Ed Markey basically believes that the Supreme Court needs to be packed, and packed with liberals.<\/p>\n<p>Heck, if he could get away with it, he\u2019d just put the entirety of the graduating class of Harvard Law on there, although maybe he\u2019d limit it to those who were members in good standing of Students for Justice in Palestine. Gotta keep the occasional Ben Shapiro that the Cambridge, Massachusetts, institution accidentally turns out off that packed court at all costs, because you don\u2019t want that cancer to spread.<\/p>\n<p>For the majority of the time that I have had to professionally care about the ramblings of Ed Markey \u2014 almost six years, actually \u2014 he has believed this. Beginning in 2020, when Justice Ruth Bader Ginsburg died and was to be replaced by Amy Coney Barrett, Markey said that \u201cwe must abolish the filibuster and expand the Supreme Court\u201d if President Donald Trump nominated a justice.<\/p>\n<p>His dumb reasoning, like that of so many Democrats, was that there was some kind of \u201cprecedent\u201d set by the fact that the Senate refused to vote on former President Barack Obama\u2019s replacement for the late Justice Antonin Scalia in 2016.<\/p>\n<p>This, Markey said, \u201cset the precedent.\u201d The \u201cprecedent,\u201d such as it was, involved the fact that the GOP had a Senate majority, and Obama had picked so many fights with them that even the most moderate of candidates didn\u2019t have the votes. (And he didn\u2019t do that: You may remember his nominee, Merrick Garland, as the Biden-era attorney general who cracked down on such obvious terror threats as, um, <a href=\"https:\/\/www.westernjournal.com\/parents-group-speaks-reportedly-targeted-fbi-merrick-garland-terrorist-threats\/\" target=\"_blank\" rel=\"noopener\">concerned parents of schoolchildren<\/a> and <a href=\"https:\/\/www.westernjournal.com\/hawley-demands-answers-garland-apparent-lie-senate-fbi-targeting-catholics\/\" target=\"_blank\" rel=\"noopener\">\u201ctraditional Catholics.\u201d<\/a>)<\/p>\n<p>In the case of Ginsburg\u2019s death, Trump had the majority and a nominee who could get the votes. Cry harder.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Mitch McConnell set the precedent. No Supreme Court vacancies filled in an election year. If he violates it, when Democrats control the Senate in the next Congress, we must abolish the filibuster and expand the Supreme Court.<\/p>\n<p>\u2014 Ed Markey (@EdMarkey) <a href=\"https:\/\/x.com\/EdMarkey\/status\/1307122232850870274?\">September 19, 2020<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>He\u2019s basically been on one ever since; in 2021 and 2023, he introduced legislation that would expand the bench to 13 because of what he <a href=\"https:\/\/www.markey.senate.gov\/news\/press-releases\/05\/16\/2023\/sen-markey-rep-johnson-announce-legislation-to-expand-supreme-court-restore-its-legitimacy-alongside-sen-smith-reps-bush-and-schiff\" target=\"_blank\" rel=\"noopener\">called<\/a> \u201cstolen\u201d seats. These bills were doomed because some Democrats live in reality \u2014 or at least commute to it sometimes for work \u2014 and know this would touch off a process of mutually assured destruction of the court, which would see it balloon to the size of Wyoming, depending on who was in power, all with no stable body of case law to draw from because the decisions would change from administration to administration.<\/p>\n<p>This is the bargain we make for having a functioning Supreme Court. Occasionally, it doesn\u2019t go our way as conservatives, even though Republican presidents have nominated the majority of the justices. This week was one of those weeks, when the court ruled that the <a href=\"https:\/\/www.westernjournal.com\/clarence-thomas-obliterates-courts-birthright-citizenship-ruling-says-devalues-american\/\" target=\"_blank\" rel=\"noopener\">14th Amendment provides for birthright citizenship<\/a> even for people who are not legally here and therefore not, to use that amendment\u2019s language, necessarily \u201csubject to the jurisdiction thereof\u201d in this country.<\/p>\n<p>Barrett was more or less the swing vote on whether this constitutionally held up; while it was a 6-3 vote in <a href=\"https:\/\/thehill.com\/wp-content\/uploads\/sites\/2\/2026\/06\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noopener\">Trump v. Barbara<\/a> on whether or not birthright citizenship stood, Justice Brett Kavanaugh filed a brief concurrence on the substance of the case while acknowledging that he was basing it upon the fact that Congress had adopted birthright citizenship legislation with language virtually identical to that of the 14th Amendment, indicating that it was not a constitutional but a <em>legislative<\/em> issue that Congress could rectify, but which President Trump could not via executive order.<\/p>\n<p>Ergo, on constitutional grounds, it\u2019s basically Barrett \u2014 whom Markey so vehemently fought against, and has used when he\u2019s waved the bloody flag of \u201cstolen\u201d seats to rally people around court expansion \u2014 who\u2019s responsible for the decision. It is still worth noting that, in no world where the filibuster still exists, will the repeal of the legislation that Kavanaugh\u2019s concurrence hinged upon happen. Nuke the filibuster, however, and court expansion becomes a <em>fait accompli<\/em>.<\/p>\n<p>So, two of those \u201cstolen\u201d seats effectively delivered the Democrats a decision they wanted \u2014 needed, in fact, one might say, given the party\u2019s reliance on demographic drift to deliver results. At least to Ed Markey, this should be proof that the system works, right?<\/p>\n<p>Right?<\/p>\n<p>We\u2019re talking about it, so obviously the answer is no.<\/p>\n<p>Here\u2019s Sen. Markey on MS NOW \u2014 you may not have caught it, since <a href=\"https:\/\/www.westernjournal.com\/watch-tom-hanks-painful-insult-msnow-interviewer-goes-viral-obama-presidential-center-opening\/\" target=\"_blank\" rel=\"noopener\">nobody catches MS NOW these days<\/a> \u2014 saying that, yes, he\u2019s going to bang the drum loudly and proudly about expanding the court if and when there\u2019s a Democratic Senate and a Democratic president:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Democrat Senator Ed Markey is leading Democrats\u2019 attempt to pack the Supreme Court:<\/p>\n<p>\u201cI am the author of the court expansion bill\u2026the only way to solve this problem in a very short period of time is to expand the Supreme Court\u2026\u201d <a href=\"https:\/\/t.co\/K950tx925a\">pic.twitter.com\/K950tx925a<\/a><\/p>\n<p>\u2014 RNC Research (@RNCResearch) <a href=\"https:\/\/x.com\/RNCResearch\/status\/2072374898853326928?\">July 1, 2026<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>\u201cI am the author of the court expansion bill. The Republicans stole two Supreme Court seats in 2016 and 2020. That\u2019s what\u2019s giving them their supermajority,\u201d Markey <a href=\"https:\/\/youtu.be\/PE4x_fbjPMY?si=UkNotP5yNJQV79MV&#038;t=431\" target=\"_blank\" rel=\"noopener\">told<\/a> host Alicia Menendez.<\/p>\n<p>\u201cThe only way to solve this problem in a very short period of time is to expand the Supreme Court by four seats, up to 13. <strong>That would then restore the 7-6 majority<\/strong>, which should be in place right now. [Emphasis ours.] And we have to fight for that, and we can do that statutorily. It does not require a constitutional amendment. That has to be at the top of the agenda, and that\u2019s what I\u2019m talking to my colleagues about right now.\u201d<\/p>\n<p>There you have it: It\u2019s not about the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/israel-is-reforming-its-judiciary-its-not-perfect-its-democracy\/\" title=\"Israel Is Reforming Its Judiciary.\u00a0It...s Not Perfect, It...s Democracy.\u00a0\">court making decisions based<\/a> on the law; it\u2019s about the court acting as an unelected legislative branch that is permanently Democrat. Even under Franklin Delano Roosevelt, who tried this when the New Deal didn\u2019t get through as quickly or to the scope that he wanted, got rebuked by the legislative branch for trying to court-pack. Instead, they just attained what they wanted by letting the court drift slowly to the left over the period of a century.<\/p>\n<p>This scam worked for years, in part because the Democrats controlled the Senate for so long, and then in part because they were willing to filibuster Republican <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-judiciary-chairman-says-gun-control-is-top-priority\/\" title=\"Senate Judiciary Chairman Says Gun Control Is \u2018Top Priority...\">judicial nominees<\/a> who were anywhere to the right of Potter <a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/movie-day-at-the-supreme-court-or-i-know-it-when-i-see-it-a.html\" target=\"_blank\" rel=\"noopener\">\u201cI Know It When I See It\u201d<\/a> Stewart.<\/p>\n<p>But, in 2013, then-Senate Majority Leader Harry Reid got greedy. The Nevada Democrat was under pressure from the Obama White House to get Republicans to stop filibustering his judicial nominees the way that Obama\u2019s Democrats used to filibuster Republican nominees when there was a Republican president. Reid exercised the nuclear option, figuring, hey, what\u2019s the worst that can happen?<\/p>\n<p>They lost the majority in the Senate in 2014 and the White House in 2016 \u2014 that\u2019s what happened. And suddenly, it wasn\u2019t milquetoast Potter Stewarts, but Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.<\/p>\n<p>If you need to ask yourself why they need to pack the court with justices like Amy Coney Barrett still delivering for them on occasion, there\u2019s your answer.<\/p>\n<p>They don\u2019t get their <a href=\"https:\/\/www.westernjournal.com\/fact-check-abortion-declined-since-roe-v-wade-struck-three-years-ago\/\" target=\"_blank\" rel=\"noopener\">Roe or Casey<\/a> decisions anymore on abortion, or <a href=\"https:\/\/www.westernjournal.com\/texas-republican-party-declares-homosexuality-abnormal-lifestyle-calls-scotus-overturn-obergefell-v-hodges\/\" target=\"_blank\" rel=\"noopener\">Obergefell<\/a> on gay marriage, or Furman v. Georgia and Roper v. Simmons on the application of the death penalty, or Lawrence v. Texas bestowing a right to homosexual behavior that doesn\u2019t exist in the Constitution, or <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/539\/306\/\" target=\"_blank\" rel=\"noopener\">Grutter v. Bollinger<\/a> on so-called <a href=\"https:\/\/www.westernjournal.com\/west-point-sued-director-admissions-brags-happens-white-applicants\/\" target=\"_blank\" rel=\"noopener\">\u201crace-conscious admissions\u201d<\/a> at universities. None of this stuff, which couldn\u2019t be passed in Congress but which got enacted because the Democrats gamed the system, would have ever flown \u2014 and it doesn\u2019t usually fly now, all because Harry Reid and Barack Obama got greedy.<\/p>\n<p>On the occasions it <em>does<\/em> fly, Ed Markey is still grousing about the fact that he doesn\u2019t have that majority he believes is the Democrats\u2019 birthright. Barrett betrayed conservatives on birthright citizenship, and he\u2019s still unhappy. Why? The Supreme Court is not about jurisprudence for Democrats. It\u2019s about dominance.
