The Court&#8217;s decision ties this interpretation to the Civil War era and the historical intent of the amendment, suggesting that the goal was to allow foreigners to gain U.S. citizenship by having children on American soil. This ruling is criticized for its historical accuracy by Justice Clarence Thomas and others, who argue that it misrepresents the amendment\u2019s original purpose. The decision has led to concerns over birth tourism scams, exemplified by Chinese nationals and businesses facilitating births in the U.S. to secure citizenship for their children. Critics contend that the Court&#8217;s reasoning is flawed and driven by political motives rather than historical fact.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Supreme Court ruled Tuesday that the Civil War was apparently fought so that illegal aliens and Chinese nationals who have set up <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dear-justice-roberts-the-same-constitution-would-never-authorize-anchor-babies\/\" title=\"The \u2018Same Constitution\u2019 Would Never Authorize Anchor Babies\">birth tourism companies<\/a> in the United States could have anchor babies.<\/p>\n<p>The Supreme Court held that \u201cChildren born in the United States to parents unlawfully or temporarily present are \u2018subject to the jurisdiction\u2019 of the United States and are citizens at birth under the Fourteenth Amendment\u2019s Citizenship Clause.\u201d Four of the justices agreed that the 14th Amendment does not confer automatic citizenship.<\/p>\n<p>In justifying their decision, the high court argued the ruling is rooted in the Civil War itself. According to the Court\u2019s historical account (which was rebuked by Justice Clarence Thomas), one of the greatest achievements of the generation that fought the Civil War and created the 14th Amendment was to permit millions of foreign nationals to come here, drop a baby out, and have that child become \u201cAmerican.\u201d <\/p>\n<p>\u201cIn the midst of the Civil War, Attorney General Edward Bates issued a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >landmark opinion citing key authorities<\/a>, including <em>Calvin\u2019s<\/em> <em>Case<\/em> and Kent\u2019s Commentaries, rejecting the premise that \u2018citizenship is ever hereditary,\u2019 and declaring that \u2018every person born in the country is, at the moment of birth, <em>prima facie<\/em> a citizen, . . . without any reference to race or color,&#8217;\u201d the Court wrote. The opinion then tied that to Reconstruction.<\/p>\n<p>\u201cA year after General Lee\u2019s surrender at Appomattox, Congress sought to turn Bates\u2019s opinion into law. The result was the Civil Rights Act of 1866\u2026 What the Civil Rights Act began, the Fourteenth Amendment, and its reputation of <em>Dred Scott,<\/em> would finish.\u201d<\/p>\n<p>According to the narrow majority, Congress sought \u201cto put the \u2018great question of citizenship\u2019 \u2018beyond the legislative power\u2019 altogether, to settle the issue once and for all.\u201d<\/p>\n<p>\u201cThe Fourteenth Amendment achieved its aim,\u201d the court held, as if the \u201caim\u201d of the 14th Amendment was ever to guarantee that illegal aliens or foreign nationals who set up birth tourism schemes could have \u201cAmerican\u201d babies. \u201cThe Citizenship Clause mirrored the common law\u2019s criteria for citizenship, starting with territory ( a child must be \u2018born \u2026 in the United States\u2019) and ending with sovereign power (a child must be \u2018subject to the jurisdiction\u2019 of the United States). A child born on American soil and subject to American law was made an American citizen.\u201d<\/p>\n<p>It\u2019s a ludicrous assertion that now legitimizes the scams being run by the Chinese, for example. Take <a href=\"https:\/\/thefederalist.com\/2025\/12\/16\/chinese-billionaires-u-s-baby-factory-exposes-birthright-citizenship-scam\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chinese billionaire Xu Bo<\/a>, who has <a href=\"https:\/\/www.yahoo.com\/news\/articles\/chinese-billionaires-create-mega-families-080000540.html\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a> fathered more than 100 children \u2014 possibly more \u2014 through surrogacy agencies in the United States. Xu himself has never lived in the United States. But, as a result of the twisted logic that was codified by the high court, his children are citizens and can run for president one day. But Xu isn\u2019t the only Chinese national purposely having children in the United States. Take the <a href=\"https:\/\/www.havemybabyinmiami.com\" target=\"_blank\" rel=\"noreferrer noopener\">Have My Baby in Miami<\/a> clinic, which is a business that allows foreign nationals using temporary visitor visas to travel to the country to give birth and make a paperwork American. Republicans in Congress are <a href=\"https:\/\/thefederalist.com\/2026\/05\/19\/lawmakers-open-investigation-into-thriving-birth-tourism-economy\/\" target=\"_blank\" rel=\"noreferrer noopener\">investigating<\/a> the birth tourism schemes.<\/p>\n<p>But as Thomas wrote in his dissent, \u201cthe Court\u2019s account is not historically accurate.\u201d<\/p>\n<p>Thomas points out that the Court twisted an amendment \u201cdesigned and understood to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/matt-gaetz-proposes-trump-tucker-ticket\/\" title=\"Gaetz suggests Trump-Tucker ticket\">secure equal rights<\/a> for the freed blacks\u201d for \u201cpolitical projects that the Reconstruction Congress did not support.\u201d<\/p>\n<p>As The Federalist\u2019s CEO and co-founder Sean Davis <a href=\"https:\/\/x.com\/seanmdav\/status\/2071970729789153453?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> on X: \u201cThe Roberts\/Barrett take on the 14th is entirely inconsistent with actual history, language, and common sense. They\u2019re not actually stupid enough to believe it.
