That President is not all powerful\u2014not by any means,\u201d Roberts wrote. \u201cBut he is not impotent either. He and he alone is vested with \u2018[t]he executive Power\u2019 of the United States.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cTo \u2018discharg[e] the duties of his trust,\u2019 the President must have the assistance of officers he can trust. Although it is up to the Senate to decide whether to confirm those with whom the President would prefer to work, neither Congress nor the courts may saddle him with those with whom he cannot work. Subordinates who exercise the President\u2019s power are subject to removal by him. The Supreme Court partially weighed in on the legality of those firings twice before the <em>Trump v. Slaughter<\/em> case, twice allowing for firings to take place on their emergency docket while the lawsuits continued.<\/p>\n<p class=\"wp-block-paragraph\">With <em>Slaughter<\/em>, the court again allowed the firing to take place in the interim but also elevated the case to its merits docket, leading to the Supreme Court\u2019s full ruling on the matter.<\/p>\n<p class=\"wp-block-paragraph\">During <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3908676\/supreme-court-grapples-executive-power-independent-agencies\/\" type=\"link\" id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3908676\/supreme-court-grapples-executive-power-independent-agencies\/\">oral arguments<\/a> in December, a majority of the justices appeared likely to side with the president on his ability to fire members of agencies created by Congress that exert executive branch power, such as the FTC.
