The decision was based on the belief that seperate sports teams for biological males and females are reasonable due to inherent physical differences, and they are essential to ensuring fair competition and safety for female athletes. Justice Brett Kavanaugh emphasized that states and organizations like the NCAA are justified in maintaining these distinctions to offer equal opportunities without risking injury or competitive imbalance.Several justices offered additional views: Justice Clarence Thomas highlighted that sex is an immutable biological characteristic; Justice Neil Gorsuch questioned whether Title IX clearly prohibits gender-based sports teams; and Justice Sonia Sotomayor dissented on the equal protection claim,expressing concern about fairness and inclusivity. Justice Ketanji Brown Jackson interpreted Title IX as accommodating individuals&#8217; gender identities beyond sex assigned at birth. The ruling was welcomed by groups like Alliance Defending Freedom, which sees it as a victory for girls\u2019 sports. The decision reverses lower court opinions and sends cases back for further proceedings consistent with the Supreme Court\u2019s majority view.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Supreme Court upheld state laws protecting women\u2019s sports from trans-identifying men on Tuesday. The ruling was 6-3 in the reasoning along ideological lines. <\/p>\n<p>The decision stems from <em><a href=\"https:\/\/thefederalist.com\/tag\/little-v-hecox\/\" target=\"_blank\" rel=\"noreferrer noopener\">Little v. Hecox<\/a><\/em>  and <em><a href=\"https:\/\/thefederalist.com\/tag\/west-virginia-v-b-p-j\/\" target=\"_blank\" rel=\"noreferrer noopener\">West Virginia v. B.P.J.<\/a><\/em>, which dealt with challenges brought against Idaho and West Virginia\u2019s laws ensuring fairness for female athletes. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2026\/06\/09\/here-are-the-biggest-outstanding-supreme-court-cases-to-keep-an-eye-out-for\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, legal specialists, female athletes, and Republican attorneys general \u201chave all highlighted how <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/here-are-the-biggest-outstanding-supreme-court-cases-to-keep-an-eye-out-for\/\" title=\"Here Are The Biggest Outstanding SCOTUS Cases To Look For\">males\u2019 distinct biological advantage<\/a> over women puts them at a competitive advantage over female athletes and imposes physical risks to their safety.\u201d<\/p>\n<p>Writing for the majority in <em>B.P.J.<\/em>, Justice Brett Kavanaugh <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-43_2b35.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that <a href=\"https:\/\/amzn.to\/3YuVZYV\" >state laws permitting schools<\/a> to \u201cdetermine eligibility for women\u2019s and girls\u2019 sports based on biological sex\u201d do not violate the 14th Amendment\u2019s equal protection clause or Title IX. He emphasized that \u201c[s]eparate sports teams for biological males and biological females are reasonable: Given the inherent physical differences between the sexes, allowing only biological females to play on women\u2019s and girls\u2019 teams can reduce the risk of physical injury and ensure fair competition.\u201d<\/p>\n<p>\u201cThe two States here \u2014 along with 25 other States, the IOC, the USOPC, and the NCAA \u2014 have concluded at this time that women and girls should be allowed to compete for those life-changing opportunities on an equal playing field, without fear of physical injury from biological males or being forced to compete against biological males,\u201d Kavanaugh wrote. \u201cConsistent with Title IX and the Equal Protection Clause, we hold that the States may maintain women\u2019s and girls\u2019 sports for biological females. They may determine eligibility for women\u2019s and girls\u2019 sports based on biological sex. The Constitution and Title IX do not require an overhaul of women\u2019s and girls\u2019 sports throughout America.\u201d<\/p>\n<p>While joining the majority opinion in full, Justice Clarence Thomas authored a concurrence outlining two additional points. He reiterated that \u201ctransgender\u201d is not a suspect class \u2014 a point that he and Justices Samuel Alito and Amy Coney Barrett <a href=\"https:\/\/thefederalist.com\/2025\/07\/09\/upcoming-trans-athletes-cases-give-scotus-the-chance-to-fix-what-its-u-s-v-skrmetti-decision-didnt\/\" target=\"_blank\" rel=\"noreferrer noopener\">raised<\/a> in the court\u2019s <a href=\"https:\/\/www.oyez.org\/cases\/2024\/23-477\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Skrmetti<\/em> decision<\/a> last year \u2014 and underscored the importance of acknowledging biological reality.  <\/p>\n<p>\u201cMen and boys with gender dysphoria are not women or girls, even if they believe that they are. Sex is an immutable \u2018biological\u2019 characteristic \u2026; it is binary; and \u2018man\u2019 and \u2018woman,\u2019 \u2018boy\u2019 and \u2018girl,\u2019 are the terms that correspond to adults and children of each sex,\u201d Thomas wrote. \u201cTo use language to obscure reality \u2014 to show \u2018indifference regarding the truth\u2019 \u2014 is to lie to the public and cease to treat our fellow citizens \u2018as equal[s].&#8217;\u201d<\/p>\n<p>Justice Neil Gorsuch also authored a concurring opinion laying out his thoughts on two separate points. He argued that \u201cTitle IX does not clearly and unambiguously alert funding recipients that they are prohibited from sponsoring sports teams restricted to biological women or girls,\u201d and that the court\u2019s <em>B.P.J.<\/em> decision is supported by its 2020 <a href=\"https:\/\/www.oyez.org\/cases\/2019\/17-1618\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Bostock<\/em> ruling<\/a>, which bizarrely codified so-called \u201cgender identity\u201d into Title VII of the Civil Rights Act. <\/p>\n<p>Writing on behalf of the court\u2019s Democrat appointees, Justice Sonia Sotomayor concurred in the judgement in part and dissented in part. While agreeing with the majority\u2019s holding that \u201cB. P. J.\u2019s Title IX claim fails, although on a narrower basis than that on which the majority relies,\u201d she argued that the court \u201cat this stage of the litigation, gets the answer wrong\u201d on shooting down B.P.J.\u2019s equal protection claim. <\/p>\n<p>\u201cPlaying sports can lead to benefits that are immeasurable, and many are understandably invested in ensuring that competition stays fair and safe,\u201d Sotomayor wrote. \u201cBecause the majority, however, inflicts a hardship on those it disfavors without giving them the fair and full opportunity the Constitution requires to litigate their contentions, I respectfully dissent.\u201d<\/p>\n<p>While joining Sotomayor\u2019s opinion in full, Justice Ketanji Brown Jackson wrote separately to advance trans ideology. Employing leftist jargon, she argued that \u201cTitle IX makes room for individuals to live in the gender they choose; it cares not just about sex assigned at birth but also about individuals\u2019 ability to match (or not) their gender presentation to their gender identity.\u201d<\/p>\n<p>Tuesday\u2019s decision received positive remarks from Alliance Defending Freedom, which backed Idaho and West Virginia in the legal battle to protect women\u2019s sports. In a <a href=\"https:\/\/x.com\/ADFLegal\/status\/2071967560090738750?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>, ADF President Kristen Waggoner hailed the ruling as \u201ca victory for every girl who refused to stay quiet in the face of injustice.\u201d<\/p>\n<p>\u201cMen cannot be women, and no drug erases the male athletic advantage. I\u2019m grateful to Attorneys General Ra\u00fal Labrador and JB McCuskey and our clients for their courage,\u201d she said. <\/p>\n<p>The court\u2019s decision reverses the opinions of the lower courts and remands the cases back to their respective jurisdictions for further proceedings consistent with the majority opinion. <\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
