United States that suppressors fall under the category of \u201carms\u201d and are protected under the Second Amendment. The Second Amendment Foundation noted the \u201ccircuit split,\u201d when two appellate circuits disagree on similar cases, in a series of <a href=\"https:\/\/x.com\/2AFDN\/status\/2067685228160978963\">posts<\/a> on X, while SAF Director of Legal Research and Education Konstadinos Moros specifically <a href=\"https:\/\/x.com\/MorosKostas\/status\/2067681781197967384\">mentioned<\/a> the Ninth Circuit case Duncan v. Bonta.<\/p>\n<p>\u201cThere is now a circuit split on whether suppressors are arms,\u201d Moros posted. \u201cThis is of critical importance to those of us in states that totally ban them. While everyone else is arguing about whether registration is constitutional, we can\u2019t even register them under the NFA if we wanted to!\u201d<\/p>\n<p>The National Firearms Act, passed in 1934, imposed a $200 tax on suppressors, fully automatic firearms, \u201cshort-barreled\u201d rifles and shotguns, and other weapons, and required they be registered with the Bureau of Alcohol, Tobacco, Firearms, and Explosives.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">A surprise second major ruling to cover today, because the Fifth Circuit just became the first to agree that suppressors are \u201carms\u201d under the Second Amendment.<\/p>\n<p>This is of massive importance considering that other circuits have ruled the opposite, and it puts further pressure on\u2026 <a href=\"https:\/\/t.co\/e8XXu2XRSK\">https:\/\/t.co\/e8XXu2XRSK<\/a> <a href=\"https:\/\/t.co\/Cy7EytEe3s\">pic.twitter.com\/Cy7EytEe3s<\/a><\/p>\n<p>\u2014 SAF (@2AFDN) <a href=\"https:\/\/x.com\/2AFDN\/status\/2067685228160978963?\">June 18, 2026<\/a><\/p>\n<\/blockquote>\n<p>When a \u201ccircuit split\u201d occurs, the Supreme Court tends to be more likely to hear the case to resolve the disagreement among the lower courts. The Fifth Circuit ruling decisively rejected the Justice Department\u2019s arguments that suppressers were not arms in the unanimous ruling.<\/p>\n<p>\u201cFirst, Bruen explained that Second Amendment \u2018Arms\u2019 need not be necessary for a firearm\u2019s functioning but instead must only \u2018facilitate armed self-defense,\u201d the opinion said. \u201cAnd second, the Supreme Court has cautioned lower courts against the trapped-in-amber approach that the government attempts to use by limiting the definition of \u2018Arms\u2019 to those devices required for militia service at the Founding. Silencers are \u2018Arms.\u2019\u201d<\/p>\n<p>The Supreme Court\u00a0invalidated New York\u2019s \u201cgood cause\u201d requirement for pistol permits in June 2022 with a 6-3 ruling in New York State Rifle and Pistol Association v. Bruen. Associate Justice Clarence Thomas, who authored the court\u2019s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" data-mrf-link=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\">opinion<\/a>, cited historical gun laws and the debate around the ratification of the 14th Amendment as reasons New York\u2019s law was unconstitutional.<\/p>\n<p>While the Fifth Circuit found that suppressors were protected under the Second Amendment, it upheld the conviction of Comeaux because the National Firearms Act of 1934 operates similarly to a \u201cshall issue\u201d system for administering applications for concealed carry permits.<\/p>\n<p>In another sign that the high court could take this case up, the Ninth Circuit case Moros <a href=\"https:\/\/x.com\/MorosKostas\/status\/2067693270982123541\" target=\"_blank\" rel=\"noopener noreferrer\">cited<\/a> as causing the potential \u201csplit,\u201d Duncan v. Bonta, has been relisted 21 times as of Thursday, <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/25-198.html\">according<\/a> to the Supreme Court\u2019s docket.<\/p>\n<p>In that case, a federal district court initially found California\u2019s ban on detachable magazines holding more than 10 rounds unconstitutional, but was overturned on appeal by an \u201cen banc\u201d panel at the appellate court, which has a long-standing <a href=\"https:\/\/www.law.com\/nationallawjournal\/2023\/04\/13\/how-liberal-is-the-9th-circuit-new-study-takes-deep-dive\/\">reputation<\/a> as one of the most <a href=\"https:\/\/amzn.to\/3YuVZYV\" >left-leaning federal appellate courts<\/a> in the country.<\/p>\n<p>The Supreme Court has overturned almost four out of every five decisions the Ninth Circuit has issued since 2007, <a href=\"https:\/\/www.pacificresearch.org\/supreme-court-hands-9th-circuit-highest-year-of-reversals-since-1985\/\">according<\/a> to the Pacific Research Institute, with the high court reversing 94 percent of the circuit\u2019s rulings in the term ending in June 2021.
