Prior to the lawsuit, Assistant Attorney General Harmeet Dhillon had offered California officials a chance to negotiate a settlement, which they declined. The DOJ argues that the law is presumptively unconstitutional under the Second Amendment because it restricts citizens&#8217; ability to acquire these firearms, which are popular in the U.S. Dhillon emphasized that such bans infringe on legal gun ownership and that the lawsuit aims to protect Second Amendment rights. The law, signed by Governor Gavin Newsom, prohibits licensed dealers from selling certain semiautomatic handguns but dose not outlaw current ownership or private resale. The DOJ also challenges California\u2019s handgun roster, claiming it <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-long-push-to-abolish-new-jerseys-county-line-ballot-system\/\" title=\"Efforts intensify to end New Jersey&#039;s &#039;county-line&#039; ballot practice\">violates constitutional rights<\/a>. This legal action follows recent Supreme Court rulings affirming citizens&#8217; rights to carry firearms for self-defence. The federal government is seeking to halt enforcement of the Glock ban and the handgun roster in California. Newsom signed the bill into law last fall after the California legislature passed the measure.<\/p>\n<p class=\"wp-block-paragraph\">The law, however, does not outlaw current ownership of the pistols or the private resale of such firearms.<\/p>\n<p class=\"wp-block-paragraph\">The complaint also challenges California\u2019s existing handgun roster, a list of specific pistols and revolvers legally approved for retail sale, arguing it\u2019s unconstitutional as well.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">In making its argument, the DOJ pointed to a recent <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" type=\"post_tag\" id=\"203\">Supreme Court<\/a> ruling that struck down a sweeping gun law in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/hawaii\/\" type=\"post_tag\" id=\"1259\">Hawaii<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe United States Supreme Court recently reaffirmed that the Second and Fourteenth Amendments protect the right to carry handguns outside the home for self-defense in <em>Wolford v. Lopez<\/em>,\u201d the department said in a press release. \u201cThe Court reiterated that states cannot prevent citizens from using commonly used firearms for self-defense.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The federal government is asking the U.S. District Court for the Central District of California to prevent the state and law enforcement from enforcing the Glock ban and the handgun roster. The law was supposed to take effect on Wednesday, but it remains temporarily blocked after state judges intervened.
