The order directed that only children born on American soil to legal residents are automatically citizens of the United States.<\/p>\n<p>The Fourteenth Amendment <a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/\" target=\"_blank\" rel=\"noopener\">states<\/a>, in part, \u201cAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.\u201d<\/p>\n<p>Chief Justice John Roberts, writing for the majority, concluded, \u201cChildren born in the United States to parents unlawfully or temporarily present are \u2018subject to the jurisdiction\u2019 of the United States and are citizens at birth under the Fourteenth Amendment\u2019s Citizenship Clause.\u201d<\/p>\n<p>Thomas, in his dissent, in which he was joined by Justice Neil Gorsuch, noted, as Trump <a href=\"https:\/\/www.westernjournal.com\/nbc-anchor-caught-deceptively-altering-14th-amendment-trump-interview\/\" target=\"_blank\" rel=\"noopener\">previously argued<\/a>, that the Fourteenth Amendment was passed in the immediate aftermath of the <a href=\"https:\/\/www.westernjournal.com\/five-challenging-times-presidents-appealed-declaration-independence-inspire-americans-world\/\" target=\"_blank\" rel=\"noopener\">Civil War<\/a>. It was in direct response to the Dred Scott v. Sandford Supreme Court decision of 1857, which held that blacks were not citizens.<\/p>\n<p>\u201cBoth the Civil Rights Act [of 1866] and the Citizenship Clause [of the Fourteenth Amendment] guaranteed citizenship to persons born and domiciled in the United States regardless of their race. Neither guaranteed citizenship to persons who were not domiciled in the United States,\u201d Thomas wrote.<\/p>\n<p>\u201cBlacks were entitled to citizenship because they were Americans. Today, the Court does so again by recognizing a constitutional right to citizenship for the children of all foreign birth tourists and illegal aliens.\u201d<\/p>\n<p>Birth tourism accounts for up to 26,000 babies being born annually in the United States, and then being taken back to their home countries with American citizenship rights, according to the <a href=\"https:\/\/www.migrationpolicy.org\/article\/birth-tourism-trump\" target=\"_blank\" rel=\"noopener\">Migration Policy Institute<\/a>.<\/p>\n<p>Further, the Center for Immigration Studies <a href=\"https:\/\/cis.org\/Richwine\/Births-Illegal-Immigrants-and-LongTerm-Temporary-Visitors\" target=\"_blank\" rel=\"noopener\">reported<\/a> last year that between 225,000 and 250,000 births to illegal immigrants occurred in 2023, or 7 percent of the total 3.6 million births in the U.S.<\/p>\n<p>Thomas concluded, \u201cI am not sure that today\u2019s opinion will stand the test of time. The Citizenship Clause added greatly to the dignity and glory of American citizenship. Today\u2019s opinion devalues that citizenship.\u201d<\/p>\n<p>Justice Samuel Alito wrote in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/illinois-supreme-court-rules-assault-weapons-ban-constitutional-in-4-3-vote\/\" title=\"Illinois Supreme Court upholds &#039;assault weapons&#039; ban in close vote.\">separate dissenting opinion<\/a>, \u201cIn sum, the Fourteenth Amendment confers citizenship on a person who is born in this country or naturalized only if that person is also \u2018not subject to any foreign power.\u2019\u201d<\/p>\n<p>\u201cThe Court interprets \u2018subject to the jurisdiction thereof\u2019 differently. In its view, the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >phrase simply means subject<\/a> to the laws that apply to everyone who is present within the country\u2019s borders,\u201d he continued.<\/p>\n<p>Alito observed, \u201cThe Court\u2019s interpretation preserves a powerful incentive to enter or remain in this country illegally. Immigrants naturally prefer affluent countries where economic opportunities are available. Other than Canada, the United States will be the only affluent nation where birth alone is enough to establish citizenship.\u201d<\/p>\n<p>He ended, \u201cIf the Fourteenth Amendment required these results, the country would have to live with them or amend the Constitution. But the Fourteenth Amendment does not include the rule the Court now imposes on the country.
