He argued Congress could amend the federal citizenship statute, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/8\/1401\">8 U.S.C. \u00a7 1401(a)<\/a>, to establish exceptions for children born to foreign nationals who are in the country illegally or temporarily.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Justices <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/clarence-thomas\/\">Clarence Thomas<\/a>, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/samuel-alito\/page\/2\/\">Samuel Alito<\/a>, and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/neil-gorsuch\/\">Neil Gorsuch<\/a> dissented, arguing the Constitution does not require such a broad interpretation of birthright citizenship.<\/p>\n<h2 id=\"h-has-the-supreme-court-completely-shut-the-door\" class=\"wp-block-heading\">Has the Supreme Court completely shut the door?<\/h2>\n<p class=\"wp-block-paragraph\">That remains the central dispute among Republicans on Capitol Hill.<\/p>\n<p class=\"wp-block-paragraph\">Trump argued shortly after the ruling that Congress could still end birthright citizenship through legislation.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cThe Supreme Court upheld Birthright Citizenship \u2026 but we can easily make it up in Congress through Legislation,\u201d Trump posted on Truth Social. \u201cCongress should start TODAY.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Several Republicans quickly agreed.<\/p>\n<p class=\"wp-block-paragraph\">Sen. Eric Schmitt (R-MO) said the court \u201cMAY have left Congress a door,\u201d adding that he would introduce legislation while continuing to pursue a constitutional amendment.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cThe Supreme Court has made its decision, now Congress needs to respond,\u201d said Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/rick-scott\/\">Rick Scott<\/a> (R-FL). \u201cWe need to be voting on these EVERY WEEK until we provide the American people with an answer.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Meanwhile, House Speaker <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/mike-johnson\/\">Mike Johnson<\/a> (R-LA) also expressed disappointment, saying the ruling \u201csubjects the country to serious challenges going forward.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Reacting to the decision just hours after it came down, several legal experts said the majority opinion appears to leave little room for Congress to accomplish Trump\u2019s goal through ordinary legislation.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Jonathan Adler, a professor at William &#038; Mary Law School, said Trump\u2019s interpretation stretches the opinion beyond what the court actually held.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI do not share the president\u2019s interpretation,\u201d Adler said during a Federalist Society panel following the ruling on Tuesday. \u201cThe chief\u2019s opinion of the court resolves the meaning of the 14th Amendment.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cThere are other things in immigration law that [provide] other tools, and certainly we\u2019ve seen that <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/reason.com\/volokh\/2026\/06\/25\/trump-administration-sweeps-all-of-the-other-immigration-cases-at-scotus\/\">the court has been very sympathetic to fairly strict readings of immigration statutes<\/a> that might prevent entry of people, say, who are engaged in birth tourism,\u201d said Adler, who wrote a <em>Volokh Conspiracy<\/em> blog last week saying the administration has swept all of its other immigration cases at the high court.<\/p>\n<p class=\"wp-block-paragraph\">Also participating in the panel was Supreme Court advocate Kannon Shanmugam, who said, \u201cI think the court was seemingly trying to shut the door\u201d on any legislative approaches to ending birthright citizenship.<\/p>\n<p class=\"wp-block-paragraph\">Eric Wessan, who helped represent Iowa after the state joined an amicus brief supporting the Trump administration, called the outcome \u201cthe worst-case scenario\u201d for Trump.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe legal holding is the worst-case scenario,\u201d Wessan told the <em>Washington Examiner<\/em> following the panel discussion. \u201cBut the 5-4 vote is not.\u201d<\/p>\n<h2 id=\"h-why-was-the-5-4-vote-significant\" class=\"wp-block-heading\">Why was the 5-4 vote significant?<\/h2>\n<p class=\"wp-block-paragraph\">Although the outcome against Trump\u2019s birthright citizenship executive order itself was widely expected, the narrow 5-4 constitutional split was not.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe default assumption, if you would have asked most law professors, is that the holding would have been 9-0,\u201d Wessan said.<\/p>\n<p class=\"wp-block-paragraph\">He said the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >narrower margin reflects growing originalist scholarship questioning<\/a> the conventional understanding of the citizenship clause, even though a majority of the justices ultimately rejected those arguments.<\/p>\n<p class=\"wp-block-paragraph\">Wessan also suggested the issue may not be permanently settled.<\/p>\n<p class=\"wp-block-paragraph\">\u201cA different case could present the question differently down the line,\u201d he said.<\/p>\n<p class=\"wp-block-paragraph\">Wessan\u2019s position was reflected in the final part of Thomas\u2019s written dissent, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\">where Thomas accused the majority<\/a> of \u201crepurpos[ing] the Fourteenth Amendment to protect its own set of preferred rights that the Reconstruction Congress never contemplated and that cannot find support in its text.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cI am not sure that today\u2019s opinion will stand the test of time. The Citizenship Clause \u2018added greatly to the dignity and glory of American citizenship,&#8217;\u201d Thomas wrote. \u201cToday\u2019s opinion devalues that citizenship. I respectfully dissent.\u201d<\/p>\n<h2 id=\"h-would-a-constitutional-amendment-be-realistic\" class=\"wp-block-heading\">Would a constitutional amendment be realistic?<\/h2>\n<p class=\"wp-block-paragraph\">Not under the current political landscape.<\/p>\n<p class=\"wp-block-paragraph\">A constitutional amendment requires approval by two-thirds of both the House and Senate before being ratified by three-fourths of the states.<\/p>\n<p class=\"wp-block-paragraph\">Republicans currently lack those margins in Congress, making such an effort extraordinarily unlikely.<\/p>\n<p class=\"wp-block-paragraph\">The Constitution also provides another avenue through a convention called by two-thirds of state legislatures. That method has never been successfully used to adopt an amendment, and any proposal would still require ratification by three-fourths of the states.<\/p>\n<h2 id=\"h-are-republicans-shifting-their-focus-to-birth-tourism\" class=\"wp-block-heading\">Are Republicans shifting their focus to birth tourism?<\/h2>\n<p class=\"wp-block-paragraph\">Rather than attempting to revoke citizenship for children born in the U.S. to illegal parents, some Republicans are turning their attention toward restricting so-called birth tourism \u2014 travel to the U.S. for the primary purpose of giving birth so a child acquires U.S. citizenship.<\/p>\n<p class=\"wp-block-paragraph\">Rep. Andy Ogles (R-TN) announced Tuesday that he plans to introduce the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/atrupar\/status\/2072049813323964882\">Anchors Away Act<\/a>, legislation that would prohibit pregnant foreign nationals from entering the U.S. for that purpose.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe are literally going to be dropping Anchors Away,\u201d Ogles said in an interview on Fox News\u2019s <em>The Will Cain Show<\/em>. \u201cIt is time for Congress to pass a law that says you cannot come here. You cannot have a baby on U.S. soil and exploit this loophole.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Federal policy already targets birth tourism in more limited ways.<\/p>\n<p class=\"wp-block-paragraph\">The State Department amended its B visa regulations in 2020 to require consular officers to deny tourist visas when they have reason to believe an applicant\u2019s primary purpose is traveling to the U.S. to give birth so a child will obtain U.S. citizenship.<\/p>\n<p class=\"wp-block-paragraph\">U.S. Customs and Border Protection also says pregnancy alone does not prohibit someone from entering the U.S. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.help.cbp.gov\/s\/article\/Article1838?language=en_US#:~:text=Although%20there%20are%20no%20specific,Border%20Protection%20(CBP)%20Officer.\">According to<\/a> agency guidance updated in November, admission remains at the discretion of CBP officers, who consider factors including the expected delivery date, intended length of stay, whether the traveler has sufficient medical insurance, and whether the traveler intends to return home. CBP says officers may deny entry if they determine a traveler is likely to become a public charge because the government would have to provide medical care.<\/p>\n<p class=\"wp-block-paragraph\">The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-justice\/\">Justice Department<\/a> also signaled Tuesday that enforcement against birth tourism will become a priority despite the Supreme Court\u2019s ruling.<\/p>\n<p class=\"wp-block-paragraph\">\u201cBirth tourism schemes exploit our immigration laws and often violate our criminal laws,\u201d the DOJ said in a statement. \u201cThe Department of Justice will prioritize the prosecutions of birth tourism schemes across the country.
