The proposed bill aims to criminalize efforts to question or delay a child&#8217;s declaration of being transgender,equating such conversations with &#8220;conversion therapy&#8221; and punishing them accordingly. This approach would effectively outlaw cautious, nuanced discussions about gender dysphoria, leading to potential legal consequences for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/graphic-sexual-content-assigned-to-texas-students-dissenting-parents-harassed-with-anti-christiandks\/\" title=\"Graphic Sexual Content Assigned To Texas Students; Dissenting Parents Harassed With Anti-Christian\u2026\u2018D**ks...\u00a0\">mental health professionals<\/a> who do not immediately prescribe puberty blockers or schedule surgeries for transgender minors.<\/p>\n<p>The legislation also seeks to expand legal remedies for individuals who believe they were harmed by past &#8220;conversion therapy,&#8221; allowing for malpractice lawsuits against practitioners even years after the fact. However, recent legal decisions, such as the supreme Court ruling in Colorado, challenge the constitutionality of bans on subjective speech, complicating California&#8217;s efforts. The bill as it stands proposes broad restrictions on therapy practices aimed at directing or influencing a patient&#8217;s gender or sexual orientation, raising concerns among healthcare providers about potential lawsuits and free speech limitations.<\/p>\n<p>Advocates warn that the legislation&#8217;s unspecified language and broad provisions could have chilling effects on counseling, religious expression, and medical practices, with some groups worried about the impact on faith-based counseling and speech. As the bill advances rapidly through the legislative process, many experts and organizations call for clarifications and further scrutiny before it becomes law, highlighting significant legal and ethical questions surrounding the proposed restrictions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>California is about to harm people again, and the dangerous moral narcissist and <a href=\"https:\/\/x.com\/Scott_Wiener\/status\/1484560885364396036\" target=\"_blank\" rel=\"noreferrer noopener\">sexualizer of childhood<\/a> Scott Wiener is as always leading the way. The state legislature is about to make it more dangerous to tell a self-identified trans kid that he or she wasn\u2019t born in the wrong body.<\/p>\n<p>To understand what\u2019s at stake, <a href=\"https:\/\/www.instagram.com\/reel\/DPfzfG8DlPa\/\" target=\"_blank\" rel=\"noreferrer noopener\">start with Jamie Reed<\/a>. A former medical caseworker and a self-identified \u201cqueer woman\u201d with a trans-identifying spouse, Reed believes that transgender identity is real, defensible, and worthy of protection. But she quit her job at a pediatric transgender clinic because the things she saw there were clearly indefensible, even for an advocate of trans identity.<\/p>\n<p>In a much-discussed <a href=\"https:\/\/archive.is\/S7AQD\" target=\"_blank\" rel=\"noreferrer noopener\">essay<\/a> at the Free Press, Reed wrote that her clinic began to see clear signs of social contagion: \u201cSometimes clusters of girls arrived from the same high school.\u201d<\/p>\n<p>Reed wrote, at length, about the degree to which minors who identified as transgender showed up with mental health problems that ran underneath their declarations about sexual identity: \u201cThe girls who came to us had many comorbidities: depression, anxiety, ADHD, eating disorders, obesity. Many were diagnosed with autism, or had autism-like symptoms.\u201d <\/p>\n<p>Despite all those reasons to tread carefully, Reed wrote, the clinic rushed every child declaring a transgender identity straight into the medical pipeline, no questions asked. \u201cTo begin transitioning, the girls needed a letter of support from a therapist \u2014 usually one we recommended \u2014 who they had to see only once or twice for the green light,\u201d she wrote. \u201cThe next stop was a single visit to the endocrinologist for a testosterone prescription.\u201d <\/p>\n<p>Even as an advocate of transgender identity, Reed advocated for caution, believing that some young people have real gender dysphoria but many don\u2019t. Social fashion plus depression and anxiety could lead teenagers to a false choice, and careful discussion was required to guide them through their decision: Are you <em>sure<\/em> about this?<\/p>\n<p>California intends to punish that question, and to punish it harshly. Under the terms of a bill that\u2019s racing through the state legislature, slowing down to talk about a child\u2019s declaration of transgender identity would be categorized as \u201cconversion therapy\u201d and punished for denying a child\u2019s true identity. When a child says <em>I\u2019m trans<\/em>, the only answer California will accept is <em>here is your prescription for puberty blockers, and let\u2019s get you scheduled for surgery<\/em>. They\u2019re not just taking away the red light \u2013\u00a0they also mean to outlaw the yellow light. <\/p>\n<p><a href=\"https:\/\/sd11.senate.ca.gov\/news\/senator-wiener-announces-bill-protect-survivors-conversion-therapy\" target=\"_blank\" rel=\"noreferrer noopener\">Declaring<\/a> that it\u2019s \u201cpsychological torture\u201d to tell a child that he or she may not have been born in the wrong body, Wiener has introduced SB 934, which \u201callows survivors of conversion therapy to seek civil remedies and justice through malpractice lawsuits for the harm that was done to them, even years after the fake therapy occurred,\u201d substantially expanding the legal deadlines for bringing lawsuits against practitioners.<\/p>\n<p>The <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202520260SB934\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a> is strapped to a rocket sled: It moved quickly through Senate committees, passed on the Senate floor, and is now moving quickly through committee hearings in the Assembly.<\/p>\n<p>As it advances, the bill is becoming muddled by its encounter with reality. You can read a series of <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billAnalysisClient.xhtml?bill_id=202520260SB934\" target=\"_blank\" rel=\"noreferrer noopener\">analyses from legislative staff<\/a> for yourself, and they identify a legal problem: California is one of many states that already banned \u201cconversion therapy\u201d a long time ago, but the recent Supreme Court decision in <em>Chiles v. Salazar <\/em>puts that ban at risk. In an <a href=\"https:\/\/www.oyez.org\/cases\/2025\/24-539\" target=\"_blank\" rel=\"noreferrer noopener\">8-1 decision<\/a> with only an idiot dissenting, the court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-539_fd9g.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">concluded<\/a> that Colorado\u2019s ban on <a href=\"https:\/\/amzn.to\/3YuVZYV\" >conversion therapy \u201cregulates speech based<\/a> on viewpoint, and the lower courts erred by failing to apply sufficiently rigorous First Amendment scrutiny.\u201d You can\u2019t tell a therapist that they aren\u2019t allowed to <em>say<\/em> a child wasn\u2019t born in the wrong body, because they have a right to say what they think.<\/p>\n<p>Amending the bill to anticipate legal challenges, the California legislature now proposes to ban \u201cany practices of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/us-open-to-offer-quiet-rooms-in-holistic-approach-to-mental-health\/\" title=\"US Open To Offer \u2018Quiet Rooms... In \u2018Holistic Approach... To Mental Health\">licensed mental health provider<\/a> that seek to direct a patient toward a predetermined sexual orientation or gender identity.\u201d Adopting a supposedly content-neutral posture, the bill in its current form appears to propose that therapists can also be sued for trying to talk children into <em>becoming<\/em> transgender or gay.<\/p>\n<p>It\u2019s not clear what the bill will look like in its final form, and activists are calling for answers before the legislature wraps up its work and sends it to the governor for a signature. Erin Friday, who leads the parents\u2019 group <a href=\"https:\/\/ourduty.group\/about\/our_duty\/\" target=\"_blank\" rel=\"noreferrer noopener\">Our Duty<\/a>, told The Federalist that Wiener \u201cmust clarify whether mental providers who steer a patient toward a transgender identity face the same malpractice liability as those who just affirm a transgender identity.\u201d Friday discussed the bill in detail in a long thread on X:<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">PERPETUAL STATUTE OF LIMITATIONS \u2013 SB 934 creates a perpetual statute of limitations. It purports to have limits of 22 years after a minor turns 18 and 10 years for an adult, but the clock does not start until the client discovers that the mental health symptom could have been\u2026<\/p>\n<p>\u2014 Erin Friday, Esq. (@ErinFriday75490) <a href=\"https:\/\/x.com\/ErinFriday75490\/status\/2065455673710932141?ref_src=twsrc%5Etfw\">June 12, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Many other features of the bill demand a close look from therapists and medical practitioners, including the standard of evidence Wiener proposes to establish in \u201cconversion therapy\u201d lawsuits. <\/p>\n<p>As the most recent legislative analysis says, \u201cthe bill specifies that a plaintiff may establish general causation by using expert testimony, scientific literature, or other evidence demonstrating that sexual orientation or gender identity change efforts are capable of causing the type of psychological injury or illness suffered by a plaintiff.
