In a Monday order, the Court quickly vacated the D.C. Circuit\u2019s November 2025 ruling-sending the case back to the D.C.circuit-after noting legal problems the Trump management says exist in the earlier rules.<\/p>\n<p>The D.C. Circuit had previously upheld the regulations in a 2-1 decision, reasoning that Congress gave the Department of Energy broad authority under the Energy policy and Conservation Act.Although the Biden administration defended the rules during arguments in November 2024, the Supreme Court\u2019s action now allows the Trump administration to press its alternative position and potentially revisit the regulations. The Trump administration indicated it intends to pursue a new rulemaking to correct alleged factually and legally flawed aspects of the Biden-era framework, and the case could also be paused while that happens.<\/p>\n<p>A coalition of energy companies, including the American Gas Association, had petitioned the Supreme Court to challenge the D.C. Circuit\u2019s ruling, arguing that the Department of Energy exceeded its power-citing the 2024 decision *Loper Luminous enterprises v. Raimondo*-and warning the rules could force widespread changes for households and businesses using gas appliances. Circuit<\/a> after quickly vacating the appeals court\u2019s November 2025 ruling. The case was argued in November 2024, with the Biden administration defending the rules, but a ruling was not issued until November 2025. Overturns Bill Cosby Sex Assault Conviction, Actor To Leave Prison\">lower appeals court<\/a>.<\/p>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">A coalition of energy companies, led by the American Gas Association, filed a petition to the Supreme Court earlier this year, arguing the justices should reverse the D.C. Circuit\u2019s ruling as a violation of the standard set in the 2024 ruling <em>Loper Bright Enterprises v. Raimondo<\/em>, which limited federal agencies\u2019 rulemaking ability, by arguing the Biden Department of Energy overreached with the gas appliance regulations. The petition also warned that Biden-era rules at the center of the lawsuit would \u201cforce millions of Americans with gas appliances to either renovate their homes or switch to electric appliances.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In its response to the petition, the Trump administration said it wanted the high court to quickly toss the D.C. Circuit\u2019s ruling and send it back to the appeals court \u201cbecause the government agrees that the rules at issue rest on a legal error.\u201d <\/p>\n<p class=\"wp-block-paragraph\">The brief from Solicitor General D. John Sauer said that the Department of Energy under President Donald Trump \u201chas determined that the rules at issue are factually and legally flawed, and the agency is considering a new rulemaking in which it would correct those errors.\u201d Sauer suggested that sending the case back to the appeals court could also allow it to essentially pause the case while it considers a new gas appliance rule.<\/p>\n<p class=\"wp-block-paragraph\">The coalition of energy companies said they did not oppose the Trump administration\u2019s request to toss the ruling and return to the appeals court, saying such a decision should happen \u201cat minimum,\u201d in a reply brief. The Supreme Court did just that with its Monday order, allowing the legal war over the regulations to continue back in the D.C. Circuit. <\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4562772\/major-supreme-court-decisions-remainder-term\/\">THE MAJOR SUPREME COURT DECISIONS REMAINING FOR THIS TERM<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">In Monday\u2019s orders list, the justices did not add any cases to the list of cases they have decided to hear in their upcoming term, which will begin in October. The Supreme Court has already announced 11 cases it will hear in the next term, but will likely add dozens more cases over the coming months.<\/p>\n<p class=\"wp-block-paragraph\">For the current Supreme Court term, which is set to conclude in the coming weeks, the high court is next scheduled to issue opinions in pending cases it heard earlier this term on Thursday.
