The $70 billion measure would fund Border Patrol and Immigration and Customs Enforcement, which were left out of an earlier Homeland Security funding bill.  <\/p>\n<p>Senate approval came Friday, with one GOP defection (Sen. Lisa Murkowski) during a debate that largely focused on President Donald Trump\u2019s \u201canti-weaponization fund,\u201d funded via a DOJ settlement. The Senate bill did **not** include a ban on that fund, despite GOP concerns and debates over whether it should be blocked.  <\/p>\n<p>Johnson can afford to lose only two GOP votes. Key uncertainties include Rep. Thomas Massie and Rep. Brian Fitzpatrick, along with perhaps other members who are undecided or leaning against the bill (including Rep.Kevin kiley). Fitzpatrick is expected to push for a discharge petition to stop taxpayer funds from being used for DOJ claims tied to the anti-weaponization fund. Some Republicans say the issue is effectively \u201cdead\u201d due to a court ruling, while House GOP criticism has grown around the fund.<\/p>\n<p>Democrats are expected to oppose as well, with Hakeem Jeffries calling it a \u201chard no\u201d and arguing it would provide ICE more money without meaningful bipartisan constraints. Johnson also faces possible GOP attendance problems due to elections Tuesday night and the prolonged absence of Rep. Lisa Murkowski (R-AK), after an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/seven-republicans-vote-against-fisa-extension-after-bipartisan-plan-blows-up\/\" title=\"Seven ...ublicans vote against FISA extension after bipartisan plan blows up\">hourslong vote-a-rama<\/a> that became a referendum on President Donald Trump\u2019s $1.776 billion \u201canti-weaponization fund.\u201d\u00a0The Senate\u2019s bill ultimately did not include a ban on the DOJ\u2019s fund, born out of a settlement with the president over the leak of his tax returns, despite Republican reservations concerning the fund.<\/p>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">Johnson will only be able to lose two GOP votes, assuming all members are voting and present. During the party\u2019s first <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joe-bidens-not-done-increasing-inflation-with-debt-fueled-federal-spending\/\" title=\"Joe Biden\u2019s Not Done Increasing Inflation With Debt-Fueled Federal Spending\">party-line reconciliation bill<\/a>, Reps. Brian Fitzpatrick (R-PA) and Thomas Massie (R-KY) voted against the massive tax and spending bill.<\/p>\n<p class=\"wp-block-paragraph\">Massie told reporters Monday he was \u201cstill trying to compare apples to apples,\u201d but that his support would likely hinge on whether GOP leadership attaches anything to the legislation or increases the spending allotment.<\/p>\n<p>Fitzpatrick will be something of a wild card on Tuesday, as he has repeatedly broken with his party on high-profile issues, most recently voting to send aid to Ukraine and expressing vocal opposition to the anti-weaponization fund.<\/p>\n<p class=\"wp-block-paragraph\">The Pennsylvania Republican is expected to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/fitzpatrick.house.gov\/2026\/5\/fitzpatrick-suozzi-introduce-bipartisan-bill-to-stop-taxpayer-dollars-from-funding-doj-s-anti-weaponization-fund\" type=\"link\" id=\"https:\/\/fitzpatrick.house.gov\/2026\/5\/fitzpatrick-suozzi-introduce-bipartisan-bill-to-stop-taxpayer-dollars-from-funding-doj-s-anti-weaponization-fund\">launch a discharge petition<\/a> this week alongside Rep. Tom Suozzi (D-NY) to prohibit the use of taxpayer funds to pay any claims submitted to the Department of Justice for the anti-weaponization fund. Fitzpatrick\u2019s office did not return requests for comment.<\/p>\n<p class=\"wp-block-paragraph\">GOP outcry over the anti-weaponization fund escalated after the DOJ announced the settlement, culminating in acting Attorney General Todd Blanche telling House lawmakers the administration was \u201cnot moving forward with the fund\u201d after a court ruling against it.<\/p>\n<p class=\"wp-block-paragraph\">Rep. Don Bacon (R-NE), who previously expressed opposition to the fund\u2019s creation, told the <em>Washington Examiner<\/em> he planned to support the reconciliation bill despite it not including a ban on the fund, as the court\u2019s ruling made it a \u201cdead issue.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Outside of Massie and Fitzpatrick, Johnson will have to get other members of his party on board as well, with another House Republican telling the <em>Washington Examiner<\/em> they were also undecided and Rep. Kevin Kiley (I-CA) confirming he was leaning no.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI said from the beginning that I wouldn\u2019t even consider this unless we had some meaningful bipartisan reforms to interior immigration enforcement, and we haven\u2019t seen that yet,\u201d Kiley said. <\/p>\n<p class=\"wp-block-paragraph\">\u201cI think that we need to restore trust and public confidence, and make sure that the mission of the agency is focused, and so I\u2019m disappointed that we haven\u2019t seen a bipartisan agreement along those lines,\u201d Kiley added.<\/p>\n<p class=\"wp-block-paragraph\">The speaker will also have to contend with possible House GOP absences, with <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.nbcnews.com\/politics\/2026-primary-elections\/calendar\" type=\"link\" id=\"https:\/\/www.nbcnews.com\/politics\/2026-primary-elections\/calendar\">several primary elections<\/a> set for Tuesday night and Rep. Tom Kean Jr. (R-NJ) recovering from an undisclosed health problem that has kept him away from Capitol Hill for over three months.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/defense\/4595655\/iran-nuclear-negotiations-desperate-trump-strait-hormuz\/\">WHO IS MORE DESPERATE FOR A DEAL: TRUMP OR IRAN?<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">Johnson will not be able to rely on Democratic votes either.
