A reluctance to \u201crock the boat\u201d of <a href=\"https:\/\/constitutioncenter.org\/the-constitution\/supreme-court-case-library\/united-states-v-wong-kim-ark-1898\" target=\"_blank\" rel=\"noreferrer noopener\">more than a century<\/a> of bad law permeates the thinking of Chief Justice John Roberts, author of the <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">5-4 ruling<\/a> declaring unconstitutional the campaign promise Trump kept on the first day of his second term in office. <\/p>\n<p>Such cowardice in guarding the Constitution has too often marked Roberts\u2019 tenure as the chief of the nation\u2019s high court. From his similar constitutional contortionist act in 2020 <a href=\"https:\/\/www.scotusblog.com\/cases\/department-of-homeland-security-v-regents-of-the-university-of-california\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Department of Homeland Security v. Regents of the University of California<\/em><\/a>  to his ridiculous <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/567\/519\/\" target=\"_blank\" rel=\"noreferrer noopener\">reinvention<\/a> of the established understanding of a <a href=\"https:\/\/www.scotusblog.com\/2012\/06\/dont-call-it-a-mandate-its-a-tax\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201ctax\u201d<\/a> in playing savior to Obamacare, Roberts has sacrificed judicial courage at the twin altars of comity and continuity. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The legacy of the John Roberts court is cowardice and incoherence.<\/p>\n<p>\u2014 Sean Davis (@seanmdav) <a href=\"https:\/\/x.com\/seanmdav\/status\/2071972310261657996?ref_src=twsrc%5Etfw\">June 30, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<h2>\u2018The Value of American Citizenship\u2019<\/h2>\n<p>President George W. Bush\u2019s nominee for chief justice has described himself \u2014 and all judges \u2014 as <a href=\"https:\/\/www.scrippsnews.com\/politics\/supreme-court\/impeachment-trial-may-focus-on-chief-justice-s-role-as-umpire\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cumpires.\u201d<\/a> They don\u2019t make the rules, he said. They apply them. <\/p>\n<p>\u201cThey make sure everybody plays by the rules. But it is a limited role. Nobody ever went to a ballgame to see the umpire,\u201d he quipped. <\/p>\n<p>His latest opinion, <a href=\"https:\/\/thefederalist.com\/tag\/trump-v-barbara\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Trump v. Barbara<\/em><\/a>, reads more like an umpire who has ignored the foul lines. <\/p>\n<p>Donald J. Trump was born to rock the boat. The open border left and the Chamber of Commerce, <a href=\"https:\/\/www.cato.org\/blog\/economic-benefit-birthright-citizenship\" target=\"_blank\" rel=\"noreferrer noopener\">cheap labor crowd<\/a> railed against the president\u2019s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-the-meaning-and-value-of-american-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> aimed at \u201cProtecting The Meaning And Value of American Citizenship.\u201d The order asserts what many constitutional law experts \u2014 including Justice Alito \u2014 understand the 14th Amendment to mean.<\/p>\n<p>\u201c[T]he privilege of United States citizenship does not automatically extend to persons born in the United States,\u201d the president\u2019s directive states. That includes those availing themselves of the lucrative and growing industry of <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/scotus-says-the-us-civil-war-was-basically-about-protecting-chicom-birth-tourists\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cbirth tourism.\u201d<\/a><\/p>\n<p>Trump was clear: the U.S. government would no longer issue or accept documents recognizing U.S. citizenship of anchor babies, estimated to make up about<a href=\"https:\/\/cis.org\/Richwine\/Births-Illegal-Immigrants-and-LongTerm-Temporary-Visitors\" target=\"_blank\" rel=\"noreferrer noopener\"> 7 percent<\/a> of the nation\u2019s births. <\/p>\n<p>Previous presidents wouldn\u2019t go there. Trump, of course, is a different president. <\/p>\n<p>The <a href=\"https:\/\/amzn.to\/3YuVZYV\" >usual leftist suspects immediately sued<\/a> him. They are, of course, <a href=\"https:\/\/www.aclu.org\/press-releases\/groups-representing-plaintiffs-respond-to-supreme-court-birthright-citizenship-ruling\" target=\"_blank\" rel=\"noreferrer noopener\">gloating<\/a> today. Roberts, Justice Amy Coney Barrett and, to a degree, Justice Brett Kavanaugh, gave them reason to rejoice. Kavanaugh\u2019s beef was that birthplace citizenship policy is the domain of Congress, not the president. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">So close. 5-4 decision favoring birthplace citizenship. Pres. Trump should immediately amend his EO to apply to U.S. Territories which are not auto-bound by the 14th Amendment. Trump should keep pushing the issue wherever he can and force the court to reckon with the logic of its\u2026 <a href=\"https:\/\/t.co\/BbE8d6OBNh\">https:\/\/t.co\/BbE8d6OBNh<\/a><\/p>\n<p>\u2014 Roger Severino (@RogerSeverino_) <a href=\"https:\/\/x.com\/RogerSeverino_\/status\/2071974640012976484?ref_src=twsrc%5Etfw\">June 30, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<h2>\u2018The Right to Have Rights\u2019<\/h2>\n<p>Roberts and Barrett agreed with the plaintiffs that children born to parents \u201cunlawfully or temporarily present in the United States\u201d \u201csatisfy both elements\u201d of the 14th Amendment\u2019s citizenship clause: \u201cthey are \u2018born . . . in the United States\u2019 and \u2018subject to the jurisdiction thereof.\u2019\u201d <\/p>\n<p>Roberts relies on the trite \u201cnation of immigrants\u201d mantra at the expense of first principles, specifically that we are a nation of laws. And those founding laws mean little if they are bent to the whims of political expedience and political correctness. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>In 1993, the late Senator Harry Reid (D-NV) introduced a bill that would&#8217;ve eliminated birthright citizenship for the children of illegal aliens and clarified which babies would be entitled to US citizenship (US citizen or lawful permanent resident mothers).<\/p>\n<p>The &#8220;Immigration\u2026 <a href=\"https:\/\/t.co\/z0cSlHpGq1\">pic.twitter.com\/z0cSlHpGq1<\/a><\/p>\n<\/div>\n<p>\u2014 Bill Melugin (@BillMelugin_) <a href=\"https:\/\/x.com\/BillMelugin_\/status\/2072010087682510905?ref_src=twsrc%5Etfw\">June 30, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>The opinion effectively legitimizes DEI-hire Justice Ketanji Brown Jackson\u2019s <a href=\"https:\/\/www.foxnews.com\/politics\/justice-jackson-sparks-online-uproar-after-linking-birthright-citizenship-to-stealing-a-wallet-in-japan\" target=\"_blank\" rel=\"noreferrer noopener\">fatuous idea<\/a> during oral arguments that if she stole a wallet while on vacation in Japan, she would be bound by her \u201callegiance\u201d to the country\u2019s criminal laws and the consequences therein.<\/p>\n<p>\u201dSo there\u2019s this relationship, even though I\u2019m just a temporary traveler, I\u2019m just on vacation in Japan, I\u2019m still locally owing allegiance in that sense,\u201d Jackson said. <\/p>\n<p>In a very real sense that makes no sense. Visitors are bound by the laws of the countries in which they travel. Kind of like millions of \u201cundocumented\u201d migrants are bound \u2014 or should be bound \u2014 by U.S. immigration law. They don\u2019t owe an allegiance to the country that should be enforcing said laws. And therein lies a huge problem with birthplace citizenship. <\/p>\n<p>But Roberts is riding with a long-standing bastardization of the 14th Amendment\u2019s intent, which was written to grant citizenship to freed slaves and their children, not the children of millions of illegal immigrants looking for a pass to stay. <\/p>\n<p>\u201cCitizenship, then and now, was the right to have rights \u2014 to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to \u2018every free-born person in this land.\u2019 \u2026 We keep that promise today,\u201d Roberts wrote. <\/p>\n<p>That reads like the thinking of jurist who would rather win friends and influence people than right a popular but deeply flawed interpretation of the constitution. <\/p>\n<p>The \u201cinstitutionalist\u201d has a reputation and a record on that front. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Here&#8217;s my more fulsome analysis of today&#8217;s Supreme Court decision on the President&#8217;s birthright citizenship exec order, published at <a href=\"https:\/\/x.com\/theammind?ref_src=twsrc%5Etfw\">@theammind<\/a>. On this, the 250th Anniversary of the Declaration of Independence, the majority seems to have overlooked &#8220;consent of the governed.&#8221;\u2026<\/p>\n<p>\u2014 John Eastman (@DrJohnEastman) <a href=\"https:\/\/x.com\/DrJohnEastman\/status\/2072029802576449968?ref_src=twsrc%5Etfw\">June 30, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<h2>\u2018Middle Way\u2019 Roberts <\/h2>\n<p>In 2012\u2019s baffling  <a href=\"https:\/\/www.supremecourt.gov\/opinions\/11pdf\/11-393c3a2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>NFIB v. Sebelius<\/em><\/a> decision on Obamacare, Roberts was the deciding vote in abandoning the <a href=\"https:\/\/www.heritage.org\/courts\/commentary\/it-wasnt-tax-it-was-tax-court-upholds-obamacare-individual-mandate\" target=\"_blank\" rel=\"noreferrer noopener\">founding principles<\/a> of tying representation to taxation and the <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artI-S7-C1-1\/ALDE_00013355\/\" target=\"_blank\" rel=\"noreferrer noopener\">origination clause<\/a>. He justified that abandonment via a twisted bridge of constitutional interpretation, insisting \u201cit is reasonable to construe what Congress has done [creating an individual mandate] as increasing taxes on those who have a certain amount of income, but choose to go without health insurance. Such legislation is within Congress\u2019s power to tax.\u201d<\/p>\n<p>While Roberts\u2019 defended his extra-constitutional ruling on <a href=\"https:\/\/reason.com\/2021\/06\/17\/for-the-third-time-the-roberts-court-rescues-obamacare\/\" target=\"_blank\" rel=\"noreferrer noopener\">multiple occasions,<\/a> he didn\u2019t always feel that way. In fact he originally sided with his fellow conservatives in the minority \u201con the grounds that it went beyond Congress\u2019s power to regulate interstate commerce,\u201d according to <em>The Chief<\/em>, a book written by longtime SCOTUS reporter Joan Biskupic. No originalist, Roberts was originally right. <\/p>\n<p>He caved to public pressure, fearing striking down the \u201cAffordable Care Act\u201d would create too many waves.  <\/p>\n<p>\u201cAfter trying unsuccessfully to find a middle way with [Justice Anthony] Kennedy, who was \u2018unusually firm\u2019 and even \u2018put off\u2019 by the courtship, Roberts turned to the Court\u2019s two moderate liberals, Stephen Breyer and Elena Kagan,\u201d a <a href=\"https:\/\/www.theatlantic.com\/magazine\/archive\/2019\/03\/john-roberts-biography-review\/580453\/\" target=\"_blank\" rel=\"noreferrer noopener\">review<\/a> of the book published in The Atlantic asserts. \u201cThe threesome negotiated a compromise decision that upheld the ACA\u2019s individual mandate under Congress\u2019s taxing power, while striking down the Medicaid expansion.\u201d<\/p>\n<p>Roberts withstood the intense pressure to change his mind in the 2022 <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/19-1392_6j37.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Dobbs v. Jackson Women\u2019s Health Organization<\/em><\/a>  decision that overturned nearly 50 years of bad abortion law under <a href=\"https:\/\/www.oyez.org\/cases\/1971\/70-18\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Roe v. Wade<\/em><\/a>. But court watchers say the <a href=\"https:\/\/thefederalist.com\/2026\/05\/11\/scotus-liberals-caught-slow-walking-another-ruling-to-help-dems\/\" target=\"_blank\" rel=\"noreferrer noopener\">violence and the chaos<\/a> ginned up by the left \u2014 including threats on the conservative justices\u2019 lives \u2014 after a draft ruling was leaked left an impression on the chief justice\u2019s mind. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">One of the most destructive and outrageous decisions in the long history of the Supreme Court. American citizenship is not the birthright of the world. It belongs only and solely to Americans. Roberts doesn\u2019t like messy, as he made clear in his year-end message to the judiciary in late December. <\/p>\n<p>\u201cChief Justice John Roberts scrupulously avoided touching on contentious issues facing judges at a time of widespread discord within the federal judiciary,\u201d NBC News <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-john-roberts-year-end-report-trump-threats-rcna248516?cid=sm_npd_nn_tw_ma&#038;taid=6956f318728b090001cb542e&#038;utm_campaign=trueanthem&#038;utm_medium=social&#038;utm_source=twitter\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>.<\/p>\n<p>Kumbaya. <\/p>\n<p>He\u2019s done little to rein in activist judges, particularly in the realm of nationwide injunctions. Doing so might upset activist judges. Roberts has pushed back on calls for impeaching such jurists, however.  <\/p>\n<p>The chief justice\u2019s opinion on birthplace citizenship further cements his legacy of his preference for comity over conflict, political consideration over principle, to the peril of the 250 year-old republic. <\/p>\n<p>\u201cThe legacy of the John Roberts court is cowardice and incoherence,\u201d The Federalist\u2019s CEO and co-founder Sean Davis wrote Tuesday on X. <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
