The decision was authored by Justice Samuel Alito, who argued that the TPS statute restricts courts from reviewing the administration\u2019s decisions on TPS, and dismissed the claim that the revocation was racially motivated. justices Sotomayor,Kagan,and Jackson dissented,contending that the courts should have examined whether proper procedures were followed and that there was sufficient evidence to suggest racial motivations behind the revocation. The case involved challenges to the administration\u2019s decision to end TPS protections, which allow immigrants from certain countries to stay temporarily due to extraordinary conditions. The decision was 6-3, with Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson in the dissent.<\/p>\n<p>The ruling in the consolidated cases <em>Mullin v. Doe<\/em> and <em>Trump v. Miot<\/em> dates back to Trump\u2019s bid to revoke Temporary Protected Status (TPS) from large swaths of Syrian and Haitian nationals residing in America under the program. As The Federalist previously <a href=\"https:\/\/thefederalist.com\/2026\/04\/30\/scotus-weighs-whether-temporary-status-for-foreign-migrants-is-actually-temporary\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the challengers contesting the president\u2019s decision argued that the statutory provisions governing TPS \u201cdo not bar courts from reviewing an administration\u2019s actions on the program and that the government is required to undertake certain steps (ex. consultation and assessment of a country\u2019s conditions) before implementing such policies.\u201d<\/p>\n<div id=\"fdrlst__b89e9-3385950377\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>Writing for the majority, Justice Samuel Alito <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-1083_f204.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">determined<\/a> that the TPS statute does, in fact, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/here-are-the-biggest-outstanding-supreme-court-cases-to-keep-an-eye-out-for\/\" title=\"Here Are The Biggest Outstanding SCOTUS ... To Look For\">bar federal courts<\/a> from reviewing \u201cnon-constitutional claims\u201d like those brought by the challengers. He further noted that the \u201csole constitutional claim\u201d brought in the <em>Miot<\/em> case \u2014 that the Trump administration\u2019s revocation of TPS for Haitians was racially motivated \u2014 \u201cwill likely fail.\u201d<\/p>\n<p>\u201cViewing all the relevant evidence, we conclude that <em>Miot<\/em> respondents are unlikely to prove that race was a motivating factor in the decision to terminate Haiti\u2019s TPS designation,\u201d Alito wrote. \u201cIt follows that they are not entitled to interim relief on their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-upholds-law-enabling-tribes-to-bar-non-native-families-from-adopting-native-children\/\" title=\"Supreme Court Upholds Law Enabling Tribes To Bar Non-Native Families From Adopting Native Children\">equal protection claim<\/a>.\u201d<\/p>\n<p>Chief Justice John Roberts and Justices Clarence Thomas and Brett Kavanaugh joined the court\u2019s opinion in full. Meanwhile, Alito and Justices Neil Gorsuch and Amy Coney Barrett joined all parts except as to a section that argued, \u201cIn[[<em>Miot<\/em>], we need not resolve whether the TPS statute meets that <a href=\"https:\/\/www.congress.gov\/crs-product\/LSB11084\" target=\"_blank\" rel=\"noreferrer noopener\">clear-statement rule<\/a> because we conclude that <em>Miot<\/em> respondents\u2019 constitutional claim is unlikely to succeed on the merits.\u201d<\/p>\n<p>While joining Alito\u2019s opinion in full, Thomas authored a concurrence laying out \u201ctwo more fundamental problems\u201d with the lawsuit brought by challengers to Trump\u2019s TPS revocation for Haitians. <\/p>\n<p>The Bush 41 appointee noted that, in addition to being \u201cmeritless\u201d under Supreme Court precedent, the <em>Miot<\/em> respondents\u2019 equal protection claim \u201cwas also beyond the District Court\u2019s jurisdiction.\u201d He further argued that, \u201ceven assuming jurisdiction, the equal protection claim fails for the additional reason that aliens have no <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/calif-high-school-athletes-sue-for-right-to-play-indoor-sports\/\" title=\"Calif. high school athletes sue for right to play indoor sports\">equal protection rights<\/a> against the Federal Government.\u201d<\/p>\n<p>Writing for the dissent, Kagan argued that the TPS statute does <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-allows-texas-abortion-law-to-remain-in-effect-while-lawsuit-continues-against-it\/\" title=\"Supreme Court Allows Texas Abortion Law to Remain in Effect While Lawsuit Continues Against It\">permit federal courts<\/a> to review \u201cwhether the Secretary adhered to the procedures it mandates\u201d and that \u201cthe evidence is there, plain to see\u201d to support the <em>Miot<\/em> respondents\u2019 claim that Trump\u2019s TPS revocation for Haitians is racially motivated. <\/p>\n<p>\u201cOnce that much is established, the case for interim relief is made: There is no dispute that the plaintiffs will suffer irreparable harm absent postponement of the TPS decisions,\u201d Kagan wrote. \u201cSo the plaintiffs are entitled to stay in this country while these suits go forward.
