At age 76, Alito has long been expected to be one of the next justices who could retire.<\/p>\n<p class=\"wp-block-paragraph\">Earlier Tuesday, the high court released several landmark rulings before recessing for the summer. Chief among these decisions was the one concerning birthright citizenship, as the court ruled President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" type=\"post_tag\" id=\"4\">Donald Trump\u2019s<\/a> 2025 executive order violated the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/14th-amendment\/\" type=\"post_tag\" id=\"4711\">14th Amendment<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">Trump attempted to prevent citizenship from passing to children born to parents who are in the country illegally or temporarily. The Supreme Court rejected the administration\u2019s argument that such children should not be granted automatic citizenship.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Chief Justice John Roberts wrote the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-365_4hdj.pdf\">6-3 majority opinion<\/a>, while Alito was one of the three conservative justices who disagreed.<\/p>\n<p class=\"wp-block-paragraph\">In his dissenting opinion, Alito called the birthright citizenship case \u201cone of the most important decisions\u201d in the Supreme Court\u2019s history and said the court \u201cmade a serious mistake\u201d in ruling against the federal government.<\/p>\n<p class=\"wp-block-paragraph\">\u201cAs interpreted by the Court today, the Fourteenth Amendment confers citizenship on virtually everyone who happens to be born in this country, including the children of \u201cbirth tourists,\u201d women who come here solely for the purpose of giving birth to a child and then promptly return home,\u201d Alito wrote, addressing a key part of the administration\u2019s argument.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cCareful analysis of the text of the Fourteenth Amendment and the process that led to its adoption shows that it does not degrade the concept of United States citizenship in this way,\u201d he continued. \u201cInstead, the Fourteenth Amendment confers citizenship on only those children who, at birth, owe allegiance solely to this country.\u201d<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4593917\/trump-birthright-citizenship-executive-order-struck-down\/\"><strong>SUPREME COURT STRIKES DOWN TRUMP\u2019S BIRTHRIGHT CITIZENSHIP EXECUTIVE ORDER<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">Alito clarified that interpreting the 14th Amendment correctly doesn\u2019t mean \u201cuprooting the millions of children who were born here to mothers who entered or remained in this country illegally\u201d because they are not responsible for their parents violating immigration policy.
