After DNA testing confirmed her biological origins, the couple, shocked to find their child was racially different from their Caucasian background, filed a lawsuit against the fertility clinic, which had lost track of their embryos. A custody agreement was reached, allowing Mills and Score to raise the girl despite her non-biological status. Experts warn that such cases highlight the harms of the IVF industry, which often treats embryos as disposable and can lead to legal disputes, lost embryos, and emotional trauma. Critics argue that the commodification of reproductive technology, driven by profit, fosters practices harmful to children&#8217;s welfare, including unregulated embryo storage and complex custody battles, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/billionaire-mega-donor-at-center-of-hunter-biden-art-sales-raises-ethics-concerns\/\" title=\"Billionaire Mega-Donor At Center Of Hunter Biden Art Sales Raises Ethics Concerns\">raising ethical concerns<\/a> about parenthood, identity, and the treatment of human life in fertility practices.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A 6-month-old baby girl conceived via in vitro fertilization and accidentally implanted in the wrong womb will be raised by the woman who birthed her instead of the biological parents who commissioned her creation, a \u201cmutually devised custody agreement\u201d in Florida determined this week.<\/p>\n<p>The agreement, publicized on June 15, <a href=\"https:\/\/archive.ph\/DVYO7#selection-1657.91-1657.155\" target=\"_blank\" rel=\"noreferrer noopener\">confirmed<\/a> Steven Mills and Tiffany Score will \u201ccontinue as the permanent custodial parents\u201d of the unnamed baby girl despite not sharing any of her DNA. The decision comes months after the couple filed a lawsuit against the Fertility Center of Orlando after learning that the child Score gestated for nine months was not their own.<\/p>\n<p>Score and Mills, a white couple who used their own sperm and eggs to commission embryos in 2020, were shocked in December 2025 when Score birthed a baby girl who was \u201c100 percent South Asian.\u201d<\/p>\n<p>\u201cTragically, while both JANE DOE AND JOHN DOE are racially Caucasian, Baby Doe displayed the physical appearance of a racially non-Caucasian child,\u201d the couple\u2019s January 2026 lawsuit  <a href=\"https:\/\/globalnews.ca\/wp-content\/uploads\/2026\/02\/Tiffany-Score-Steven-Mills-Fertility-Lawsuit.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a>.<\/p>\n<figure><\/figure>\n<p><a href=\"https:\/\/globalnews.ca\/wp-content\/uploads\/2026\/02\/Tiffany-Score-Steven-Mills-Fertility-Lawsuit.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cExtensive DNA testing\u201d<\/a> completed by the fertility facility due to the suit confirmed that the baby belonged to an unnamed client who was the Fertility Center of Orlando\u2019s \u201conly other patient in March 2020, when Score and Mills had embryos created and frozen.\u201d<\/p>\n<p>By then, Mills and Score had not only birthed and cared for the baby girl for months, but they had also bonded with her. <\/p>\n<p>\u201cOnly one thing is as absolutely certain as it was on the day our daughter was born: We will love and will be this child\u2019s parents forever,\u201d they <a href=\"https:\/\/archive.ph\/CCCtJ#selection-1589.0-1589.168\" target=\"_blank\" rel=\"noreferrer noopener\">wrote in a statement<\/a>. <\/p>\n<p>After some deliberation, Mills, Score, and the baby\u2019s biological parents reached a \u201cmutually devised custody agreement\u201d that confirmed Mills and Score would raise the child as their own. <\/p>\n<p>\u201cI\u2019m glad the parties have reached an agreement while this child is relatively young,\u201d 9th Circuit Judge Margaret Schreiber declared.<\/p>\n<p>Despite the judge\u2019s optimism that the baby escaped the harm of a years-long custody battle, there was never a good solution here.<\/p>\n<p>Separating the baby girl from Score, the only mother she\u2019s known in the womb and out, to reunite her with her biological mother would likely cause all of the parties involved <a href=\"https:\/\/www.sciencedaily.com\/releases\/2018\/05\/180503142724.htm\" target=\"_blank\" rel=\"noreferrer noopener\">irrevocable <\/a><a href=\"https:\/\/www.heritage.org\/marriage-and-family\/commentary\/how-surrogacy-harms-women-and-children\" target=\"_blank\" rel=\"noreferrer noopener\">physical, emotional, and mental harm<\/a>. Allowing Mills and Score to keep the baby girl despite sharing none of her DNA, similarly, would inflict <a href=\"http:\/\/futureofchildren.princeton.edu\/sites\/futureofchildren\/files\/foc_vol_30_no_1_combined_v6.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">physical, emotional, and educational disadvantages<\/a> that would not affect her if she were born and raised by her married biological parents.<\/p>\n<p>Litigation against the Fertility Center of Orlando, which <a href=\"https:\/\/nypost.com\/2026\/06\/16\/us-news\/couple-in-ivf-mix-up-will-keep-baby-thats-not-genetically-theirs\/?utm_campaign=nypost&#038;utm_source=twitter&#038;utm_medium=social\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly shuttered its doors in May<\/a>, is ongoing, but as Mills and Score\u2019s initial suit noted, \u201cthere is no adequate remedy at law for the ongoing loss, injury and damage\u201d they suffered as a result of this situation. The biggest losers in this situation, however, aren\u2019t Mills and Score or even the baby girl\u2019s genetic parents. The biggest loser is the child, whose life was treated as a commodity that could be implanted or thrown away depending on the will of the adults who commissioned her long before her conception in a lab.<\/p>\n<p>Embryos created via IVF are treated as disposable, and a majority (<a href=\"https:\/\/www.heritage.org\/life\/report\/why-the-ivf-industry-must-be-regulated\" target=\"_blank\" rel=\"noreferrer noopener\">93<\/a> to <a href=\"https:\/\/www.foxnews.com\/politics\/gop-attempts-define-position-discarding-ivf-embryos-pro-life-stances\" target=\"_blank\" rel=\"noreferrer noopener\">97<\/a> percent) go <a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC11263306\/\" target=\"_blank\" rel=\"noreferrer noopener\">unused<\/a>. Those test tube babies that are not dissected under the guise of research or discarded after <a href=\"https:\/\/www.nytimes.com\/2022\/04\/20\/health\/pgta-ivf-pregnancy-test.html\" target=\"_blank\" rel=\"noreferrer noopener\">notoriously unreliable<\/a> grading revealed traits deemed <a href=\"https:\/\/thefederalist.com\/2026\/06\/11\/like-abortion-ivf-kills-babies-for-having-less-desirable-traits\/\" target=\"_blank\" rel=\"noreferrer noopener\">less desirable<\/a> are stored indefinitely in cryopreservation tanks.<\/p>\n<p>For five years, the girl embryo conceived in a lab in 2020 sat in a freezer untouched. It\u2019s unclear if she would have been given a chance at implantation and birth by her biological parents had there not been \u201claboratory-clinic errors.\u201d<\/p>\n<p>In fact, to this day, Mills and Score\u2019s <a href=\"https:\/\/archive.ph\/DVYO7#selection-1657.92-1657.155\" target=\"_blank\" rel=\"noreferrer noopener\">sole remaining embryo<\/a> sits in a cryopreservation tank waiting to be implanted. On the contrary, the fertility industry enables and even promotes arrangements that inarguably harm children because it is profitable to cater to adults\u2019 desires. <\/p>\n<p>With assisted reproductive technology, anyone and everyone, regardless of their relationship status or sexuality, can buy their way into parenthood <a href=\"https:\/\/thefederalist.com\/2021\/06\/22\/abortion-puts-selfish-wants-above-babies-rights-too-often-ivf-does-the-same\/\" target=\"_blank\" rel=\"noreferrer noopener\">regardless of<\/a> children\u2019s natural rights.
