Surrogacy denies <a href=\"https:\/\/thefederalist.com\/2023\/12\/04\/the-conservative-pro-life-case-against-surrogacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">children\u2019s natural rights<\/a> to life, to a mother and father, and to freedom from commodification; <a href=\"https:\/\/thefederalist.com\/2025\/08\/27\/united-nations-report-slavery-like-rent-a-womb-industry-should-be-globally-banned\/\" target=\"_blank\" rel=\"noreferrer noopener\">exploits vulnerable women<\/a>; and creates reproduction loopholes for <a href=\"https:\/\/thefederalist.com\/2025\/07\/29\/rising-popularity-of-rent-a-womb-industry-emboldens-pedophiles-to-buy-proximity-to-kids\/\" target=\"_blank\" rel=\"noreferrer noopener\">pedophiles<\/a> and other bad actors unfit to be parents. The most imminent and possibly important justification for taking swift and legal action to shut down America\u2019s proxy pregnancy market is the increasing exploitation of birthplace citizenship by America\u2019s sworn enemies.<\/p>\n<p>The 14th Amendment\u2019s citizenship clause <a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/\" target=\"_blank\" rel=\"noreferrer noopener\">specifies<\/a> that \u201cAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.\u201d According to <a href=\"https:\/\/thefederalist.com\/2026\/07\/01\/roberts-the-sacred-bond-between-nation-and-citizen-requires-us-to-blow-it-up\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chief Justice John Roberts<\/a>, Justice Amy Coney Barrett, and the high bench\u2019s Democrat-nominated justices, however, babies of illegal aliens and surrogates paid by wealthy foreigners are just as American as you or I simply because they were <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/scotus-says-babies-of-illegal-aliens-ccp-birth-tourists-are-us-citizens-because-of-magic-dirt\/\" target=\"_blank\" rel=\"noreferrer noopener\">born on U.S. dirt<\/a>. <\/p>\n<p>It doesn\u2019t matter, as Justice Samuel Alito <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/thomas-alito-in-birthplace-citizenship-ruling-john-roberts-imposes-feudal-darkness\/\" target=\"_blank\" rel=\"noreferrer noopener\">warned in his dissent<\/a>, if a child is born \u201cto a mother who is here for only a brief time.\u201d If a pregnant mother can board a plane to the U.S. to deliver her baby anywhere in America, that child is considered by Roberts et al. a full U.S. citizen entitled to all of the benefits of the best country in the world. <\/p>\n<p>\u201cThe Court has repurposed the Fourteenth Amendment to protect its own set of preferred rights that the Reconstruction Congress never contemplated and that cannot find support in its text,\u201d Justice Clarence Thomas wrote in his dissent. \u201cToday, the Court does so again by recognizing a constitutional right to citizenship for the children of all foreign birth tourists and illegal aliens.\u201d<\/p>\n<p>Selling the promise of U.S. citizenship for foreigners\u2019 babies, and eventually foreigners themselves, is incredibly <a href=\"https:\/\/thefederalist.com\/2026\/07\/01\/citizenship-has-become-a-financial-product-ripe-for-exploitation-by-birth-tourists-and-illegals\/\" target=\"_blank\" rel=\"noreferrer noopener\">profitable<\/a>. In fact, there\u2019s an entire subset of the American reproduction market devoted to helping people in other babies get the anchor baby experience of their dreams.<\/p>\n<p>As Federalist Senior Correspondent Chris Bray <a href=\"https:\/\/thefederalist.com\/2026\/07\/01\/citizenship-has-become-a-financial-product-ripe-for-exploitation-by-birth-tourists-and-illegals\/\" target=\"_blank\" rel=\"noreferrer noopener\">further explained<\/a>: <\/p>\n<blockquote>\n<p>\u201cThere are <a href=\"https:\/\/www.instagram.com\/modabirthandtourismservices\/\" target=\"_blank\" rel=\"noreferrer noopener\">many businesses<\/a> clustered around this industry, and there have been many more. They die and come back under new names as they get shut down. Suburban cities around Los Angeles have assigned police detectives and code enforcement officers to their <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">birth hotel problem<\/a>, because people buy houses and cram them full of beds for pregnant foreign visitors. Citizenship is a <em>product<\/em>, <a href=\"https:\/\/nypost.com\/2026\/05\/14\/us-news\/house-oversight-committee-launches-probe-of-four-birth-tourism-companies-in-us\/\" target=\"_blank\" rel=\"noreferrer noopener\">marketed<\/a> like consumer goods.\u201d<\/p>\n<\/blockquote>\n<p>Once overseas parents secure a child with full American citizenship, including key documentation like birth certificate, passport, and Social Security number, their pathway to American citizenship becomes easier <a href=\"https:\/\/www.ilrc.org\/sites\/default\/files\/2023-03\/How%20USC%20can%20petition%20their%20parents%20for%20LPR_March%202023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">as the kid gets older<\/a>, and it\u2019s <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/eb-5-immigrant-investor-program\" target=\"_blank\" rel=\"noreferrer noopener\">cheaper than some visas.<\/a><\/p>\n<p>The U.S. Department of Justice announced shortly after SCOTUS\u2019 disastrous decision that it planned to \u201cprioritize the prosecutions of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-says-the-us-civil-war-was-basically-about-protecting-chicom-birth-tourists\/\" title=\"SCOTUS Says Civil War Was About Protecting Birth Tourists\">birth tourism schemes<\/a> across the country.\u201d <\/p>\n<p>\u201cActors seeking to exploit loopholes to obtain automatic citizenship for their children pose a national security threat and will be brought to justice,\u201d the DOJ declared. The announcement comes mere weeks after the State Department shuttered <a href=\"https:\/\/thefederalist.com\/2026\/06\/10\/state-department-ends-scams-that-sent-hundreds-of-pregnant-women-to-us-to-exploit-birthplace-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">multiple birth tourism networks in Europe and Africa<\/a>.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Birth tourism schemes exploit our immigration laws and often violate our criminal laws. The Department of Justice will prioritize the prosecutions of birth tourism schemes across the country. Actors seeking to exploit loopholes to obtain automatic citizenship for their children\u2026<\/p>\n<p>\u2014 U.S. Department of Justice (@TheJusticeDept) <a href=\"https:\/\/x.com\/TheJusticeDept\/status\/2071997614959280523?ref_src=twsrc%5Etfw\">June 30, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Prosecuting anchor baby businesses is a good start, but it\u2019s simply not enough to keep America\u2019s national sovereignty intact. Even <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-the-meaning-and-value-of-american-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">President Donald Trump\u2019s \u201cprotecting the meaning and value of American citizenship\u201d<\/a> executive order, the subject of the high bench\u2019s birthplace decision, <a href=\"https:\/\/thefederalist.com\/2025\/01\/31\/trumps-executive-order-still-allows-foreigners-to-buy-u-s-citizenship-via-surrogacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">fell short<\/a> of the measures required to secure the nation for the people who are participants in its social compact.<\/p>\n<p>Any policy that permits foreigners to hire American surrogates to carry and deliver their children stateside means the thriving birth tourism market will continue. The most effective way to curb that abuse of American citizenship is a ban on cross-border commercial surrogacy.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Birthright citizenship upheld. One <a href=\"https:\/\/www.fertstert.org\/article\/S0015-0282(23)02142-8\/abstract\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> from 2024 suggested that Chinese nationals made up 41.7 percent of the surrogacy contracts between foreigners and American women between 2014 and 2019. During that same time period, foreigners\u2019 use of the American birthplace citizenship surrogacy scheme increased by 78 percent.<\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2023\/12\/14\/americas-rent-a-womb-industry-lures-an-alarming-number-of-chinese-nationals\/\" target=\"_blank\" rel=\"noreferrer noopener\">[RELATED: America\u2019s Rent-A-Womb Industry Lures An Alarming Number Of Chinese Nationals]<\/a><\/p>\n<p>Take Chinese billionaire Xu Bo\u00a0for example. Thanks to lax U.S. surrogacy laws, the Chinese billionaire who has never lived in the states\u00a0reportedly\u00a0used American surrogacy agencies <a href=\"https:\/\/thefederalist.com\/2025\/12\/16\/chinese-billionaires-u-s-baby-factory-exposes-birthright-citizenship-scam\/\" target=\"_blank\" rel=\"noreferrer noopener\">to father more than 100 children.<\/a> Most, if not all, of these babies are born on U.S. soil and automatically entitled to American citizenship benefits even though they will be raised in China. <\/p>\n<p>The case of<strong><em> <\/em><\/strong><a href=\"https:\/\/thefederalist.com\/2026\/02\/12\/surrogacy-left-these-21-children-parentless-after-alleged-abuse-until-its-banned-they-wont-be-the-last\/\" target=\"_blank\" rel=\"noreferrer noopener\">Guojun Xuan and Silvia Zhang<\/a>, who took advantage of California\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/surrogacy-left-these-21-children-parentless-after-alleged-abuse-until-its-banned-they-wont-be-the-last\/\" title=\"Surrogacy Left These 21 Children Parentless After Alleged Abuse\">lax rent-a-womb policies<\/a> to commission the creation of around two dozen children via multiple simultaneous surrogacy before those kids were seized amid allegations of abuse, holds similar implications. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The Supreme Court decision on birthright citizenship ultimately means that foreign nationals\u2013often from China\u2013can continue to buy babies via American surrogates, and in the process exploit our immigratino system and national security.
