The majority, led by Justice Brett Kavanaugh, stated that these restrictions violate the first Amendment as they impair political parties&#8217; ability to communicate and support their candidates effectively. The dissent,led by Justice Kagan,argued that the ruling undermines measures designed to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/us-senator-indicted-on-bribery-charges-prosecutors\/\" title=\"US Senator charged with bribery: Prosecutors\">prevent political corruption<\/a> and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/schiff-calls-for-big-tech-censorship-in-2024-election-45\/\" title=\"Schiff Calls for Big Tech Censorship in 2024 Election\">protect democratic integrity<\/a>. The ruling was 6-3, with Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson in the dissent. <\/p>\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/thefederalist.com\/tag\/nrsc-v-fec\/\" target=\"_blank\" rel=\"noreferrer noopener\">case<\/a>, known as <em>NRSC v. FEC<\/em>, stems from a 2022 challenge to a provision of the Federal Election Campaign Act (FECA) that restricted coordinated spending campaigns between political parties and candidates. The Republican plaintiffs \u2014 which included then-Ohio Sen. J.D. Vance \u2014 alleged that such limitations violated the First Amendment.<\/p>\n<div id=\"fdrlst__b89e9-3605671627\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Writing for the majority, Justice Brett Kavanaugh <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-621_h315.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that the FECA limits at issue are in \u201ctension with the text of the First Amendment,\u201d and thus \u201crestricts political parties\u2019 speech in support of their own candidates during political campaigns.\u201d These restrictions, he added, \u201cimpair the party\u2019s traditional forms of communication such as advertisements; preclude parties from amplifying the voice of their adherents; impose additional monetary costs and burdens on political parties; and inflict a \u2018stifling effect on the ability of the party to do what it exists to do.\u2019\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cIn short, constitutional text, history, and precedent establish that the political-party coordinated-expenditure limits violate the First Amendment,\u201d Kavanaugh wrote. \u201cWhether the Democratic party, the Republican party, or other parties, all political parties and candidates going forward can compete equally under the same rules regarding coordinated expenditures and can structure their fundraising, spending, and political speech on a level playing field as they see fit within the law.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Writing for the dissent, Kagan accused the majority of \u201crewrit[ing] the rules, to allow circumvention of the contribution limits.\u201d She argued that these rules are \u201cneeded to protect our democracy\u2019s integrity.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cI\u2019m not sure what to call a remnant of a remnant, but that is what the Court has left today. And the result will be what Justice Breyer warned of: a legal regime increasingly unable to stop political corruption, and thus to preserve our institutions\u2019 democratic legitimacy,\u201d Kagan wrote. <\/p>\n<p class=\"wp-block-paragraph\">Tuesday\u2019s decision marks yet <a href=\"https:\/\/thefederalist.com\/2026\/05\/27\/judge-hands-russia-hoaxer-marc-elias-major-loss-by-upholding-floridas-new-congressional-map\/\" target=\"_blank\" rel=\"noreferrer noopener\">another<\/a> major defeat for Russia hoaxer <a href=\"https:\/\/thefederalist.com\/tag\/marc-elias\/\" target=\"_blank\" rel=\"noreferrer noopener\">Marc Elias<\/a>. The <a href=\"https:\/\/amzn.to\/3YuVZYV\" >anti-election integrity lawyer argued<\/a> in favor of the FECA limitations <a href=\"https:\/\/thefederalist.com\/2025\/12\/10\/campaign-finance-and-the-first-amendment-take-center-stage-at-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">before the court<\/a> last year.<\/p>\n<p class=\"wp-block-paragraph\">The high court\u2019s decision reverses the 6th Circuit Court of Appeals\u2019 ruling on the matter and remands the case back to the lower judiciary for further proceedings consistent with the majority opinion. <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
