This rise is largely driven by illegal immigrants in U.S. detention filing habeas corpus petitions in federal court, challenging their detention, especially when arrests are based on administrative warrants. Many of these cases result in courts ordering detainees\u2019 release or bond hearings, as judges find indefinite detention without judicial warrants unconstitutional.the Western District of Texas has seen the highest number of habeas cases, and experts predict that legal disputes over detention policies may eventually reach the Supreme Court. Last September, <a href=\"https:\/\/amzn.to\/3YuVZYV\" >immigration attorneys began increasingly filing suits<\/a> as the number of illegal immigrants being arrested by federal immigration authorities surged to record highs.<\/p>\n<div class=\"wex-ad-wrap\" style=\"min-height:5px;\"><span class=\"wex-ad-label\" style=\"display:none;\">Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-15\" data-wex-ad=\"art-dsk-inart-1\"><\/div>\n<\/div>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">More than 41,000 lawsuits were filed in the 12 months leading up to March 2026, according to\u00a0the Transactional Records Access Clearinghouse at New York\u2019s Syracuse University, a nonpartisan data research center that analyzes federal immigration statistical information.<\/p>\n<p class=\"wp-block-paragraph\">In March alone, 9,911 new lawsuits were filed in federal court and showed no sign of reversing course. In effect, habeas corpus defendants claim that their detention is illegal.<\/p>\n<p class=\"wp-block-paragraph\">Detainees have a constitutional right to file a habeas suit, and because some ICE arrests are based on administrative warrants, not judicial warrants, immigration attorneys have had success challenging the grounds for detention in many cases.<\/p>\n<p class=\"wp-block-paragraph\">Although immigration courts are intended to decide immigration cases, habeas cases are being filed in federal court, where more sympathetic judges are often ruling that the federal government cannot detain people indefinitely without a judicial warrant.<\/p>\n<div class=\"wex-ad-wrap\" style=\"min-height:5px;\"><span class=\"wex-ad-label\" style=\"display:none;\">Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">In March 2025, 105 of the total 945 immigration civil cases filed in federal court were habeas cases. In March this year, more than 9,000 of the 9,911 cases filed that month were habeas cases.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHabeas lawsuits increased by over 85 times during the past year, while naturalization suits were 1.8 times higher than in March 2025,\u201d TRAC concluded.<\/p>\n<p class=\"wp-block-paragraph\">In <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/minnesota\/\" type=\"post_tag\" id=\"443\">Minnesota<\/a>, groups such as the American Immigration Council or the American Immigration Lawyers Association file a habeas petition to a federal judge, who more often than not grants temporary release to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mn-prosecutor-seeks-immediate-relief-amid-influx-of-425-immigration-lawsuits\/\" title=\"MN prosecutor seeks &#039;immediate&#039; relief amid influx of 425 ... lawsuits\">detained immigration enforcement target<\/a>. <\/p>\n<p>More than 300 district judges in Minnesota and elsewhere had <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/4449437\/dhs-activist-judges-grant-illegal-immigrants-freedom\/\">rejected<\/a> the government\u2019s mandatory detention policies, ordering detainees released or granted bond hearings as of earlier this spring. That has fueled a surge of copycat filings nationwide.
