The piece concludes with a call to overhaul the judicial system to ensure accountability and safety for all americans.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Even as the recent <a href=\"https:\/\/thefederalist.com\/2026\/06\/10\/karmelo-anthony-sentenced-to-35-years-in-prison-for-murdering-texas-teen-austin-metcalf\/\" target=\"_blank\" rel=\"noreferrer noopener\">conviction of Karmelo Anthony<\/a> for the murder of\u00a0Austin Metcalf comes as an encouraging verdict for many of us who wish to see more law and order in our nation,\u00a0there is\u00a0cause for frustration in the recent news that Iryna Zarutska\u2019s killer, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-charges-light-rail-attacker-federal-crime\">Decarlos\u00a0Brown Jr<\/a>., has been judged unfit to stand trial in federal court. This is an absurd outcome, threatening the very possibility of\u00a0maintaining\u00a0order and justice in our society. If we wish to have a country with any meaningful justice, we must get retribution for the innocent and punish guilty brutes like Brown.  <\/p>\n<p>Iryna Zarutska was brutally murdered in\u00a0a\u00a0public railway car in Charlotte, North Carolina last August by Decarlos Brown, Jr., a deranged homeless black felon with at least\u00a014\u00a0prior arrests who nevertheless had been put back on the streets by judges. <a href=\"https:\/\/x.com\/captive_dreamer\/status\/1965121048380363015\" target=\"_blank\" rel=\"noreferrer noopener\">Video footage of the event<\/a> showed the killer muttering to himself,\u00a0\u201cI got that white girl.\u201d\u00a0This was a publicly brutal example of the kind of anti-white violence which has become frequent under our regime of <a href=\"https:\/\/chroniclesmagazine.org\/view\/anarcho-tyranny-u-s-a\/\" target=\"_blank\" rel=\"noreferrer noopener\">anarcho-tyranny<\/a>.  <\/p>\n<p>When in April\u00a0a\u00a0state judge <a href=\"https:\/\/nypost.com\/2026\/04\/08\/us-news\/iryna-zarutskas-accused-killer-decarlos-brown-jr-found-incompetent-in-charlotte-stabbing-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">determined<\/a> that Brown was mentally incompetent to stand trial on state charges, the Department of\u00a0Justice <a href=\"https:\/\/x.com\/USAO_WDNC\/status\/2041998211171201433\" target=\"_blank\" rel=\"noreferrer noopener\">reassured the public<\/a> that Brown\u00a0would\u00a0face\u00a0federal charges and\u00a0was being\u00a0held in federal custody. If convicted of the <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-charges-light-rail-attacker-federal-crime\" target=\"_blank\" rel=\"noreferrer noopener\">federal charges<\/a> (one count of committing an act causing death on a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/alleged-brooklyn-subway-shooter-faces-federal-terrorism-charge\/\" title=\"Alleged Brooklyn Subway Shooter ...s ... Terrorism Charge\">mass transportation system<\/a>), Brown would face life in prison or the death penalty.<\/p>\n<p>Iryna Zarutska\u2019s mother\u00a0attended\u00a0President Trump\u2019s\u00a0February 2026 State of the Union address as one of his honored guests.\u00a0In his\u00a0speech,\u00a0Trump <a href=\"https:\/\/x.com\/RapidResponse47\/status\/2026501148400554016\" target=\"_blank\" rel=\"noreferrer noopener\">vowed to get justice:<\/a> \u201c[D]angerous\u00a0repeat offenders continue to be released by pro-crime Democrat politicians\u00a0again and again \u2026\u00a0No one will ever forget the expression of terror on Iryna\u2019s face as she looked up at her attacker in the last seconds of her life \u2026 Mrs. Zarutska \u2014 tonight, I promise you, we will ensure justice for your magnificent daughter, Iryna.\u201d  <\/p>\n<p>However, an all-too-predictable obstacle has once again arisen. Now, as of last week, U.S. District Judge Kenneth Bell <a href=\"https:\/\/www.cnn.com\/2026\/06\/09\/us\/decarlos-brown-jr-charlotte-train-stabbing\" target=\"_blank\" rel=\"noreferrer noopener\">decided<\/a> that Brown is incompetent to stand trial at least for four months while he undergoes mental treatment at a federal facility. Unlike many high-profile cases in which\u00a0leftist, pro-crime judges are minorities, foreign-born, or women,\u00a0this\u00a0judge is a white, male, Trump appointee\u00a0\u2013\u00a0further highlighting the problem\u00a0with the\u00a0existing criminal justice system. While radical, left-wing judges are bad enough,\u00a0there are\u00a0further legal and structural problems that must be overcome.   <\/p>\n<p>Why\u00a0can the justice system legally\u00a0deem\u00a0criminals\u00a0mentally incompetent to stand trial?\u00a0\u00a0The criminal justice system should primarily aim at protecting the innocent and providing the conditions for an ordered society. Permanently removing such dangerous people as Decarlos Brown from the streets should not be controversial. As John Locke wrote in his famous <em>Second Treatise on Government, <\/em>the violent criminal,\u00a0\u201chaving renounced reason, the common rule and measure God hath given to mankind, hath, by the unjust violence and slaughter he hath committed upon one, declared war against all mankind, and therefore may be destroyed as a lion or a\u00a0tyger, one of those wild savage beasts, with whom men can have no society nor security\u2026\u201d\u00a0(II.11). Those who act like\u00a0\u201cwild savage beasts\u201d\u00a0and\u00a0render\u00a0themselves incapable of living in society should be put down like wild animals. The idea that we cannot punish these criminals because they are too dumb or deranged to understand the consequences of their own actions is absurd and must be repudiated.   <\/p>\n<h2><strong>What Can Be Done?<\/strong> <\/h2>\n<p>What can be done? At present, the trial is <a href=\"https:\/\/www.charlotteobserver.com\/news\/local\/crime\/article316053011.html\" target=\"_blank\" rel=\"noreferrer noopener\">delayed<\/a> as Brown undergoes treatment at a federal mental facility for not more than four months. At that point, he must be reassessed for competency to stand trial. \u00a0If he is not ever\u00a0deemed\u00a0competent, then he\u00a0likely\u00a0will\u00a0be committed to an asylum. The state trial, in which he has also been\u00a0deemed\u00a0incompetent, will await the results of the federal trial anyway. This entire process with all its delays is infuriating for the American people to\u00a0witness\u00a0as we await justice.   <\/p>\n<p>Instead of what we should have\u00a0\u2013\u00a0swift convictions and swift <a href=\"https:\/\/thefederalist.com\/2026\/05\/18\/heres-a-not-so-modest-proposal-bring-back-public-executions\/\" target=\"_blank\" rel=\"noreferrer noopener\">public executions<\/a> \u2013\u00a0we have to watch a ridiculous array of procedural obstacles unfold, leaving us to be controlled by the whims of judges and alleged mental health authorities. Who is to guarantee that Decarlos Brown and others like him never get out of asylums or mental facilities? Brown had a history of violent crime prior to his arrest for murder. Numerous cases like this abound. We currently have no legal guarantees that <a href=\"https:\/\/www.foxnews.com\/us\/kentucky-child-killer-walks-free-good-behavior-gets-arrested-again-days\" target=\"_blank\" rel=\"noreferrer noopener\">even those convicted for heinous crimes will serve their entire sentence<\/a>, let alone an assurance that those\u00a0<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-passes-kennedys-amendment-protecting-veterans-second-amendment-rights\/\" title=\"Senate approves Kennedy&#039;s amendment safeguarding veterans&#039; gun rights.\">deemed\u00a0mentally incompetent<\/a> to\u00a0stand\u00a0trial\u00a0won\u2019t\u00a0be somehow released. Why should American taxpayers have to pay to subsidize the prolonged existence of such a murderer in government facilities? <\/p>\n<p>This case highlights many of the problems with our corrupt criminal justice system. To obtain a change of venue (e.g.\u00a0seek\u00a0to try the case before a different court in a different district) is almost impossible, since venue change is <a href=\"https:\/\/www.goldsteinhilley.com\/our-passion\/legal-resources\/indictments\/change-of-venue\/\" target=\"_blank\" rel=\"noreferrer noopener\">rare and must be requested by the defendant<\/a>. In theory, this makes sense because\u00a0of\u00a0the presumption of innocence for the defendant and the desire to protect the rights of the defendant against prosecutorial manipulation. Yet, we must honestly assess our current circumstances: we currently have far too little law enforcement and criminal punishment for basic needs like having communities safe from thugs and criminals (both domestic criminals and illegal aliens). We should consider what kind of extraordinary measures may be necessary to reform our system to achieve law and order. The procedures we enact should always aim at achieving the basic ends of government\u00a0\u2014\u00a0protection of life, liberty, and property for the citizens.\u00a0If\u00a0the <a href=\"https:\/\/americanreformer.org\/2025\/07\/proceduralism-and-the-idolatry-of-institutions\/\" target=\"_blank\" rel=\"noreferrer noopener\">ends of government<\/a> are failing right now, what use are good legal procedures? <\/p>\n<p>\u201cImpeach the judges\u201d\u00a0is a common refrain online, not surprisingly. However, impeachment of state or federal judges\u00a0is\u00a0very difficult, requiring an aggressiveness on the part of GOP lawmakers and willing majorities in both chambers of the legislature. Under the current legal framework, GOP legislators and advocates should adopt every legal strategy possible from moving to impeach judges to passing new legislation to proposing amendments to state constitutions. This should be done at the federal and state level.   <\/p>\n<p>If we\u00a0don\u2019t\u00a0fix our criminal justice system and our judiciary, we can never restore order and rebuild this country for us and our offspring.   <\/p>\n<hr>\n<p>      Samuel Kimzey is a doctoral student at Hillsdale College and a 2025 Publius Fellow at the Claremont Institute.
