Court issued a 6-3 emergency docket ruling that temporarily halted enforcement of California\u2019s secret student gender transition policy, giving a preview of how the high court initially feels on the matter should it make its way to the Supreme Court\u2019s merits docket.<\/p>\n<p class=\"wp-block-paragraph\">The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4478022\/supreme-court-hands-california-parents-win-over-secret-gender-transition-policy\/\">ruling<\/a> in <em>Mirabelli v. Bonta<\/em> pointed to the Supreme Court\u2019s 2025 ruling in <em>Mahmoud v. Taylor<\/em>, which upheld parents\u2019 rights to opt their children out of LGBT materials at school and found that not permitting such an option violated the free exercise clause of the First Amendment.<\/p>\n<p class=\"wp-block-paragraph\">\u201cUnder long-established precedent, parents \u2014 not the State \u2014 have primary authority with respect to \u2018the upbringing and education of children,\u2019\u201d the order in <em>Mirabelli<\/em> said. \u201cThe right protected by these precedents includes the right not to be shut out of participation in decisions regarding their children\u2019s mental health.\u201d<\/p>\n<p class=\"wp-block-paragraph\">John Bursch, senior counsel at ADF, told the <em>Washington Examiner<\/em> earlier this year that the policies allowing for \u201csecret social transitions at public schools\u201d are the \u201cmost critical issue\u201d he hopes the Supreme Court addresses regarding transgender policies across the country.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThat can cause incredible harm to those young people, and parents have a right to know when that\u2019s happening and to not have the schools interfere in the mental health treatment that they\u2019re giving their children,\u201d Bursch said.<\/p>\n<p class=\"wp-block-paragraph\">Despite issuing the emergency docket ruling in <em>Mirabelli<\/em>, the high court <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4544063\/supreme-court-punts-on-school-secret-gender-transition-cases\/\">declined two opportunities<\/a> to take up a case involving the issue on its merits docket in April. The issue could still be brought up by the justices to their merits docket as soon as this term, as cases challenging these policies continue to make their way through federal courts.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4568174\/supreme-court-upholds-ban-biological-men-womens-sports\/\" type=\"post\" id=\"4568174\">SUPREME COURT UPHOLDS BANS ON BIOLOGICAL MEN IN WOMEN\u2019S SPORTS<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court ended its term on Tuesday after issuing the final opinions from the 58 cases it heard from October 2025 through the end of April, with major issues such as <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4593917\/trump-birthright-citizenship-executive-order-struck-down\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4593917\/trump-birthright-citizenship-executive-order-struck-down\/\">birthright citizenship<\/a> and laws banning biological men from women\u2019s sports closing out the term.<\/p>\n<p class=\"wp-block-paragraph\">The high court\u2019s next term starts on Oct. 5, when oral arguments begin for the dozens of cases the justices will hear through the end of April 2027.
