In the case Wolford v. Alito emphasized that Hawaii\u2019s restrictions impose a new burden by requiring permit holders to obtain permission from property owners before entering, which hampers their rights. He also reaffirmed that the Second Amendment\u2019s protections apply equally across all states, regardless of local attitudes towards firearms. Alito highlighted that carrying firearms in public is a longstanding American tradition and criticized Hawaii\u2019s reliance on historical analogues-such as laws targeting hunting-that do not align with modern firearm rights. Additionally, he condemned Hawaii\u2019s attempt to justify the law using Civil War-era Black Codes, arguing that such outdated references are irrelevant and inappropriate given the importance of firearm rights for vulnerable populations during that period. the decision reaffirmed that foundational constitutional protections and historical practices support the right to carry firearms in public.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Supreme Court Justice Samuel Alito is having quite the year. After authoring a major decision <a href=\"https:\/\/thefederalist.com\/2026\/04\/29\/supreme-court-smacks-down-rampant-race-based-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">nuking<\/a> race-based redistricting earlier a few months ago, the senior justice just released a new ruling protecting Americans\u2019 Second Amendment rights. <\/p>\n<p>Writing for the 6-3 majority in <em><a href=\"https:\/\/thefederalist.com\/2026\/06\/25\/scotus-rules-hawaiis-vampire-rule-restricting-concealed-carry-is-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">Wolford v. Lopez<\/a><\/em>, Alito and his fellow conservative justices found Hawaii\u2019s law restricting concealed-carry permit holders from carrying handguns on private property that\u2019s open to the public to be unconstitutional. The majority more specifically determined that this \u201cvampire rule\u201d unlawfully burdened Americans\u2019 Second and 14th Amendment rights. <\/p>\n<p>Like many of his opinions, Alito\u2019s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-1046_nmio.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Wolford<\/em> decision<\/a> contained everything one would expect from a strong, originalist justice. From its reliance on the Constitution\u2019s text and history to its overall practicality, here are the best lines from the court\u2019s ruling. <\/p>\n<h2>A \u2018New Burden\u2019 on Permit Holders<\/h2>\n<p>Alito noted how Hawaii\u2019s restriction imposes a \u201cnew burden\u201d on permit holders by forcing them to acquire permission from the property owner or manager before entering the premises.<\/p>\n<blockquote>\n<p>Some proprietors who do not themselves object to entry by carry-permit holders may be reluctant to post a sign welcoming such individuals for fear of alienating other customers. So under Hawaii\u2019s new default rule, a proprietor in this category may only be willing to consent discreetly to the entry of permit holders who make the effort to inquire. This arrangement imposes a new burden on permit holders who will have to somehow obtain permission to carry a firearm on the property before stepping foot on it.<\/p>\n<\/blockquote>\n<h2>The Constitution Applies to All<\/h2>\n<p>The Bush appointee underscored that Hawaii\u2019s history of \u201cantipathy\u201d to residents owning firearms is irrelevant because the Constitution applies equally to all states. <\/p>\n<blockquote>\n[T]he Second Amendment has the same meaning in all parts of the United States. \u2026 It cannot give way to \u201cthe spirit of Aloha\u201d in Hawaii \u2026 any more than it can yield to the spirit of the Big Apple (Bruen) or the Windy City (McDonald). It applies in the same way to our 50th State (where about 8% of adults possess guns) and our 49th State (where the figure is roughly 59%). Merely local attitudes can neither shrink nor inflate the meaning of fundamental Bill of Rights guarantees that apply to the States through the Fourteenth Amendment.<\/p>\n<\/blockquote>\n<h2>An American Tradition <\/h2>\n<p>Alito highlighted how carrying firearms in public is a longstanding American tradition. <\/p>\n<blockquote>\n[A]s we have explained, \u201coverwhelming evidence\u201d shows an \u201cenduring American tradition permitting public carry.\u201d \u2026 Hawaii\u2019s prohibitions on public carry represent a distinct outlier.<\/p>\n<\/blockquote>\n<h2>Hawaii\u2019s Historical Analogues Don\u2019t Work<\/h2>\n<p>Alito detailed how Hawaii\u2019s reliance on founding-era gun restrictions to defend its unconstitutional law doesn\u2019t pass the smell test. <\/p>\n<blockquote>\n<p>In sum, the State\u2019s <a href=\"https:\/\/amzn.to\/3YuVZYV\" >analogues principally targeted unauthorized hunting<\/a>. Their coverage differed sharply from that of the Hawaii law now before us. They applied to land where game could be found, not retail establishments that residents of cities and suburbs frequent as part of their daily routines. They had little if any impact on the Second Amendment\u2019s central objective: protecting the fundamental right to self-defense.<\/p>\n<\/blockquote>\n<h2>Black Codes Are a No-Go<\/h2>\n<p>Alito blasted Hawaii for relying on a Civil War-era law (\u201cBlack Code\u201d) aimed at restricting freed black Americans\u2019 Second Amendment rights to defend its <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gop-lawmakers-push-to-loosen-gun-restrictions-in-several-states\/\" title=\"GOP ...makers push to loosen gun restrictions in several ...\">concealed carry restriction<\/a>. <\/p>\n<blockquote>\n<p>As we laid out in McDonald, the right to keep and bear arms was crucially important for vulnerable blacks during this period. \u2026 And this was well-understood by the Republicans in Congress who were responsible for drafting, approving, and securing the ratification of the Fourteenth Amendment. \u2026 Unless we put history entirely out of our minds, Hawaii\u2019s claim that this tainted artifact illuminates the original understanding of the right to keep and bear arms cannot be taken seriously.<\/p>\n<\/blockquote>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
