Justice Jackson\u2019s lengthy concurrence is examined for its ideological stance rooted in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-releases-list-of-president-trumps-accomplishments-and-it-is-historic\/\" title=\"White House Releases List of President Trump\u2019s Accomplishments \u2013  And It Is Historic!\">critical race theory<\/a>, using inclusive language about \u201cshared humanity\u201d and rejecting traditional constitutional interpretations.Jackson emphasizes the 14th Amendment as fundamentally anti-racist and antisubordination, advocating for a broad, worldwide submission of American citizenship without regard too birthplace or allegiance. The author criticizes Jackson\u2019s rejection of originalist views, suggesting her interpretation reflects a leftist, globalist agenda aimed at transforming the nation\u2019s understanding of citizenship and justice. The piece also warns that if Democrats regain power,they may dismantle judicial norms,pack the courts,and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >promote radical ideological policies<\/a>,further delegitimizing the judiciary.The author argues this current display of woke ideology seen in Jackson\u2019s opinion undermines public trust in the courts and calls for a revival of Departmentalism to limit judicial overreach and promote constitutional fidelity.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"https:\/\/thefederalist.com\/2026\/07\/02\/scotus-pasting-birth-tourism-into-the-constitution-demands-a-legal-system-rebuild\/\" target=\"_blank\" rel=\"noreferrer noopener\">travesty<\/a> of last week\u2019s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Trump v. Barbara<\/em><\/a>  decision on birthplace citizenship is further highlighted by the fact that the five-vote majority consisted of nominally conservative Chief Justice John Roberts and Justice Amy Coney Barrett joining with all three liberal justices.<\/p>\n<p>While Roberts authored the majority opinion, social-justice warrior Ketanji Brown Jackson could not restrain herself from penning her own 20-page concurrence to specifically target the erudite dissent of Justice Clarence Thomas. Jackson provides no serious intellectual response to the scholarly treatise Thomas produced, yet it is illuminating for other reasons. Recall this is the same woman who, her prestigious position on the court notwithstanding, in December 2024 <a href=\"https:\/\/x.com\/basilianthought\/status\/2072039609299575118?s=12\">performed onstage<\/a> in a Broadway musical all about feminist and LGBT \u201cempowerment.\u201d<\/p>\n<p>Our \u201c<a href=\"https:\/\/x.com\/JohnDoyle\/status\/1897680791691297259\" target=\"_blank\" rel=\"noreferrer noopener\">theater-kid occupied government<\/a>,\u201d to borrow the hypothesis popularized online by John Doyle, routinely attains to new heights of absurdity, as shown in Jackson\u2019s antiracist screed. Jackson\u2019s concurrence is packed with language that reeks of her pervasive critical-theory framework, which sees all of history as a struggle between \u201coppressors\u201d and \u201coppressed.\u201d <\/p>\n<p>Upon reading through it, one is shocked by the ubiquitous presence of CRT buzzwords and phrases such as \u201cantisubordination reset,\u201d \u201cuniversalist approach,\u201d \u201cuniversalist vision of belonging and citizenship,\u201d \u201cracial reckoning,\u201d \u201canticaste engine,\u201d \u201cequal dignity,\u201d \u201cshared humanity of all people,\u201d \u201cperfect equality of every human being,\u201d \u201cinequitable result,\u201d and \u201cuniversalist, antisubordination command.\u201d These phrases could easily have been plucked seamlessly from the writing of Ibram Kendi or from the many <a href=\"https:\/\/x.com\/FischerKing64\/status\/2027422869760930107\" target=\"_blank\" rel=\"noreferrer noopener\">amicus briefs<\/a> filed by the <a href=\"https:\/\/x.com\/NDRepublicans\/status\/2070591920020029462\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Conference of Catholic Bishops<\/a>. Ironically, when typing this article, Microsoft Word\u2019s spell check did not even recognize \u201cantisubordination\u201d and \u201canticaste\u201d as dictionary words. That didn\u2019t seem to stop Justice Jackson. <\/p>\n<p>In Jackson\u2019s opinion, she views the 14th Amendment coming upon the heels of the Civil War as a \u201cremaking of the soul of a Nation beset by rank, entrenched race-based prejudice and inequity.\u201d Thus, to interpret the citizenship clause of the 14th Amendment as only applying to citizens, or even only to those permanently domiciled here, is to revive the discriminatory, racist older America. <\/p>\n<p>She deliberately takes issue with Justice Thomas\u2019 argument that the citizenship clause was only meant to grant citizenship to freed slaves and was <em>not <\/em>intended to apply to foreigners on American soil who owe allegiance to a foreign government. As she puts it, \u201cThe Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, not a mere spot treatment for the dark stain of slavery.\u201d <\/p>\n<p>To interpret the citizenship clause <em>as it was meant <\/em>by its framers would be unacceptable. Who cares if illegal aliens from Latin America or Chinese birth tourists are subject to a foreign power? If America seeks to very reasonably exclude them from birthplace citizenship (<a href=\"https:\/\/thefederalist.com\/2026\/05\/20\/national-sovereignty-is-at-stake-in-imminent-supreme-court-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">consonant with the original meaning of the 14th Amendment<\/a>), that is an exclusionary rejection of the radically inclusive vision Jackson would impose on the Constitution through her distorted reading. In her grand narrative of moral absolutes, echoing the 1619 Project, America\u2019s story is a narrative of oppression, slavery, exploitation, and genocide; America\u2019s only admirable features are its leftist crusades against oppression. America is only worthy to the extent it atones for its past sins by endless programs of antidiscrimination and reparations for the oppressed. <\/p>\n<p>Furthermore, there is no evidence in her 20-page concurrence that Jackson sees or posits <em>any <\/em>limitation upon American citizenship. She sees the 14th Amendment as a rejection of any kind of discrimination whatsoever, giving us a \u201cuniversalist, antisubordination command\u201d based upon the \u201cshared humanity of <em>all <\/em>people.\u201d Anyone who happens to be born on American soil can be an American citizen, no matter how absurd the consequences. But why stop there? Isn\u2019t it exclusionary to limit it to American soil? Why should the 8 billion people of the globe have to get to American soil to be born American citizens? Why can\u2019t we just have global American citizenship to atone for America\u2019s past sins of racism, colonialism, sexism, and so on? <\/p>\n<p>An all-too-typical conservative response to witnessing the unintelligent antics of Jackson is to laugh it off with, \u201cWhat a ridiculous example of what happens when you pick a judge solely based on her skin color and sex rather than her merits! Heck, she doesn\u2019t even know what a woman is!\u201d While such mockery is duly warranted, it\u2019s misleading. Jackson is a very effective leftist jurist whose ignorance of law, the Constitution, and originalist interpretations is an <em>aid <\/em>to her side, not a hindrance. She openly flies her colors, does not conceal her intentions, and always manages to rule in favor of Democrats in her votes on the court. <\/p>\n<p>More importantly, her writing provides a great <a href=\"https:\/\/x.com\/SamuelMKimzey\/status\/2072063977371144590\" target=\"_blank\" rel=\"noreferrer noopener\">reminder<\/a> that if ever the Democrats are permitted to regain the Senate and the presidency, they will not hesitate to abolish the filibuster and pack not just the Supreme Court but the federal judiciary more broadly with an infinite number of \u201cjudges\u201d whose legal opinions will be indistinguishable from the antiracist, globalist, histrionic slop Jackson issued in this latest decision. The fact that the Trump administration has already faced such relentless opposition from within the judiciary, most especially from the <a href=\"https:\/\/x.com\/StephenM\/status\/1902338216130179147\" target=\"_blank\" rel=\"noreferrer noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/stop-pretending-witness-testimony-doesnt-qualify-as-evidence-in-gop-voter-disenfranchisement-lawsuit\/\" title=\"Stop Pretending Witness Testimony Doesn\u2019t Qualify as \u201cEvidence... in GOP Voter Disenfranchisement Lawsuit\">federal district court judges<\/a><\/a>, is because Obama and Biden appointed <a href=\"https:\/\/x.com\/SatoshiAncap\/status\/1968967022856855942\" target=\"_blank\" rel=\"noreferrer noopener\">so many such types<\/a> already, including a <a href=\"https:\/\/thefederalist.com\/2025\/03\/25\/a-third-of-all-dc-district-judges-were-not-born-in-united-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">startling number of foreign-born judges<\/a>. This will be the future of the judiciary and thus the country if the right is not able to successfully appoint their own fighters to the courts and also retake power from the judiciary. <\/p>\n<p>One advantage that comes from such a theatrical display from Jackson is that it serves to further delegitimize the institution of the Supreme Court and the judiciary. The courts hold sway over the nation because people believe them to be a legitimate source of political power and esteem. To the extent they abase themselves through naked displays of woke hatred for America, the Constitution, and American citizens, they will continue to expose their illegitimacy. Exposing the fraud of the courts and the legal system is a key step to building political pushback and making long-overdue reforms. <\/p>\n<p>In this regard, the absurdity of the court\u2019s acquiescing in the most liberal stance on birthplace citizenship possible \u2014 affirmed proudly by Jackson\u2019s voice \u2014 is just one more sign we must revive <a href=\"https:\/\/americanmind.org\/salvo\/trump-departmentalism-and-the-judiciary\/\" target=\"_blank\" rel=\"noreferrer noopener\">departmentalism<\/a> and stop treating the courts generally with a godlike reverence and deference. <\/p>\n<hr>\n<p>      Samuel Kimzey is a doctoral student at Hillsdale College and a 2025 Publius Fellow at the Claremont Institute.
