Republican National Committee centered on a Mississippi law that allows mail-in ballots to be counted up to five business days after Election Day if they have the proper postmark.<\/p>\n<p>During oral <a href=\"https:\/\/www.youtube.com\/watch?v=ghrl33H29V0&#038;pp=ygUmYWxpdG8gZWxlY3Rpb24gZGF5IGFyZ3VtZW50IG1pc2lzc2lwcGk%3D\" target=\"_blank\" rel=\"noopener\">arguments<\/a> in March, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/high-ranking-democrats-pledge-to-preserve-roe-without-necessary-backing-in-congress\/\" title=\"High-Ranking Democrats Pledge to Preserve Roe Without Necessary Backing in Congress\">high court appeared poised<\/a> to strike down the law, with Justice Samuel Alito arguing that events like Independence Day, Memorial Day, and Election Day are all \u201cparticular days.\u201d<\/p>\n<p><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/ghrl33H29V0?si=HXqkwD1PcAu2T2KD\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>Justice Amy Coney Barrett and Chief Justice John Roberts crossed ideological lines to join the court\u2019s three liberals, Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson, however, shattering that speculation.<\/p>\n<p>Law professor Jonathan Turley posted about the outcome on social media Monday morning, writing that Barrett had authored the majority opinion, while Alito wrote the dissent, joined in full by Justices Clarence Thomas, Neil Gorsuch, and in part by Brett Kavanaugh.<\/p>\n<p>\u201cThe court rejects the preemption of a Mississippi law that allows mail-in ballots to be counted as long as they are postmarked by, and received within, five days of Election day,\u201d Turley wrote on X.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">\u2026We have today\u2019s first opinion. The court rejects the preemption of a Mississippi law that allows\u2026<\/p>\n<p>\u2014 Jonathan Turley (@JonathanTurley) <a href=\"https:\/\/x.com\/JonathanTurley\/status\/2071595375903789165?\">June 29, 2026<\/a><\/p>\n<\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>He also noted that the ruling represents a \u201csignificant <a href=\"https:\/\/x.com\/JonathanTurley\/status\/2071595891572510893\" target=\"_blank\" rel=\"noopener\">win<\/a> for the Democrats in states like California,\u201d which have been heavily criticized for taking weeks to submit their final tallies.<\/p>\n<p><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/yF4mbbzoyHw?si=gxc9aD2bgXxJFXEq\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>In the <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-1260_g3cn.pdf\" target=\"_blank\" rel=\"noopener\">majority opinion<\/a>, Barrett argued there is no specific date for receipt of ballots, meaning there is no statute preventing states from accepting votes long after Election Day.<\/p>\n<p>\u201cIn sum, the election-day statutes require the electorate\u2019s choice to be made on election day,\u201d she wrote. \u201cThat occurs so long as election day is the deadline for individuals to vote\u2014as it is in Mississippi. But the election-day statutes do not set a deadline for ballot receipt, so they do not prevent Mississippi from counting ballots postmarked before election day yet received afterward.\u201d<\/p>\n<p>The Trump appointee also noted that Congress may \u201c\u2019override\u2019\u201d most of these choices, but added that \u201cby default,\u201d such responsibilities \u201cfor the mechanics of congressional elections belongs to States.\u201d<\/p>\n<p>In his dissent, Alito wrote, \u201cToday\u2019s decision is inconsistent with the terms of the election-day statutes, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-upholds-state-laws-allowing-ballots-to-be-accepted-after-election-day\/\" title=\"SCOTUS Approves ...&#039; Acceptance Of Late-Arriving Ballots\">contemporary election-law principles<\/a>, two centuries of historical practice, and the case law on the question presented.\u201d<\/p>\n<p>\u201cIt opens up and fails to resolve a host of questions for state election officials and courts,\u201d he concluded. \u201cAnd it creates a serious risk of further undermining public confidence in our elections and our system of self-government.\u201d<\/p>\n<p>Alito also touched upon the issue of potential fraud, writing, \u201cToday\u2019s decision leaves open opportunities for voter fraud that may further undermine Americans\u2019 faith<br \/> in the integrity of this country\u2019s elections. Diverse sources have recognized that mail-in ballots increase the potential for fraud.\u201d<\/p>\n<p>He added, \u201cIt is not difficult to understand why. When someone votes by mail, it is harder for officials to verify the identity of the person requesting and completing the ballot. Mail voting also presents a greater opportunity for voter manipulation, a more vulnerable chain of ballot custody, and a diminished ability to detect improprieties in real time.\u201d<\/p>\n<p>The dissent echoes many of the concerns d by President Donald Trump, who is pushing the Republican-controlled Senate to pass the Save America Act before the upcoming midterm elections.<\/p>\n<p>The commander in chief responded to the ruling on  Monday, <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/116834002761429397\" target=\"_blank\" rel=\"noopener\">writing<\/a>: \u201cIn light of the tremendous loss in the Supreme Court today concerning Voter\u2019s Rights, and the fact that \u2018people\u2019s\u2019 votes are allowed to be counted LONG AFTER an Election is over, it is more important than ever to pass THE SAVE AMERICA ACT.\u201d<\/p>\n<p>The Save America Act <a href=\"https:\/\/www.whitehouse.gov\/saveamerica\/\" target=\"_blank\" rel=\"noopener\">would mandate<\/a> that voters provide a valid ID and proof of citizenship before registering to vote in a federal election, and would also ban mail-in ballots, with limited exceptions.<\/p>\n<p>\u201cThere is no excuse for a politician, or otherwise, to be against the above three requirements,\u201d Trump added. \u201cThere is only one reason to oppose \u2014 CHEATING! The House of Representatives has approved this vital Act, THREE TIMES.
