target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/glad-org-wpom.nyc3.cdn.digitaloceanspaces.com\/wp-content\/uploads\/2026\/05\/20260608_Doe-v-Blanche_PI-Order.pdf\">a preliminary injunction<\/a> that temporarily prevents the Federal Bureau of Prisons from moving them to male-designated penitentiaries in accordance with President Donald Trump\u2019s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\">directive<\/a> to separate federal prisons by biological sex.<\/p>\n<p class=\"wp-block-paragraph\">The transgender litigants in <em>Jane Doe v. Blanche<\/em> were given temporary relief by Lamberth before, when they initially challenged their impending transfers in January 2025, but an appeals court later vacated those protections.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4536916\/court-lifts-block-housing-inmates-biological-sex\/\"><strong>COURT LIFTS BLOCK ON HOUSING INMATES BY BIOLOGICAL SEX, PAVING WAY FOR REMOVAL OF MEN FROM WOMEN\u2019S PRISONS<\/strong><\/a><\/p>\n<div class=\"wex-ad-wrap\" style=\"min-height:5px;\"><span class=\"wex-ad-label\" style=\"display:none;\">Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">However, the appellate panel left open the possibility for the lower court to block the enforcement of BOP\u2019s placement policy again, determining at the time that Lamberth simply did not weigh how each plaintiff would individually be harmed by biologically accurate housing assignments.<\/p>\n<p class=\"wp-block-paragraph\">In May, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.gladlaw.org\/cases\/doe-v-blanche\/\">GLAD Law<\/a> and the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.nclrights.org\/about-us\/press-release\/federal-court-stops-trump-policy-that-deliberately-exposes-transgender-women-in-prison-to-extreme-risk-of-sexual-assault\/\">National Center for LGBTQ Rights<\/a> filed a new motion for continued protection on behalf of the 14 transgender complainants, this time asking Lamberth to particularize his findings. Lamberth did so over the weekend, granting the renewed relief request on Sunday and keeping the male prisoners where they are pending further litigation.<\/p>\n<h2 id=\"h-female-inmates-on-the-offensive-after-winning-protective-order\" class=\"wp-block-heading\">Female inmates on the offensive after winning protective order<\/h2>\n<p class=\"wp-block-paragraph\">Lamberth\u2019s ruling comes as female inmates from a separate but related lawsuit, in which they recently won a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.199.0.pdf\">separation order<\/a> against the biological men imprisoned alongside them at a Texas women\u2019s prison, move to intervene in the <em>Doe <\/em>case out of Washington, D.C.<\/p>\n<div class=\"wex-ad-wrap\" style=\"min-height:5px;\"><span class=\"wex-ad-label\" style=\"display:none;\">Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Four female prisoners at Federal Medical Center-Carswell, a specialized women\u2019s prison in Fort Worth, are seeking to be added as defendants to the Washington, D.C., case, arguing the federal government is not adequately representing the interests of incarcerated women.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIn this case, the Government has defended institutional discretion and Executive Branch policy,\u201d said the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.141.1.pdf\">intervention filing<\/a>, submitted Friday. \u201cBut it has not developed the women\u2019s constitutional theory, has not submitted declarations from any incarcerated women, and has not squarely argued that forcing women to share showers, toilets, changing areas, housing units, and common areas with biological males violates women\u2019s bodily privacy and Eighth Amendment rights.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In the women\u2019s own civil rights case, <em>Fleming v. Warden T. Rule<\/em>, the court recognized that confining female inmates with biological men violates the women\u2019s Eighth Amendment protections from cruel and unusual punishment, as well as their rights to bodily safety and privacy under the Fifth Amendment.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4356741\/female-inmates-allege-sexual-abuse-transgender-separation-case\/\"><strong>MORE FEMALE INMATES ALLEGE SEXUAL ABUSE IN TRANSGENDER SEPARATION CASE<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">Judge Sidney Fitzwater, also a Reagan appointee, granted the <em>Fleming<\/em> plaintiffs a first-of-its-kind protective order that sequesters the men at FMC Carswell away from the entire female prison population.<\/p>\n<p class=\"wp-block-paragraph\">The landmark victory, handed down on June 2, protects women facilitywide for the first time since female prisoners started opposing the Obama-era transgender accommodations.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIntervention will allow women themselves to be heard,\u201d John Greil, one of the attorneys for the <em>Fleming<\/em> plaintiffs, told the <em>Washington Examiner<\/em>.<\/p>\n<p class=\"wp-block-paragraph\">Greil said Lamberth granted the earlier injunction, in part, because government counsel failed to enter any evidence into the court record as to how the biologically male inmates harm women in prison.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe defendants have not so much as alleged that the plaintiffs in this particular suit present any threat to the female inmates housed with them, or that this threat cannot be managed locally by prison staff,\u201d Lamberth <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.23.0_2.pdf\">previously<\/a> ruled.<\/p>\n<p class=\"wp-block-paragraph\">The <em>Fleming<\/em> plaintiffs <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.141.4.pdf\">say<\/a> Lamberth\u2019s prior preliminary injunction rested heavily on the absence of articulated harms to the female inmates, which they say the federal government lawyers should have provided.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIn Texas and in D.C., government lawyers have refused to give voice to the women who suffer when biological males are placed in women\u2019s prisons,\u201d Greil said.<\/p>\n<p class=\"wp-block-paragraph\">Government attorneys in <em>Fleming<\/em>, led by assistant U.S. attorney Brian Stoltz, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.147.0.pdf\">attempted to dismiss<\/a> the women\u2019s complaint, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.166.0.pdf\">opposed<\/a> the preliminary injunction, and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.198.0.pdf\">noted their objection<\/a> when injunctive relief was issued.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4452277\/trump-administration-treading-carefully-transgender-prison-housing\/\"><strong>TRUMP ADMINISTRATION TREADING CAREFULLY IN TRANSGENDER PRISON HOUSING CASES<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">Rhonda Fleming, lead plaintiff in the Texas case, told the <em>Washington Examiner<\/em> that Stoltz complained at a hearing last month that the separation arrangement would create a miniature \u201cmen\u2019s prison\u201d at FMC Carswell in violation of Lamberth\u2019s restraint.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIf they all claim to be women, what is the big deal with them being in one area?\u201d Fleming questioned. \u201cThese men want access to women, but not each other.\u201d<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><figcaption class=\"wp-element-caption\">Rafael Mercado Berrios was one of the biological men housed at FMC Carswell. Rule)<\/figcaption><\/figure>\n<\/p><\/div>\n<p class=\"wp-block-paragraph\">Meanwhile, the <em>Fleming<\/em> co-plaintiffs <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.153.0.pdf\">documented<\/a> specific incidents of sexual abuse and predatory behavior by the men at FMC Carswell, including detailed testimony from the women describing a pattern of stalking in the shower areas, voyeurism, sexual propositions, and threatening conduct. Many of the men are fully intact, while several were <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.400241\/gov.uscourts.txnd.400241.107.1.pdf\">convicted of violent sex crimes<\/a> against women and children.<\/p>\n<p class=\"wp-block-paragraph\">The two cases, though filed in different jurisdictions, are directly tied. According to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.133.0_1.pdf\">a government notice<\/a>, four of the men housed at FMC Carswell \u2014 and therefore subject to the <em>Fleming<\/em> injunction \u2014 are also anonymous plaintiffs in the <em>Doe<\/em> case.<\/p>\n<p class=\"wp-block-paragraph\">Lamberth <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.149.0.pdf\">instructed<\/a> current parties, the <em>Doe<\/em> plaintiffs and government attorneys, to convene and propose a briefing timeline by June 17 for responses regarding whether the women\u2019s motion to intervene should be allowed.<\/p>\n<h2 id=\"h-the-two-cases-could-collide-despite-judicial-comity\" class=\"wp-block-heading\">The two cases could collide despite judicial comity<\/h2>\n<p class=\"wp-block-paragraph\">Some legal observers suspect <em>Fleming <\/em>and <em>Doe<\/em> are on a collision course, despite the two Reagan-nominated judges intentionally structuring their orders so that they do not contravene each other.<\/p>\n<p class=\"wp-block-paragraph\">Fitzwater\u2019s order only moved the men to a segregated unit within FMC Carswell, rather than transfer them out of the facility altogether, as the women ultimately want.<\/p>\n<p class=\"wp-block-paragraph\">Lamberth, in his decision, specified that the latest <em>Doe<\/em> injunction \u201cmerely enjoins\u201d the government from sending the male plaintiffs to men\u2019s prisons. It does not, Lamberth <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/glad-org-wpom.nyc3.cdn.digitaloceanspaces.com\/wp-content\/uploads\/2026\/05\/20260608_Doe-v-Blanche_PI-Memo.pdf\">stated<\/a> explicitly, require that the men share living quarters with the female inmates.<\/p>\n<p class=\"wp-block-paragraph\">\u201cJudge Lamberth carefully avoided directly contradicting Judge Fitzwater,\u201d explained Elspeth Cypher, board president of the Women\u2019s Liberation Front, a women\u2019s advocacy organization.<\/p>\n<p class=\"wp-block-paragraph\">Fleming said Fitzwater\u2019s injunction essentially nullifies Lamberth\u2019s by establishing a wing of the prison that completely closes off the men at FMC Carswell and simultaneously remedies the men\u2019s fear of sexual violence claims. The men\u2019s main argument centers on them facing the threat of rape, as \u201ctransgender women,\u201d if they were relocated to men\u2019s prisons.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIt is like Judge Lambreth\u2019s order does not exist,\u201d Fleming said. \u201cAnd the men cannot complain that they are in danger.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Lawyers for the <em>Fleming<\/em> plaintiffs argued ahead of Lamberth\u2019s ruling that the men\u2019s requested relief would undermine what the women already achieved in the Texas court: recognition that the female inmates are likely to succeed on the merits of their constitutional injury claims.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIntervention is therefore necessary not only to protect their constitutional interests, but also to prevent this case from impairing relief already entered to protect those interests,\u201d the women\u2019s legal team wrote.<\/p>\n<p class=\"wp-block-paragraph\">Cypher, a retired Massachusetts Supreme Court justice, said both cases will likely proceed to appeal and eventually end up with <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.law.cornell.edu\/wex\/circuit_split\">a circuit split<\/a>, in which separate appellate courts reach different conclusions on the same issue.<\/p>\n<p class=\"wp-block-paragraph\">Such conflicting opinions over sex-segregated prisons could then draw in the Supreme Court to settle the disagreement.<\/p>\n<\/div>\n<\/article>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge has blocked the Trump administration from transferring more than a dozen transgender inmates, all biological males currently housed in women\u2019s prisons across the country, back to men\u2019s correctional facilities.
