The Republican National Committee (RNC), along with Rep. Jeff Crank and County Clerk Sheri Davis, filed the lawsuit in Denver District Court, seeking an injunction against Griswold. The lawsuit claims that Griswold\u2019s guidance and Colorado law conflict with constitutional residency requirements,which specify that residency cannot be inherited or established by proxy. It argues that individuals who have never resided in Colorado or the U.S. should not be allowed to vote there, citing legal and constitutional violations.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ftc-sues-amazon-alleging-it-has-an-illegal-monopoly-in-online-marketplace\/\" title=\"FTC sues Amazon for alleged online marketplace monopoly.\">lawsuit highlights concerns<\/a> over laws and guidance that permit overseas and non-resident voters to participate in Colorado and other states\u2019 elections,allegedly undermining election integrity.It criticizes the request of the federal Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA), which the RNC sees as allowing non-residents with no real connection to a state to vote in federal elections. The suit also seeks to remove such ineligible voters from Colorado\u2019s voter rolls.<\/p>\n<p>This legal action is part of broader Republican efforts to challenge voting eligibility laws considered suspect or unconstitutional, especially regarding overseas and non-resident voting.The case also arises amid political controversy over Colorado secretary Griswold\u2019s previous efforts to disqualify Trump from the ballot and her stance in election matters,including efforts to enforce the 14th Amendment against Trump,which the U.S. Supreme Court later reversed. The RNC\u2019s lawsuits continue across several states, including Nebraska and North Carolina, to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/an-abused-wife-took-on-tesla-over-tracking-tech-she-lost\/\" title=\"Abused wife battles Tesla on tracking tech, but loses\">address similar concerns<\/a> about non-residents voting in U.S. elections.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Colorado Secretary of State Jena Griswold, who served as head cheerleader in the left\u2019s failed attempt to keep Donald Trump off her state\u2019s 2024 Republican primary ballot, now faces a lawsuit alleging she broke the state constitution in permitting non-residents who have never lived in Colorado to vote in its elections. <\/p>\n<p>Griswold, the leftist tool of the far-left machine that defiled the U.S. Constitution, is now accused of ignoring the Centennial State\u2019s charter. <\/p>\n<p>\u201cYet again, Democrats are trying to let people vote in a state where they\u2019ve never lived,\u201d Republican National Committee Chairman Joe Gruters said in a statement. \u201cJena Griswold is ignoring Colorado\u2019s Constitution and allowing non-residents to cast ballots in Colorado elections.\u201d<\/p>\n<h2>\u2018Residency is not Inherited\u2019 <\/h2>\n<p>The RNC filed the <a href=\"https:\/\/prod-static.gop.com\/media\/documents\/2026-06-26_12-17-55_Final_Complaint_w._Verifications-_RNC_v_Griswold_1782501141.pdf?utm_medium=email&#038;utm_source=ncl_amplify&#038;utm_campaign=260625-rnc_sues_colorado_secretary_of_state_for_unlawfully_allowing_non_residents_to_vote&#038;utm_content=ncl-7yDsA8Rnxs&#038;utm_term=&#038;_nlid=7yDsA8Rnxs&#038;_nhids=ncNRMhKgbtGqEls\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> on Friday in Denver District Court, joined by Rep. Jeff Crank, R-Colo., and Douglas County Clerk and Recorder <a href=\"https:\/\/www.douglasco.gov\/board-county-commissioners\/transparency\/elected-officials\/clerk-and-recorder\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sheri Davis<\/a>. According to the court filing, the action seeks an injunction against Griswold, a Democrat with a checkered record on the law <a href=\"https:\/\/ballotpedia.org\/Jena_Griswold\" target=\"_blank\" rel=\"noreferrer noopener\">running<\/a> for Colorado attorney general. A primary election is slated for Tuesday. <\/p>\n<p>\u201cIn direct contravention of this constitutional command, the Colorado Secretary of State has issued guidance permitting individuals who have never resided in the United States, let alone in Colorado, to register and vote in Colorado elections based solely on the residency of a parent, legal guardian, or spouse,\u201d the lawsuit states. <\/p>\n<p>Griswold <a href=\"https:\/\/www.sos.state.co.us\/pubs\/elections\/FAQs\/UOCAVA.html\" target=\"_blank\" rel=\"noreferrer noopener\">notes<\/a> as much in a <a href=\"https:\/\/www.sos.state.co.us\/pubs\/elections\/FAQs\/UOCAVA.html\" target=\"_blank\" rel=\"noreferrer noopener\">Uniformed and Overseas Electors Frequently Asked Questions<\/a> page on the Secretary of State\u2019s website.<\/p>\n<p>Griswold\u2019s guidance follows a bad state law, the lawsuit asserts, that also permits voters who have never lived in Colorado to vote in the state\u2019s elections. The law and Griswold\u2019s guidance are in \u201cdirect conflict with the residency requirements set forth in <a href=\"https:\/\/law.justia.com\/constitution\/colorado\/cnart7.html\" target=\"_blank\" rel=\"noreferrer noopener\">Article VII <\/a>of the Colorado Constitution,\u201d the complaint asserts. <\/p>\n<p>\u201cResidency is not inherited and cannot be established by proxy. An individual who has never personally made Colorado his or her home has not \u2018resided in this state\u2019 within the meaning of Article VII of the Colorado Constitution,\u201d the lawsuit states. \u201cIt follows that <a href=\"https:\/\/law.justia.com\/codes\/colorado\/title-1\/general-primary-recall-and-congressional-vacancy-elections\/article-8-3\/section-1-8-3-102\/\" target=\"_blank\" rel=\"noreferrer noopener\">Colo. Rev. Stat. \u00a7 1-8.3- 102(2)(d) <\/a>and the Secretary\u2019s published UOCAVA guidance implementing it are contrary to the Colorado Constitution.\u201d<\/p>\n<p>There clearly is a residency requirement in voter eligibility in the Centennial State\u2019s supreme laws. <\/p>\n<p>As a county clerk, Davis is bound by Colorado law and the secretary of state\u2019s instructions. The lawsuit asserts David tried to reconcile Griswold\u2019s guidance with the state\u2019s constitution \u201cbut finds she cannot.\u201d She is put in a position to make a choice between following the constitution or the secretary\u2019s instructions, the lawsuit charges. <\/p>\n<p>Davis isn\u2019t simply Douglas County\u2019s clerk; she\u2019s a Douglas County voter who has voted and intends to do so in future elections, the lawsuit states. She has a \u201cdirect, personal, and substantial interest in ensuring that her vote counts and is not diluted by the inclusion of constitutionally ineligible voters.\u201d <\/p>\n<p>As an incumbent candidate for Colorado\u2019s 5th Congressional District seat, Crank\u2019s electoral interests \u201care directly and concretely injured by the state law and Griswold\u2019s guidance.\u201d<\/p>\n<p>\u201cThe unlawful registration of never-resident voters harms the Candidate by depriving him of an election conducted under lawful rules, undermining the political legitimacy of any winning candidate, and forcing the Candidate to compete in an election in which unqualified voters are participating,\u201d the complaint states. <\/p>\n<h2>\u2018Never Resided in the United States\u2019 <\/h2>\n<p>The lawsuit is the latest in a string of RNC legal challenges of <a href=\"https:\/\/amzn.to\/3YuVZYV\" >legally suspect voter eligibility requirements<\/a> under the application of the federal <a href=\"https:\/\/www.justice.gov\/crt\/uniformed-and-overseas-citizens-absentee-voting-act\" target=\"_blank\" rel=\"noreferrer noopener\">Uniformed and Overseas Citizens Absentee Voting Act <\/a>(UOCAVA). The 40-year-old law lays out voter registration and voting procedures for military and other uniformed personnel absent from their established state residence, as well as certain American civilians living overseas but previously domiciled in the United States. <\/p>\n<p>Under UOCAVA, the nonresidents have limited rights to vote in federal elections in the state in which they previously resided. As the lawsuit states, however, the law otherwise defers to state prerogatives to \u201cprescribe substantive prerequisites for voting in both federal and state elections.\u201d That doesn\u2019t mean language in state constitutions should be ignored, the complaint asserts. <\/p>\n<p>Republican lawmakers have introduced congressional bills that would end the loophole of voting allowances for a \u201cnever resident,\u201d as the RNC lawsuit describes the overseas U.S. citizen. <\/p>\n<p>As The Federalist\u2019s Brianna Lyman <a href=\"https:\/\/thefederalist.com\/2025\/08\/04\/new-bill-targets-uocava-loophole-that-lets-overseas-voters-use-outdated-addresses\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported,<\/a> UOCAVA would grant an individual born to American parents the right to vote in elections held in his parents\u2019 former home state even though he has never resided in the United States.  <\/p>\n<p>That loophole allows an untold number of voters to vote in major swing states where they have no connection, Lyman wrote, including people with no sense of allegiance to the United States. <\/p>\n<p><a href=\"https:\/\/www.overseasvotefoundation.org\/us-overseas-voting-reform-agenda#:~:text=remedy%20this%20situation.-,Codify%20the%20right%20to%20vote%20in%20federal%20elections%20under%20the,former%20state%20residents%20when%20abroad\">Nearly 40 states<\/a> and Washington, D.C., allow military citizens who have \u201cnever resided in the U.S.\u201d to cast ballots if a parent or legal guardian last registered in that state. <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/4851\/text\">The Proving Residency for Overseas Voter Eligibility (PROVE) Act <\/a>would tighten up the loose requirements that have permitted untold numbers of never residents to vote in U.S. elections. <\/p>\n<p>The RNC\u2019s Colorado lawsuit also seeks the removal from the state\u2019s voter rolls overseas-residing citizens who have never lived in the state.<\/p>\n<h2>\u2018Especially the Presidency\u2019<\/h2>\n<p>Griswold faced an<a href=\"https:\/\/coloradonewsline.com\/2024\/04\/09\/colorado-democrat-griswold-impeachment\/\"> impeachment threat <\/a>after she vehemently advocated for the left-led Colorado Supreme Court to kick Trump off the state\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michigan-judge-dismisses-14th-amendment-challenge-against-trump\/\" title=\"Michigan Judge Dismisses 14th Amendment Challenge Against Trump\">primary ballot based<\/a> on a politically twisted interpretation of the 14th Amendment. The court determined that Trump was guilty of insurrection connected to his speech in the Jan. 6, 2021 riots at the Capitol despite the fact that he had not been convicted \u2014 and never has been \u2014 of such a charge. <\/p>\n<p>The U.S. Supreme Court later unanimously <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-719_19m2.pdf\">reversed <\/a>the ruling, clarifying that, \u201cStates have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency.\u201d <\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2024\/09\/23\/trump-hating-colorado-secretary-of-state-loses-another-election-integrity-battle\/\" target=\"_blank\" rel=\"noreferrer noopener\">Weeks before<\/a> the 2024 presidential election, a U.S. District Court issued an <a href=\"https:\/\/publicinterestlegal.org\/wp-content\/uploads\/2024\/09\/62-Order-Approving-Settlement-Agreement.pdf\">order<\/a> demanding the secretary of state release <a href=\"https:\/\/ericstates.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Electronic Registration Information Center (ERIC)<\/a> reports suspected of containing dead registrants on the state\u2019s voter rolls. The reports, according to a settlement, include individuals who may have died within the past three years. <\/p>\n<h2>North Carolina Finding <\/h2>\n<p>The RNC also filed a \u201cnever resident\u201d <a href=\"https:\/\/prod-static.gop.com\/media\/documents\/1._2026.06.22_Verified_Complaint_-_fully_executed_1782165295.pdf?utm_medium=email&#038;utm_source=ncl_amplify&#038;utm_campaign=260622-rnc_sues_nebraska_over_unconstitutional_non_resident_voting_law&#038;utm_content=ncl-mbfAPzPPE8&#038;utm_term=&#038;_nlid=mbfAPzPPE8&#038;_nhids=nc98ZTmZZHvBls\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> in Nebraska last week.  <\/p>\n<p>Late last month, a North Carolina court ruled that the North Carolina Board of Elections violated the state constitution with a directive that permitted the class of voter to register and vote in federal elections in the Tar Heel State. The North Carolina Supreme Court earlier had found nonresidents could not vote in state elections. <\/p>\n<p>\u201cThe North Carolina Supreme Court\u2019s decision was clear: individuals who do not live \u2014 and have never lived \u2014 in North Carolina are not allowed to choose who represents the people of the state,\u201d the RNC said in a press release. <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
