Jackson also dissented, asserting that the law respects property rights and does not harm Second Amendment rights. Justice Amy Coney Barrett concurred, criticizing Hawaii\u2019s reliance on outdated laws like the Black Codes to justify its restrictions, and emphasizing that the law primarily protects property rights rather than gun rights. <\/p>\n<p>The decision sends the case back to the 9th Circuit Court of Appeals for further proceedings consistent with the ruling.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>In a major win for gun owners, the U.S. Supreme Court ruled on Thursday that Hawaii\u2019s restrictions on <a href=\"https:\/\/amzn.to\/3YuVZYV\" >concealed-carry permit holders violate<\/a> the Second and 14th Amendments. The decision was 6-3, with Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson in the dissent.<\/p>\n<p>Known as <em>Wolford v. Lopez<\/em>, the <a href=\"https:\/\/thefederalist.com\/2026\/01\/21\/scotus-scolds-hawaii-for-relegating-americans-second-amendment-rights-to-second-class-status\/\" target=\"_blank\" rel=\"noreferrer noopener\">case<\/a> stems from a 2023 legal challenge against Hawaii\u2019s \u201cvampire rule\u201d restricting citizens with concealed carry permits from carrying on private property open to the public unless they received explicit authorization to do so from the property owner, manager, or lessee. The plaintiffs argued that the law infringed their Second Amendment rights.<\/p>\n<p>Writing for the majority, Justice Samuel Alito <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-1046_nmio.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> how the Hawaii law \u201cseverely burdens the ability to carry a firearm in much of the rest of the State by prohibiting firearms on private property without the express and affirmative consent of the property owner.\u201d He further detailed the lengths concealed-carry holders must go to avoid violating these \u201csevere restrictions,\u201d which he added infringe upon their Second Amendment rights.<\/p>\n<p>\u201cWhen these permit holders leave home in the morning, not only must they take care to avoid all the territory where the possession of a gun is prohibited outright, but they may also be barred from entering many places that people routinely visit in the course of their daily routines, such as gas stations, convenience stores, restaurants, coffee shops, drug stores, grocery stores, \u2018big box\u2019 stores, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/retail-sales-saw-sharp-decline-in-november\/\" title=\"Retail Sales Saw Sharp Decline in November\">home improvement stores<\/a>, barber shops or hair salons, dry cleaners, and laundromats,\u201d Alito wrote. \u201cThis regime hobbles what the Second Amendment protects: the right of Americans to carry arms for self-defense as they go about their daily lives. We hold that the law is unconstitutional.\u201d<\/p>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/01\/21\/scotus-scolds-hawaii-for-relegating-americans-second-amendment-rights-to-second-class-status\/\" target=\"_blank\" rel=\"noreferrer noopener\">SCOTUS Scolds Hawaii For \u2018Relegating\u2019 Americans\u2019 Second Amendment Rights To \u2018Second-Class Status\u2019<\/a>]<\/strong><\/p>\n<p>In expressing her intent to uphold Hawaii\u2019s vampire rule, Kagan argued that it is comparable to \u201ccolonial and founding era laws that similarly prohibited carrying firearms onto private property without the owner\u2019s affirmative consent.\u201d She contended that both those and Hawaii\u2019s statute \u201crespond to the dangers and harms that someone with a gun can cause on another person\u2019s property.\u201d<\/p>\n<p>Writing on behalf of Sotomayor and herself, Jackson authored a separate dissent arguing that the Aloha State\u2019s law \u201cfairly applies a first principle of property law \u2014 the right to exclude \u2014 and does no harm to the Second Amendment.\u201d The two justices additionally claimed that the statute \u201cnot implicate the Second Amendment because there is no right to carry a gun onto private property without consent (as all agree), and the Constitution does not dictate the form of that required consent.\u201d<\/p>\n<p>\u201cToday\u2019s decision makes one thing clear: The Court\u2019s objective is protecting guns, not consistently preserving any principle of law,\u201d Jackson wrote.<\/p>\n<p>In addition to joining Alito\u2019s opinion in full, Justice Amy Coney Barrett authored a concurrence, which Justices Clarence Thomas and Neil Gorsuch joined in part.<\/p>\n<p>The Trump appointee took to task Hawaii and the dissent\u2019s argument that <em>Wolford<\/em> is about property law and not the Second Amendment. She furthermore chastised the Aloha State for its reliance on the Black Codes \u2014 a series of laws passed by Southern states following the Civil War to disenfranchise freed black Americans \u2014 to defend its gun control law.<\/p>\n<p>\u201cIt is beyond me why Hawaii would claim that these vile laws can justify its present-day restriction,\u201d Barrett wrote. \u201cThe Black Codes were enacted to subordinate newly freed slaves. Hawaii obviously does not contend that its law promotes an analogous interest.
