Who Will It Be?\">expedited removal process<\/a> for illegal immigrants across the United States, overturning a previous ruling that temporarily blocked these efforts. The 2-1 decision by the D.C. Circuit Court of Appeals reversed a 2025 court order that had limited the expansion of expedited removal, which allows certain aliens to be deported without full hearings. The court found that the administration\u2019s policy is consistent with constitutional due process, dismissing claims that it violated legal procedures. The ruling reflects ongoing legal debates about the scope of immigration enforcement and executive authority, with some judges dissenting on due process concerns. Circuit Court of Appeals overturned an August 2025 decision by Biden-appointed D.C. District Judge <a href=\"https:\/\/thefederalist.com\/2025\/09\/15\/rests-on-a-series-of-legal-errors-trump-admin-appeals-court-order-blocking-removal-of-fed-governor-lisa-cook\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jia Cobb<\/a>. That ruling <a href=\"https:\/\/www.politico.com\/news\/2025\/08\/29\/trump-deportation-expedited-judge-00538077\" target=\"_blank\" rel=\"noreferrer noopener\">attempted<\/a> to block the Trump administration\u2019s efforts to expand the \u201cexpedited removal\u201d process to increase the deportation of illegal immigrants. <\/p>\n<div id=\"fdrlst__b89e9-3896880938\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>According to the <a href=\"https:\/\/www.congress.gov\/crs_external_products\/R\/PDF\/R45314\/R45314.7.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Congressional Research Service<\/a>, federal law established a \u201cstreamlined expedited removal process\u201d in which \u201ccertain aliens deemed inadmissible by an immigration officer may be removed from the United States without further administrative hearings or review.\u201d While prior administrations limited expedited removal to aliens \u201cintercepted within 100 miles of a U.S. land border and within two weeks of entering the U.S.,\u201d the Trump administration expanded it \u201cto apply anywhere in the U.S. and to any unauthorized immigrant who cannot show they have been in the country for more than two years,\u201d as described by left-wing <a href=\"https:\/\/www.politico.com\/news\/2025\/08\/29\/trump-deportation-expedited-judge-00538077\" target=\"_blank\" rel=\"noreferrer noopener\">Politico<\/a>. <\/p>\n<p>Writing for the majority, Judge Justin Walker, a Trump appointee, ruled that Cobb\u2019s finding that the Trump administration\u2019s expansion of expedited removal \u201clikely violated due process\u201d is incorrect. In doing so, he said that Cobb\u2019s pause of the government\u2019s policies is now void.<\/p>\n<p>\u201cAlthough [the challenger] Make the Road clears the four threshold procedural hurdles, it falters when it reaches the merits. It has not shown that the written directives fail to comply with constitutional due process,\u201d Walker wrote. \u201cAnd Make the Road\u2019s evidence of implementation problems \u2014 referral errors, rushed interviews, communication barriers \u2014 does not establish that the Designation and Huffman Memorandum are themselves \u2018not consistent with applicable provisions of [federal law] or \u2026 otherwise in violation of law.\u2019 We therefore vacate the district court\u2019s \u00a7705 stay.\u201d<\/p>\n<p>While joining parts of Walker\u2019s opinion and concurring in the judgment, Judge Neomi Rao, another Trump appointee, authored a separate opinion expressing a different view. She agreed that the administration\u2019s expedited removal policy is \u201cconsistent with due process and that the district court\u2019s stay must be vacated,\u201d but said that Make the Road\u2019s lawsuit \u201cshould have been dismissed at the threshold because Congress left expedited removal policies to the Executive\u2019s discretion, barred judicial review, and foreclosed universal remedies.\u201d<\/p>\n<p>Meanwhile, Judge Robert Wilkins, an Obama appointee, dissented from the court\u2019s holding. While he concurred with aspects of Walker\u2019s opinion \u2014 such as its finding that the plaintiffs have standing and that the president\u2019s directive is reviewable under federal law \u2014 he expressed disagreement with the majority\u2019s determination regarding due process.<\/p>\n<p>\u201cI write separately \u2026 to express my view that Plaintiffs were entitled to a \u00a7705 stay under [existing precedent], having shown a likelihood of success that the 2025 Designation and Huffman Memorandum violate due process. On that ground, I respectfully dissent,\u201d Wilkins wrote.<\/p>\n<p>The ruling came down the same day the U.S. Supreme Court handed the administration a win in another <a href=\"https:\/\/amzn.to\/3YuVZYV\" >high-profile immigration case<\/a>. In <em><a href=\"https:\/\/thefederalist.com\/2026\/06\/23\/scotus-upholds-border-officials-ability-to-parole-green-card-holders-who-committed-crimes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Blanche v. Lau<\/a><\/em>, the 6-3 majority recognized border officials\u2019 ability to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-upholds-border-officials-ability-to-parole-green-card-holders-who-committed-crimes\/\" title=\"SCOTUS: Gov&#039;t Can ... &#039;Criminal&#039; Green Card Holders\">parole green card holders<\/a> who have \u201ccommitted a crime involving moral turpitude.\u201d<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
