However, a Florida federal judge allowed Brazil to intervene in teh case, claiming it was the &#8220;real party in interest.&#8221; The case stems from Moraes\u2019s orders in February 2025, which targeted Rumble, a platform used by Trump media, and involved blocking accounts and demanding user data, with threatened fines and potential criminal charges.Rumble challenged Moraes\u2019s authority, arguing his US-based operations were outside Brazil\u2019s jurisdiction and that his orders violated free speech and US law.The court later granted Brazil\u2019s request to intervene, noting Moraes was sued in his official capacity, effectively making it a lawsuit against Brazil. The lawsuit highlights Moraes&#8217;s extensive censorship efforts against critics and political opponents, which the US State Department condemned as violating rights and extending beyond Brazil\u2019s borders. Brazil\u2019s intervention sheds light on its ongoing censorship and political persecution, with potential implications for upcoming elections and regional political shifts.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Rumble and Trump Media stood <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flmd.438114\/gov.uscourts.flmd.438114.72.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">poised<\/a> last week to score a victory in their lawsuit against Alexandre de Moraes, a justice of Brazil\u2019s Supreme Federal Tribunal who had ordered the American social-media outlet to shutdown the accounts of political opponents. However, on Tuesday, a federal judge in Florida <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flmd.438114\/gov.uscourts.flmd.438114.73.0_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">granted<\/a> Brazil\u2019s request to intervene in the case, with the South American country arguing it was \u201cthe real party in interest.\u201d But with the country\u2019s elections set for October, Brazil\u2019s left-wing president Luiz In\u00e1cio \u201cLula\u201d da Silva, might soon regret highlighting the massive censorship scheme launched by Moraes.<\/p>\n<p>In February 2025, Rumble filed suit against Moraes in a Florida federal court, seeking a judgment declaring the Brazilian justice\u2019s orders against the American company are unenforceable in this country. Trump Media, which uses Rumble as its video-streaming and hosting provider, joined the lawsuit, alleging Moraes\u2019 orders against Rumble negatively impacted its business operations.<\/p>\n<p>Among other things, Moraes had issued sealed orders directing Rumble to block the accounts of a popular Brazilian conservative commentator and blogger who fled the South American country and sought political asylum in the United States. Moraes\u2019 order also imposed fines of approximately $9,000 for every day Rumble failed to comply with his directive. The Brazilian justice further directed Rumble to provide him with account holders\u2019 information. When Rumble refused to capitulate, Moraes ordered the complete suspension of the social media company in Brazil and also threatened Rumble\u2019s CEO with criminal prosecution.<\/p>\n<p>Moraes emailed his various orders to Rumble, which is a Florida-based corporation. And so, Rumble filed its lawsuit against Moraes in a federal court in Florida, arguing that the Brazilian justice lacks authority over the American business which has no operations in Brazil. Rumble also argued that Moraes\u2019 universal ban on accounts operating from the United States violates the free speech rights of Americans, and that the order to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >provide user information violates federal law<\/a>.<\/p>\n<p>After numerous efforts to serve Moraes proved futile, Rumble obtained permission from the federal court to serve the Brazilian justice via email, which it then did. That prompted Brazil to file a Motion to Intervene, arguing that Moraes was sued in his official capacity as a justice and thus it was really a lawsuit against Brazil. Earlier this week, the court granted that motion, allowing Brazil into the case.<\/p>\n<p>The Court, however, did not rule on Brazil\u2019s simultaneously filed Motion to Dismiss, and here is where things will get interesting: Rumble\u2019s complaint details not merely Moraes\u2019 orders against it, but the extensive censorship efforts undertaken by the justice as part of his so-called \u201cFake News Inquiry.\u201d That inquiry and the many censorship orders issued by Moraes have overwhelmingly targeted critics of Moraes, the current Brazilian president, or institutions they control.<\/p>\n<p>Last year, the State Department <a href=\"https:\/\/www.state.gov\/releases\/office-of-the-spokesperson\/2025\/07\/announcement-of-visa-restrictions-on-brazilian-judicial-officials-and-their-immediate-family-members\/\" target=\"_blank\" rel=\"noreferrer noopener\">responded<\/a> to those Brazilian censorship activities by sanctioning Moraes and his fellow justices, with Secretary of State Rubio, writing:<\/p>\n<blockquote>\n<p>President Trump made clear that his administration will hold accountable foreign nationals who are responsible for censorship of protected expression in the United States.\u00a0 Brazilian Supreme Federal Court Justice Alexandre de Moraes\u2019s political witch hunt against Jair Bolsonaro created a persecution and censorship complex so sweeping that it not only violates basic rights of Brazilians, but also extends beyond Brazil\u2019s shores to target Americans.<\/p>\n<\/blockquote>\n<p>Bolsonaro, who Rubio had singled-out in his press release, is a conservative who had served as Brazil\u2019s president from 2019 to 2023, and his son, Sen.\u00a0Fl\u00e1vio Bolsonaro,\u00a0is currently running against the left-wing incumbent, President Lula. <\/p>\n<p>By intervening in Rumble\u2019s lawsuit against Moraes, Lula has just reupped the newsworthiness of his country\u2019s censorship against his political opponents. And while Moraes may be able to shutter Rumble and extort other social media companies into silencing their political opponents, it won\u2019t be as easy to bury news of Brazil\u2019s appearance in a federal court to defend its autocratic censorship \u2014 especially with President Trump\u2019s social media start-up also a plaintiff in the litigation.<\/p>\n<p>Come October, then, we may well see Sen. Bolsonaro joining the <a href=\"https:\/\/apnews.com\/article\/elections-latin-america-argentina-colombia-ecuador-fc5e0224b70c578faaf5c56d2d2a1d82\" target=\"_blank\" rel=\"noreferrer noopener\">growing<\/a> slate of conservative leaders in Central and South America who have replaced their socialist predecessors.<\/p>\n<hr>\n<p>      Margot Cleveland is an investigative journalist and legal analyst and serves as The Federalist\u2019s senior legal correspondent.
