United States<\/em>, Kagan concluded that compelling Google to search its users\u2019 location records and disclose the results to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/police-and-law-enforcement\/\" type=\"post_tag\" id=\"401\">law enforcement<\/a> amounted to a Fourth Amendment search. However, rather than suppressing the evidence outright, the justices instructed the lower courts to determine whether the warrant satisfied the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/constitution\/\" type=\"post_tag\" id=\"424\">Constitution\u2019s <\/a>requirement that searches be reasonable.<\/p>\n<p class=\"wp-block-paragraph\">The ruling represents the Supreme Court\u2019s latest effort to apply Fourth Amendment protections to rapidly evolving digital technologies. An attorney for Cole was not available to comment to the <em>Washington Examiner<\/em>.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">When asked whether the decision in <em>Chatrie <\/em>could lead to other Fourth Amendment disputes over cellphone data dumps like the dispute raised by Cole\u2019s counsel, New Civil Liberties Alliance attorney Andreia Trifoi said, \u201cThere are lots of similar places where the third-party doctrine comes into play, and we think it is currently being abused.\u201d NCLA argued the case on behalf of Chatrie.<\/p>\n<p class=\"wp-block-paragraph\">\u201cPeople may not even know that their location is being recorded, and people treat their cellphones as their diaries. It\u2019s an extension of oneself,\u201d said Trifoi. \u201cSo, I think we could definitely see this being expanded into other third-party doctrine cases.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The doctrine, established in a pair of Supreme Court cases in the 1970s, follows the principle that when private information is shared with someone else, a person is taking the risk that it may be shared with the police or government.
