The Ninth Circuit Court of Appeals reversed a previous ruling, allowing thier case to proceed to trial. The women alleged that they faced termination after expressing religious objections to the Equality Act and related company policies, which they argued conflicted with their faith. The case highlights issues around religious freedom, free speech, and workplace discrimination, especially regarding employees expressing conservative or religious views on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mind-your-business-lizzo-calls-texas-abortion-ban-atrocious-says-trans-rights-are-human-rights\/\" title=\"\u2018Mind Your Business\u2019: Lizzo Calls Texas Abortion Ban \u2018Atrocious,\u2019 Says \u2018Trans Rights Are Human Rights\u2019\">controversial social issues<\/a>. The court recognized that disputes over whether their firings were motivated by religious beliefs or policy violations merit further examination in trial. Alaska Airlines<\/a>. \u201cThe Ninth Circuit\u2019s decision today reinforces that federal civil rights laws protect people of faith from discrimination by their employer or their union,\u201d <a href=\"https:\/\/firstliberty.org\/media\/ninth-circuit-rules-in-favor-of-alaska-airlines-flight-attendants-fired-for-their-faith\/\">cheered<\/a> First Liberty Institute senior counsel Stephanie Taub, who argued the case before the court. \u201cYou cannot be fired because your employer does not like your religious beliefs.\u201d<\/p>\n<p>District Judge Barbara Rothstein in the Western District of Washington had previously ruled against Lacey Smith and Marli Brown, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wisconsin-supreme-court-set-to-hear-appeal-of-court-decision-that-absentee-ballot-drop-boxes-are-illegal\/\" title=\"Wisconsin Supreme ... Set to Hear Appeal of ... Decision that Absentee Ballot Drop Boxes Are Illegal\">granting summary judgment<\/a> to the airline and labor union and dismissing the women\u2019s claims. The Ninth Circuit reversed, concluding \u201cthat both plaintiffs have established a triable issue.\u201d Their lawsuit will now proceed to trial.<\/p>\n<p>\u201cIn this case, Smith and Brown both established, at minimum, a genuine dispute,\u201d the court reasoned. \u201cSmith and Brown claim they were discriminated against based on their religious beliefs, a protected ground. \u2026 Alaska argues that it did not fire Brown [or Smith] for her religious beliefs but because it regarded her as having violated the company\u2019s anti-discrimination and harassment policies. This argument captures the genuine dispute in this case; it does not settle it. That is because for the reasons we have given, a reasonable jury could find Alaska\u2019s position pretextual.\u201d<\/p>\n<p>\u201cIn sum, the issue is not whether Alaska can punish employees who engage in discrimination and harassment (it can),\u201d the court stated. \u201cThe issue here is instead a factual one of whether Brown was in fact fired for engaging in discrimination or harassment, or whether Alaska instead used the cover of its employee policies to fire Brown because of her religious beliefs.\u201d<\/p>\n<p>The Ninth Circuit opinion was written by Judge Daniel Bress, a Trump appointee, and joined by Judge Kenneth Lee, another Trump appointee. Judge Morgan Christen, an Obama appointee, wrote a separate opinion concurring in all respects but one. Christen would have disallowed Smith\u2019s claim against Alaska Airlines.<\/p>\n<p>The substance of the case hearkens back to the repressed and boiling days of early 2021, when passengers were getting booted from airlines left and right, and flight attendants were losing their jobs for refusing to take the jab. \u201cOn February 25, 2021, Alaska posted on Alaska\u2019s World to announce the company\u2019s support for the <a href=\"https:\/\/www.frc.org\/equalityact2019\">Equality Act<\/a>,\u201d the court observed. The bill proposed to statutorily railroad religious liberty by creating civil rights protections for sexual orientation and gender identity, and allowing these categories to trump any religious objections. Fortunately, it has never become law.<\/p>\n<p>\u201cAlaska\u2019s World\u201d is \u201can internal intranet communication network\u201d visible to all Alaska Airlines employees. Before this controversy, the company encouraged employees to reply and comment on company communications, explaining that \u201c[c]omments are here for us to openly and constructively  ideas, ask respectful questions, and understand one another and our company.\u201d<\/p>\n<p>Shortly after the airline announced its endorsement of the Equality Act, Christian flight attendant Lacey Smith responded, \u201cAs a company, do you think it\u2019s possible to regulate morality?\u201d Later that day, after researching the issue, Christian flight attendant Marli Brown posted a fuller rebuttal:<\/p>\n<blockquote>\n<p>\u201cDoes Alaska support: endangering the Church, encouraging suppression of religious freedom, obliterating women rights and parental rights? This act will Force every American to agree with controversial government-imposed ideology on or be treated as an outlaw. The Equality Act demolishes existing civil rights and constitutional freedoms which threatens constitutional freedoms by eliminating conscience protections from the Civil Rights Act. The Equality act would affect everything from girls\u2019 and women\u2019s showers and locker rooms to women\u2019s shelters and women\u2019s prisons, endangering safety and diminishing privacy. Giving people blanket permission to enter private spaces for the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >opposite sex enables sexual predators<\/a> to exploit the rules and gain easy access to victims. This is Equality Act[.]\u201d<\/p>\n<\/blockquote>\n<p>Alaska Airlines management received complaints about Smith\u2019s post and discussed it internally. Instead of taking it down, they initially drafted a response:<\/p>\n<blockquote>\n<p>\u201cSupporting the Equality Act is not about regulating morality. It\u2019s about supporting laws that allow our LGBTQ+ employees and guests, no matter what state they live in or fly to, to be protected against discrimination. Our values are our guide, and we strongly believe that doing the right thing and being kind-hearted require us to support this act. As we said above, we aren\u2019t the kind of company that stands by and watches\u2014we\u2019re going to use our voice and be a leader on these issues. We also expect our employees to live by these same values. Our differences are to be respected. As stated in our People Policies, harassment and discrimination will not be tolerated.\u201d<\/p>\n<\/blockquote>\n<p>Notably, the internal communications were even more censorious than this hard put-down. \u201cIn internal Alaska s discussing this draft, Taylor Ball of Alaska\u2019s legal department wrote, \u2018Employees actually do not have the right to believe that LGBTQ rights are \u2018immoral,\u2019 to which Carmen Williams, Alaska\u2019s vice president of Inflight replied, \u2018I 100% agree,\u2019\u201d the court recorded.<\/p>\n<p>That night, Alaska shut down comments on the post and deleted the comments by Smith and Brown. It later changed its comment policy to forbid \u201cpartisan or personal (such as religious or political) opinions.\u201d<\/p>\n<p>These offending (but not offensive) posts did not go unnoticed by the employee union. Jeffrey Peterson, president of the Master Executive Council for the Association of Flight Attendants-CWA (AFA), became personally involved in the incident to an unusual extent. \u201cEmployees get to be bigots in their private lives and to express their bigoted and misinformed opinions while not at work \u2014 as horrifying as that may be,\u201d he told AFA colleagues. But Smith\u2019s \u201cpost is reprehensible and there should be repercussions.\u201d He separately texted \u201cI hate her\u201d with reference to Smith and, \u201cMngmt needs to send [Smith\u2019s] bigoted [censored] packing for a variety of reasons.\u201d<\/p>\n<p>Smith had previously faced discipline in 2020 after organizing a petition to keep Alaska Airlines from politicizing itself with pro-BLM statements.<\/p>\n<p>With regard to Brown, Peterson made clear that he knew the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-starts-case-with-enormous-religious-freedom-implications\/\" title=\"SCOTUS Starts ... With Enormous ... Implications\">religious freedom implications<\/a> of his intolerant attitude. \u201cI wish fewer people would struggle so much with unifying their faith with inclusivity.\u201d<\/p>\n<p>Peterson was not the only AFA official to disparage the views expressed by Brown and Smith. AFA representative Terry Taylor initially blurted out, \u201cCan we PLEASE get someone to shut down comments, or put Marli and Lacey in a burlap bag and drop them in a well\u201d \u2014 before revising the comment. Taylor also called the posts \u201creprehensible\u201d and hoped for \u201c[a]t least a suspension\u201d for Brown.<\/p>\n<p>Taylor later served as Brown\u2019s union representative in her grievance dispute against Alaska Airlines. During a March 4 investigatory meeting, the court noted, \u201cTaylor, privately texted AFA\u2019s Stephanie Adams [also virtually present in the meeting], \u2018[a]pparently [Brown] can\u2019t stop herself . . . I may hurl,\u2019 with the text exchange culminating in Adams writing to Taylor: \u2018Nice poker face \u2026NOT.\u2019\u201d<\/p>\n<p>\u201cBrown\u2019s supervisor, meanwhile, believed that Brown\u2019s concerns were sincere and recommended that she be given a \u2018record of discussion\u2019 but no discipline,\u201d the Ninth Circuit said. Instead, \u201cOn March 19, 2021, Alaska determined that Brown\u2019s comments violated the company\u2019s anti-discrimination and anti-harassment policies and terminated her employment.\u201d The AFA eventually declined to defend Brown\u2019s case further.<\/p>\n<p>Alaska Airlines held an investigatory meeting with Smith on March 11. \u201cSmith claims she did not raise her religious beliefs during this meeting because she feared that Alaska would discriminate against her if she \u2018used the word \u2018religion.\u2019 Smith later described the meeting as \u2018hostile\u2019 and recalled that during \u2018repeated, aggressive questioning,\u2019 she broke into tears,\u201d the court noted. Alaska terminated Smith on the same day as Brown, and the AFA again declined to carry the case any further.<\/p>\n<p>In Smith\u2019s Notice of Discharge, Alaska Airlines claimed that \u201c[d]efining gender identity or sexual orientation as a moral issue \u2026 is not a philosophical question, but a discriminatory statement.\u201d<\/p>\n<p>Brown and Smith had worked as flight attendants for Alaska Airlines for eight and six years, respectively. Brown had no marks on her disciplinary record, while Smith only had one 30-day suspension related to her petition against BLM.
