The Court\u2019s order list revealed that the justices rejected her request for an appeal without dissent or clarification. Newman was suspended in 2023 by the court\u2019s Judicial Council due to concerns about her health, but she and the New Civil Liberties Alliance contend that her suspension and removal violate federal law, specifically the 1980 Judicial Council Reform and Judicial Conduct and Disability Act, which limits administrative suspensions and explicitly prohibits removals from office without congressional action. Lower courts dismissed her constitutional challenges, directing her to seek relief through the Judicial Conference. return false;\" title=\"Printer Friendly, PDF &#038; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>The U.S. Supreme Court has declined to help a 98-year-old <a href=\"https:\/\/amzn.to\/3YuVZYV\" >judge facing seemingly unlawful efforts<\/a> to suspend her from the federal bench.<\/p>\n<p>The revelation was disclosed in the high court\u2019s Monday <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/061526zor_5if6.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">order list<\/a>, in which the justices rejected a request by Federal Circuit Judge Pauline Newman to take up and hear arguments in her case (<em>Newman v. Moore<\/em>). There were no noted dissents, and no explanation was given for the decision. <\/p>\n<div id=\"fdrlst__b89e9-2709358811\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>As The Federalist recently <a href=\"https:\/\/thefederalist.com\/2026\/06\/10\/scotus-to-decide-whether-rogue-judges-can-sideline-constitution-to-oust-their-colleague\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, Newman was first suspended from the bench in 2023 by Federal Circuit Chief Judge Kimberly Moore and the court\u2019s Judicial Council over alleged concerns about her mental and physical health. Despite protests from Newman and her counsel, the New Civil Liberties Alliance (NCLA), this indefinite suspension \u2014 which remains ongoing \u2014 has barred the Reagan appointee from partaking in cases brought before the court.<\/p>\n<p>Newman and the NCLA challenged her de-facto removal from the bench by arguing that the Judicial Council\u2019s actions are unconstitutional and violate the 1980 Judicial Council Reform and Judicial Conduct and Disability Act (\u201c<a href=\"https:\/\/www.congress.gov\/bill\/96th-congress\/house-bill\/7974\" target=\"_blank\" rel=\"noreferrer noopener\">the Disability Act<\/a>\u201c), which governs the process for filing misconduct and disability complaints against federal judges. As <a href=\"https:\/\/nclalegal.org\/case\/re-complaint-against-circuit-judge-pauline-newman\/\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> by the NCLA, they argued that only Congress possesses the power to remove judges from the bench and that the Disability Act \u201cpermits administrative suspensions, but only a time-limited suspension with a definite end-date\u201d and \u201cexplicitly forbids removing a judge from office.\u201d<\/p>\n<p>D.C.-based District Judge Christopher Cooper rejected Newman\u2019s arguments in 2024. Citing a past decision by the D.C. Circuit Court of Appeals, the Obama appointee argued that federal courts are precluded from hearing her case and that she must seek relief from the <a href=\"https:\/\/www.uscourts.gov\/administration-policies\/governance-judicial-conference\/about-judicial-conference-united-states\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Judicial Conference<\/a>. A three-judge panel on the D.C. Circuit \u2014 comprised of all Democrat appointees \u2014 upheld Cooper\u2019s ruling on similar grounds in August 2025.<\/p>\n<p>With nowhere left to turn, Newman petitioned SCOTUS for relief earlier this year. In asking the justices to take up her case, she and the NCLA forewarned about the dangers of federal judges being allowed to seemingly violate the Constitution by effectively removing their colleagues from the bench. <\/p>\n<p>\u201cThis <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-harris-admin-is-fighting-to-keep-noncitizens-on-voter-rolls\/\" title=\"Biden-Harris Admin Is Fighting To Keep Noncitizens On Voter Rolls\">administrative removal<\/a> of a judge who is famous for dissenting from her colleagues, by those same colleagues, with judicial refusal to review the merits of the action, undermines the judicial independence that is a vital foundation of our constitutional design,\u201d the petition <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-1101\/400775\/20260312164901795_Petition.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">reads<\/a>. \u201cEvery judge who gets crosswise with her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-president-trump-gives-pardons-to-73-individuals-and-commutes-another-70-sentences-steve-bannon-is-included\/\" title=\"BREAKING: President Trump Gives Pardons to 73 Individuals and Commutes Another 70 Sentences \u2013 Steve Bannon Is Included\">chief judge<\/a> or her colleagues must now worry whether similar tactics could be used to remove them.\u201d<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
