id=\"more\"><\/p>\n<div>\n<p>When George Washington lived in the President\u2019s House in Philadelphia, at that time the nation\u2019s capital, he consistently focused on <a href=\"https:\/\/amzn.to\/3YuVZYV\" >setting rightful constitutional precedents<\/a>.\u00a0One thing our first president didn\u2019t have to worry about was having lower federal court judges issue rulings that professed to bind the entire nation.\u00a0Now, as the Trump administration seeks to replace a woke exhibit at the President\u2019s House Site that made Washington the most heavily criticized individual at Independence Park, its efforts are being blocked by a lone federal judge who sits in New England, far from Philadelphia.<\/p>\n<p>The President\u2019s House exhibit, opened by the National Park Service under President Obama, was <a href=\"https:\/\/www.nationalreview.com\/2026\/05\/the-battle-for-independence-park\/\" target=\"_blank\" rel=\"noreferrer noopener\">spearheaded<\/a> by the Avenging the Ancestors Coalition and other leftist activists.\u00a0ATAC (pronounced \u201cattack\u201d) has <a href=\"https:\/\/www.phillytrib.com\/commentary\/michaelcoard\/coard-blacks-who-celebrate-july-4th-are-ignorant-or-traitors-or-both\/article_549b103a-a7bc-5cad-855b-1028da3a9b31.html\" target=\"_blank\" rel=\"noreferrer noopener\">sponsored<\/a> \u201cAnti-July Fourth Day\u201d events, and its founder, Michael Coard, <a href=\"https:\/\/www.phillytrib.com\/commentary\/michaelcoard\/coard-blacks-who-celebrate-july-4th-are-ignorant-or-traitors-or-both\/article_549b103a-a7bc-5cad-855b-1028da3a9b31.html\" target=\"_blank\" rel=\"noreferrer noopener\">speaks<\/a> of \u201cthe 1776 birth of the racist American nation\u201d and calls those who celebrate July 4 \u201ctraitors\u201d who \u201cembrace whiteness.\u201d<\/p>\n<p>The President\u2019s House exhibit essentially ignored the watershed events that happened there during the first two presidencies, focusing almost exclusively on slavery.\u00a0Because Washington had brought several slaves north with him to Philadelphia, 25 of the site\u2019s 30 signs <a href=\"https:\/\/claremontreviewofbooks.com\/hijacking-americas-story\/\" target=\"_blank\" rel=\"noreferrer noopener\">focused<\/a> on slavery or race relations.\u00a0These signs spoke of \u201cWashington\u2019s Deceit\u201d and claimed he \u201cmocked the nation\u2019s pretense to be a beacon of liberty.\u201d<\/p>\n<p>After the Park Service <a href=\"https:\/\/www.wsj.com\/opinion\/the-trump-administration-reclaims-washingtons-home-577fa90c?st=qpMYmc&#038;reflink=desktopwebshare_permalink\" target=\"_blank\" rel=\"noreferrer noopener\">removed<\/a> the signs in January, Philadelphia sued, and a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/maryland-judge-allows-schools-to-change-names-of-students-without-parental-consent\/\" title=\"Maryland Judge Allows Schools to Change Names of Students Without Parental Consent\">district court judge ruled<\/a> they must be reinstalled.\u00a0Some were rehung before the Third Circuit Court of Appeals issued a partial stay while it considered the case on an expedited basis.\u00a0Last week, a three-judge panel for the Third Circuit \u2014 composed of Bush, Obama, and Trump appointees \u2014 unanimously ruled in the administration\u2019s favor.  <\/p>\n<p>Writing for the court, Judge Thomas Hardiman <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca3.127203\/gov.uscourts.ca3.127203.112.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">observes<\/a> that \u201cthe City does not own the President\u2019s House or anything in it.\u201d\u00a0Rather, \u201cNPS owns the President\u2019s House\u201d and is therefore free to change the exhibit as it sees fit.\u00a0Hardiman\u2019s opinion also notes that the Park Service\u2019s <a href=\"https:\/\/www.city-journal.org\/article\/independence-national-historical-park-presidents-house-site-signs\" target=\"_blank\" rel=\"noreferrer noopener\">replacement signs<\/a>, which it seeks to hang by July 4, <a href=\"https:\/\/www.nps.gov\/inde\/planyourvisit\/presidentshousesite.htm\" target=\"_blank\" rel=\"noreferrer noopener\">discuss<\/a> the house, the people who lived there (including slaves), the executive branch, and the history of slavery in America.\u00a0\u201cThese new panels are full of historical context,\u201d he writes, and the ruling green-lights the Trump administration to hang them.<\/p>\n<p>The administration can\u2019t do so, however, because of a separate ruling by Judge Angel Kelley, whose district court is located in Boston.\u00a0Kelley, a Biden appointee, <a href=\"https:\/\/cases.justia.com\/federal\/district-courts\/massachusetts\/madce\/1:2026cv10877\/296214\/41\/0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a nationwide injunction saying the Park Service must rehang \u2014 by July 3 \u2014 all woke signs it has taken down during this administration.\u00a0It might seem strange that a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/government-unions-have-been-stealing-money-for-years-now-scotus-has-the-chance-to-intervene\/\" title=\"Government Unions Have Been Stealing Money For Years \u2014 Now, SCOTUS Has The Chance To Intervene\">lower court judge<\/a> in far-off Boston, who didn\u2019t even address the specific arguments in the Philadelphia case, could effectively overrule three judges on a higher court that sits in Philadelphia and did address those arguments.\u00a0But such is the reality under so-called \u201cuniversal injunctions.\u201d<\/p>\n<p>Kelley\u2019s <a href=\"https:\/\/cases.justia.com\/federal\/district-courts\/massachusetts\/madce\/1:2026cv10877\/296214\/41\/0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">opinion<\/a>, which uses \u201cdiverse,\u201d \u201cequity,\u201d or \u201cinclusive\u201d 23 times, effectively ignores the law, applying it only in its broadest strokes to reach her desired ends.\u00a0She writes that the Park Service must \u201cmanage \u2026 sites in a manner that serves the public,\u201d but its actions \u201cfailed to consider the interests of the public.\u201d\u00a0\u201cFor example,\u201d she writes, the NGOs who brought the suit are harmed because this \u201cshift\u201d in \u201cpriorities\u201d jeopardizes their ability \u201cto participate in panels on topics including #MeToo and #BlackLivesMatter.\u201d\u00a0Also, a homeschooling member of one NGO \u201ccan no longer rely on the park sites for their pedagogical value.\u201d<\/p>\n<p>Her ruling ultimately objects to the opening line of Article II of the Constitution, which vests the \u201cexecutive Power \u2026 in a President.\u201d\u00a0She concludes that \u201ca unilateral, unreasoned, and lawless Executive Order of a president cannot be the sole justification\u201d for changing exhibits, as we cannot let ourselves be ruled by \u201cthe whims of a single individual\u201d \u2014 unless, of course, that individual is a district court judge in Boston.<\/p>\n<p>Kelley\u2019s ruling openly defies the Supreme Court\u2019s opinion last year in <em>Trump v. CASA<\/em>.\u00a0Therein, the Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a884_8n59.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">writes<\/a> that \u201cunder the Judiciary Act,\u201d which President Washington signed into law, \u201cfederal courts lack authority to issue\u201d universal injunctions.\u00a0The Court notes that universal injunctions create the bizarre situation whereby a \u201cplaintiff must win just one suit to secure sweeping relief,\u201d while \u201cthe Government must win everywhere\u201d \u2014 as the President\u2019s House Site battle demonstrates.<\/p>\n<p>The Trump administration promptly asked for a stay of Kelley\u2019s rogue ruling.\u00a0So, the race is on to hang <a href=\"https:\/\/www.realclearpolitics.com\/articles\/2026\/05\/04\/reclaiming_independence_park_154086.html\" target=\"_blank\" rel=\"noreferrer noopener\">the replacement signs<\/a> at the President\u2019s House Site by the 250th anniversary of American independence.\u00a0If the administration succeeds \u2014 thereby honoring the man who did more to achieve our independence than any other \u2014 it will mark a great win for the separation of powers, for the telling of America\u2019s story, and for the quarter-millennial celebration of the country.<\/p>\n<hr>\n<p>      Jeffrey H.
