The judges contend that the sanctions severely restrict their financial capabilities, such as using credit cards and accessing banking services, and label the sanctions as a form of &#8220;financial death penalty.&#8221; The U.S. conducts sanctions against ICC officials due to disputes over the court&#8217;s authority, especially after it issued an arrest warrant for Israeli Prime Minister Benjamin Netanyahu on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/as-europe-rallies-to-ukraine-putin-rattles-his-nukes\/\" title=\"As Europe Rallies To Ukraine, Putin Rattles His Nukes\">war crimes charges<\/a>, which the U.S. sees as a threat to its and Israel\u2019s sovereignty. (Eva Plevier\/ ANP via AP, Pool)<\/figcaption><\/figure>\n<p class=\"wp-block-paragraph\">The Trump administration began rolling out <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/3925966\/state-department-sanctions-two-icc-judges-illegitimate-targeting-israel\/\">sanctions against the ICC and its officials<\/a> in February of last year, slowly <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/foreign-policy\/3762524\/marco-rubio-icc-sanctions-four-more-officials\/\">adding to the list <\/a>\u201cforeign persons who directly engaged in efforts by the [ICC] to investigate, arrest, detain, or prosecute nationals of the United States or Israel, without the consent of either nation.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Tensions between the ICC and the U.S. came to a boiling point when the court issued an <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/world\/3301314\/netanyahu-skips-auschwitz-ceremony-icc-arrest\/\">arrest warrant<\/a> for Israeli Prime Minister Benjamin Netanyahu in 2024 on charges of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ilhan-omar-biden-should-back-referring-accused-israeli-officials-to-international-criminal-court\/\" title=\"Ilhan Omar: Biden Should Back Referring Accused ... To ...\">committing war crimes<\/a> and crimes against humanity.<\/p>\n<p class=\"wp-block-paragraph\">A <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.state.gov\/releases\/2025\/08\/imposing-further-sanctions-in-response-to-the-iccs-ongoing-threat-to-americans-and-israelis-2\">press release<\/a> from the State Department in August called the court a \u201cnational security threat that has been an instrument for lawfare against the United States and our close ally Israel.\u201d<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap\" style=\"min-height:5px;\"><span class=\"wex-ad-label\" style=\"display:none;\">Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The judges, none of whom hold U.S. citizenship, argue that Trump exceeded his legal authority under the International Emergency Economic Powers Act by imposing sanctions without a national emergency. In contrast to the three ICC judges, Albanese is focusing on the First Amendment as the basis for her appeal.<\/p>\n<p class=\"wp-block-paragraph\">Last month, U.S. District Judge Richard Leon ruled in favor of the Albanese family\u2019s request for an injunction and ordered the State Department to remove her from their sanctions list as the case moved to the U.S. Court of Appeals for the D.C.
