Recent decisions by Justices Clarence Thomas and Samuel Alito highlight their criticism of lower courts for overstepping their legal boundaries, especially in immigration and asylum cases. Thomas emphasized that lower courts attempted to issue class-wide injunctions and relief prohibited by federal law, potentially infringing on presidential authority to control immigration. Alito pointed out how some courts challenge the Trump administration&#8217;s attempts to revoke Temporary Protected Status (TPS) designations, despite previous presidents terminating these statuses without legal challenges.Justice Gorsuch also criticized lower courts for ignoring Supreme Court guidance, stressing judges&#8217; duty to respect the judicial hierarchy. the justices underscore a pattern of judicial activism and the need for courts to adhere to established legal limits.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"https:\/\/thefederalist.com\/tag\/judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">phenomenon<\/a> of rogue judges ignoring the Constitution and the Supreme Court in favor of partisan outcomes is growing every day. And it looks like Justices Clarence Thomas and Samuel Alito have taken notice. <\/p>\n<p>Across a pair of decisions issued Thursday (both authored by Alito), the two senior justices separately rebuked several lower courts for sidestepping immigration law and the high court\u2019s past rulings. The cases were <em><a href=\"https:\/\/thefederalist.com\/2026\/06\/25\/supreme-court-affirms-temporary-status-for-foreign-migrants-is-temporary\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mullin v. Doe<\/a><\/em>  and <em><a href=\"https:\/\/thefederalist.com\/2026\/06\/25\/scotus-no-asylum-seekers-dont-arrive-in-america-when-theyre-in-mexico\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mullin v. Al Otro Lado<\/a><\/em>, in which the court upheld President Trump\u2019s revocation of Temporary Protected Status for foreign nationals and affirmed that asylum seekers do not \u201carriv[e] in the United States\u201d when they\u2019re standing on the Mexican side of the border, respectively. <\/p>\n<p>In his <em>Al Otro Lado<\/em> concurrence, Thomas <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-5_86qd.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> how the federal immigration law at issue (\u201cImmigration and Nationality Act\u201d) bars federal courts from having jurisdiction over and the authority to \u201c\u2018enjoin or restrain the operation of \u2018 certain parts of the INA.\u201d Citing a past related SCOTUS ruling (<em><a href=\"https:\/\/www.oyez.org\/cases\/2021\/20-322\" target=\"_blank\" rel=\"noreferrer noopener\">Garland v. Aleman Gonzalez<\/a><\/em>), he further highlighted how the law\u2019s exception \u201conly for relief granted on an individual basis\u201d takes away lower courts\u2019 \u201c\u2018jurisdiction or authority\u2019 to \u2018enjoin or restrain the operation of \u2019\u201d these parts of the INA on a classwide basis.\u201d<\/p>\n<p>Put another, lower courts cannot <a href=\"https:\/\/www.law.cornell.edu\/rules\/frcp\/rule_23\" target=\"_blank\" rel=\"noreferrer noopener\">certify a class<\/a> of individuals and then issue an injunction covering those individuals under these provisions of the INA. <\/p>\n<p>Thomas noted how the challengers in <em>Al Otro Lado<\/em> nevertheless \u201csought relief\u201d that the statute explicitly \u201cprohibits.\u201d What\u2019s more, he added, is that the <a href=\"https:\/\/amzn.to\/3YuVZYV\" >district court granted<\/a> their request to certify a \u201cproposed class of \u2018\u201dall noncitizens who seek or will seek to access the U.S. asylum process by presenting themselves\u201d\u2018 at a port of entry at the U. S. Mexico border and who \u2018\u201dwere or will be denied access to the U.S. asylum process by or at the instruction of \u201c\u2018 border officials.\u201d<\/p>\n<p>\u201cThe District Court acknowledged that our interpretation of \u00a71252(f )(1) in <em>Aleman Gonzalez<\/em> barred this relief \u2026 Nonetheless, the District Court effectively gave Respondents all that they asked for in the form of nominally declaratory relief,\u201d Thomas wrote. \u201cIn a future case, this Court should address this apparent end-run around \u00a71252(f )(1) and <em>Aleman Gonzalez<\/em>. I am skeptical that the relief that the District Court ordered complies with \u00a71252(f )(1).\u201d<\/p>\n<p>The current court\u2019s longest-serving justice further argued that \u201cthe relief that the District Court provided may well have unconstitutionally infringed on the President\u2019s inherent authority to exclude aliens from the country.\u201d<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Justice Thomas: \u201c[A]ny statute that forced the President to allow aliens to cross the border against his will would appear to exceed Congress\u2019s enumerated powers, and a court could not enforce it against the President.\u201d <a href=\"https:\/\/t.co\/UXj4MujQCG\">pic.twitter.com\/UXj4MujQCG<\/a><\/p>\n<p>\u2014 Shawn Fleetwood (@ShawnFleetwood) <a href=\"https:\/\/x.com\/ShawnFleetwood\/status\/2070195873246568871?ref_src=twsrc%5Etfw\">June 25, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Meanwhile, Alito\u2019s critique of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/john-roberts-is-the-face-of-leftists-judicial-coup\/\" title=\"John Roberts Is The Face Of Leftists&#039; Judicial Coup\">rogue lower courts<\/a> and their indulgence of leftists\u2019 judicial coup against the president was much more subtle. <\/p>\n<p>In <em>Doe<\/em>, the Bush 43 appointee <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-1083_f204.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">detailed<\/a> how several TPS designations for some foreign countries have been permitted to continue for several decades, while others have not. In an apparent indirect reference to the wave of lawfare waged against the Trump administration, he noted in a footnote how Presidents Clinton, Bush (43), and Obama all \u201cterminated some TPS designations much more promptly\u201d but that \u201c[n]one of these terminations were challenged in court.\u201d<\/p>\n<p>\u201cLegal challenges to [President Trump\u2019s] decisions,\u201d however, \u201cbegan almost immediately,\u201d Alito wrote. <\/p>\n<p>Alito went on to note how the Trump administration previously asked SCOTUS to pause lower court injunctions barring Trump from ending TPS for Venezuelan nationals in the United States last year. As noted by the justice and previously <a href=\"https:\/\/thefederalist.com\/2026\/03\/10\/year-into-trump-2-0-judicial-insurrectionists-reign-supreme\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> by The Federalist, the high court granted those requests on two separate occasions. <\/p>\n<p>\u201cNevertheless,\u201d Alito wrote, \u201clower courts, including those in the cases now before us, have continued to block the Secretary\u2019s attempted terminations of other TPS designations.\u201d<\/p>\n<figure><\/figure>\n<p>The decisions weren\u2019t the first in which some of the justices have rebuked lower courts for refusing to stay in their lane. <\/p>\n<p>In an <a href=\"https:\/\/thefederalist.com\/2026\/03\/12\/heres-how-leftists-weaponize-their-anti-trump-judicial-coup-to-attack-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">interim docket<\/a> case last year, Justice Neil Gorsuch (joined by Justice Brett Kavanaugh) <a href=\"https:\/\/thefederalist.com\/2025\/08\/22\/justice-gorsuch-gives-rogue-lower-courts-the-smackdown-they-deserve\/\" target=\"_blank\" rel=\"noreferrer noopener\">blasted<\/a> lower court judges for disregarding the Supreme Court\u2019s guidance on issues before the bench \u2014 which he noted has become a recurring pattern throughout the judiciary. <\/p>\n<p>\u201cAll these interventions should have been unnecessary, but together they underscore a basic tenet of our judicial system: Whatever their own views, judges are duty-bound to respect \u2018the hierarchy of the federal court system created by the Constitution and Congress,\u2019\u201d Gorsuch wrote.<\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
