Examples cited include a Massachusetts judge ordering the reinstatement of park signs promoting left-wing messages and another blocking a law in Idaho,with some decisions based on speculation and political bias. Such actions are seen as undermining the separation of powers, a principle emphasized by Alexander Hamilton, who warned that the judiciary is intended only to judge, not to enforce policy. The piece highlights that judges lack autonomous enforcement power, relying on other branches and public respect for the rule of law. critics warn that judicial activism threatens to erode legitimacy and could lead to a constitutional crisis if courts continue to bypass constitutional limits. But perhaps among the top ticket items would be how the country\u2019s \u201c<a href=\"https:\/\/guides.loc.gov\/federalist-papers\/text-71-80#s-lg-box-wrapper-25493470\" target=\"_blank\" rel=\"noreferrer noopener\">least dangerous<\/a>\u201d branch has usurped the constitutionally guaranteed powers of the other two.<\/p>\n<p>That\u2019s the reality currently unfolding throughout the federal judiciary, where a significant number of \u201cjudges\u201d have flipped separation of powers on its head. While supposed to perform in an objective manner, these rogue actors have greenlit <a href=\"https:\/\/thefederalist.com\/tag\/judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">leftists\u2019 lawfare<\/a> against the Trump administration and Republicans by issuing overreaching orders \u2014 many of which have little basis in the Constitution or law. <\/p>\n<p>A decision by Massachusetts District Judge Angel Kelley is a perfect example of this phenomenon at play. <\/p>\n<p>Last Friday, the Biden appointee <a href=\"https:\/\/thefederalist.com\/2026\/06\/16\/massachusetts-judge-orders-trump-to-put-leftist-propaganda-back-up-at-national-parks\/\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> the administration to reinstall national park signs that advanced left-wing narratives about LGBT ideology, climate alarmism, and American historical figures. As Skye Graham wrote in these pages, her directive came dripping with \u201cpolitical activism [and her] eagerness to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/massachusetts-judge-orders-trump-to-put-leftist-propaganda-back-up-at-national-parks\/\" title=\"Judge Orders Trump To Rein... Woke Propaganda At National Parks\">defend promoting woke agendas<\/a> at taxpayer-funded national parks.\u201d<\/p>\n<p>To the casual observer, Kelley\u2019s bid to hijack the functions of the executive branch may seem like a one-off \u2014 if not for the even more egregious decision that preceded it. <\/p>\n<p>A day prior, a different Massachusetts-based district judge, Richard Stearns, <a href=\"https:\/\/www.courthousenews.com\/judge-halts-ken-paxtons-retaliatory-actblue-fundraising-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">unilaterally halted<\/a> Texas Attorney General Ken Paxton\u2019s lawsuit against <a href=\"https:\/\/thefederalist.com\/tag\/actblue\/\" target=\"_blank\" rel=\"noreferrer noopener\">ActBlue<\/a>. The major Democrat-aligned fundraising platform is currently facing scrutiny over allegations of <a href=\"https:\/\/thefederalist.com\/2026\/06\/17\/actblue-refuses-to-answer-congresss-questions-about-its-foreign-donation-pipeline\/\" target=\"_blank\" rel=\"noreferrer noopener\">accepting contributions<\/a> from foreign nationals and other corrupt activities.<\/p>\n<p>The Clinton-appointed Stearns apparently based his <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2026\/06\/act-blue-order-massachusetts-preliminary-injunction-paxton.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">preliminary injunction<\/a> on pure speculation. Writing as if he were an ActBlue employee, he regurgitated the fundraising platform\u2019s claim that Paxton\u2019s statements as a candidate criticizing ActBlue are proof that his suit was \u201cfiled in retaliation for (and in an attempt to suppress) ActBlue\u2019s efforts\u201d to support Paxton\u2019s Senate opponent, James Talarico. <\/p>\n<p>\u201cPaxton\u2019s public statements in the wake of filing the case against ActBlue reveal his true motivation,\u201d Stearns wrote matter-of-factly. \u201cWhile a prosecutor is entitled to a large degree of prosecutorial discretion and has a right to make a considered public accounting of his actions, Paxton did not hesitate in drawing a connection between the lawsuit and his candidacy for Senate.\u201d<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">According to both these decisions, serving an organization in another state and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >reviewing discovery creates *general* personal jurisdiction<\/a> over an outside state officer? (@EWess92) <a href=\"https:\/\/x.com\/EWess92\/status\/2065192531932201186?ref_src=twsrc%5Etfw\">June 11, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>A Biden-appointed district judge followed this activist blueprint on Tuesday by <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/5927361-idaho-transgender-bathroom-law-injunction\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocking<\/a> an Idaho law requiring individuals to use the restroom that corresponds with their sex.<\/p>\n<p>While certainly outrageous, these types of outcome-oriented decisions aren\u2019t surprising. Like a frog in boiling water, Americans have slowly become accustomed to activist judges overstepping their bounds to produce partisan rulings that their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-sides-with-man-fighting-gun-seizure-after-mental-health-episode\/\" title=\"Supreme Court Sides With Man Fighting Gun Seizure After Mental Health Episode\">left-wing allies<\/a> want. <\/p>\n<p>That in itself is problematic, given that such a dynamic is at complete odds with the framer\u2019s view of how American government is intended to function. <\/p>\n<p>Alexander Hamilton aptly noted in <a href=\"https:\/\/guides.loc.gov\/federalist-papers\/text-71-80#s-lg-box-wrapper-25493470\" target=\"_blank\" rel=\"noreferrer noopener\">Federalist No. 78<\/a> how, if there were to be a weaker branch, it would be the judiciary because it \u201chas no influence over either the sword or the purse; no direction either of the strength or of the wealth of the society; and can take no active resolution whatever.\u201d In possessing only the power of \u201cjudgment,\u201d it relies upon \u201cthe aid of the executive arm even for the efficacy\u201d of its decisions, he added.<\/p>\n<p>To put it another way, the judiciary has no power to enforce its own rulings. Its authority is wholly dependent upon the people and their government\u2019s willingness to respect it.<\/p>\n<p>Leftists regularly <a href=\"https:\/\/www.nytimes.com\/2025\/03\/07\/opinion\/trump-courts-judges.html\" target=\"_blank\" rel=\"noreferrer noopener\">foment fears<\/a> that President Trump will \u201cdefy\u201d court orders he finds unfavorable and thus throw America into a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/brian-stelter-claims-cnn-would-never-air-an-incendiary-phrase-that-anderson-cooper-used-thursday\/\" title=\"Brian Stelter Claims CNN Would \u2018Never\u2019 Air An \u2018Incendiary\u2019 Phrase That Anderson Cooper Used Thursday\">full-blown constitutional crisis<\/a>. In addition to being baseless, these claims miss a more fundamental point. <\/p>\n<p>That is, it\u2019s actually rogue judges (like those documented in this article) who are pushing America toward a crisis by forgoing their sworn duty to apply the law in an objective manner.<\/p>\n<p>If the judiciary refuses to operate within the limits enacted by the Constitution, then why should the other branches? And why should the people and their representatives respect the courts\u2019 judgments if they\u2019re continuously based on anything but the law?<\/p>\n<p>Those are questions 5th Circuit Judge James Ho <a href=\"https:\/\/thefederalist.com\/2026\/01\/13\/judge-ho-takes-a-sledgehammer-to-judicial-supremacy-and-its-elite-enablers\/\" target=\"_blank\" rel=\"noreferrer noopener\">addressed<\/a> in a Harvard Journal of Law &#038; Public Policy article earlier this year. Taking aim at the courts\u2019 <a href=\"https:\/\/thefederalist.com\/tag\/judicial-supremacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">judicial supremacy<\/a> problem, he wrote, \u201cIf the American people can\u2019t expect the judiciary to stay in its lane, then federal judges shouldn\u2019t expect the American people to follow them.\u201d<\/p>\n<p>Leftists and their judicial accomplices have a choice to make: They can either heed Ho\u2019s warning and call off their abuse of America\u2019s legal system, or they can continue their lawfare campaign and leave it burning in their wake.
