The article claims this reflects a broader pattern of immigrant drivers-legal or illegal-obtaining CDLs too easily and then causing deadly incidents, citing DOT data about fatal crashes involving non-domiciled truckers.<\/p>\n<p>It further questions how a person who cannot meet an English requirement was naturalized in the first place, arguing there should be no age exception. The piece connects trucking to wider Supreme Court and federal-policy debates, describing a case (Montgomery v. Caribe Transport II) where brokers can face liability for hiring unsafe carriers, and another (Florida v. California) where the court dismissed Florida\u2019s challenge without a substantive opinion. The author highlights dissenting views suggesting states should be able to sue other states that allegedly violate federal CDL-related requirements.<\/p>\n<p>The article credits the Trump administration with steps aimed at tightening enforcement-such as executive orders, new DOT\/Federal motor Carrier Safety Administration rules, audits of state compliance, and potential consequences like <a href=\"https:\/\/amzn.to\/3YuVZYV\" >withholding <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/public-transit-funding-still-on-shapiros-mind-washington-examiner\/\" title=\"Public transit funding still on Shapiro\u2019s mind - Washington Examiner\">federal highway funds<\/a><\/a>. It also claims USCIS has tightened naturalization testing, resulting in fewer naturalizations. Concluding, it argues trucking should be treated as a major front in immigration reform, calls for legal and regulatory changes so only eligible people receive CDLs, and urges criminal or civil accountability for officials involved in fraudulent or negligent licensing decisions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A\u00a0sickening recent crash of a motorcoach bus in Stafford County, Virginia,\u00a0resulted\u00a0in the death of five people, and if the United States had sane immigration laws, it never would have happened.\u00a0The driver, <a href=\"https:\/\/x.com\/BillMelugin_\/status\/2061537482689183890\" target=\"_blank\" rel=\"noreferrer noopener\">Jing Shen Dong<\/a>, was a\u00a0Chinese man\u00a0who was\u00a0naturalized as an American citizen\u00a0yet could not speak English.\u00a0The Democrat-controlled state of New York issued his commercial driver\u2019s\u00a0license\u00a0(CDL) in 2024.\u00a0This is just the most recent instance of an <a href=\"https:\/\/www.dhs.gov\/news\/2026\/02\/25\/secretary-noem-backs-dalilah-law-bar-states-granting-commercial-drivers-licenses\" target=\"_blank\" rel=\"noreferrer noopener\">ongoing phenomenon<\/a> \u2014\u00a0immigrant drivers or truckers getting CDLs with\u00a0little\u00a0scrutiny and going on to cause deaths on U.S.\u00a0highways. <a href=\"https:\/\/www.foxnews.com\/us\/dot-closes-major-commercial-trucking-loophole-blamed-illegal-immigrants-causing-fatal-crashes\" target=\"_blank\" rel=\"noreferrer noopener\">According to the Department of Transportation<\/a> (DOT), non-domiciled truckers killed at least 30 people in 2025 in 17 fatal crashes.  <\/p>\n<p>It is horrifying that Americans\u00a0have to\u00a0worry about whether their families may be killed\u00a0on the interstate\u00a0by\u00a0a\u00a0foreign\u00a0trucker\u00a0who was issued a CDL with insufficient scrutiny by\u00a0a\u00a0corrupt or incompetent state government.\u00a0Not to mention,\u00a0issuing CDLs to illegal aliens is against federal law.  <\/p>\n<p>The\u00a0motorcoach crash in Virginia\u00a0highlights the problem not just with illegal immigration, but with\u00a0legal\u00a0immigration and the\u00a0naturalization process.\u00a0How was such a man lawfully naturalized as a U.S. citizen when he could not speak English?\u00a0United\u00a0States law requires those under the age of 50 to speak\u00a0English to be naturalized as a citizen, and that ought to be the bare minimum\u00a0for everyone, with no age exception.  <\/p>\n<p>Stopping and reversing the illegal migration of millions of people into America is the most urgent demand of the day,\u00a0but scrutinizing, reducing, and reversing even\u00a0legal\u00a0migration is\u00a0almost as\u00a0important.\u00a0It is encouraging that President Trump has been using regulatory hurdles and discretion to <a href=\"https:\/\/x.com\/derzum_\/status\/2044159747042013313\" target=\"_blank\" rel=\"noreferrer noopener\">reduce legal immigration<\/a> into the\u00a0United\u00a0States.\u00a0For decades,\u00a0leftists\u2014\u00a0and even\u00a0many conservatives\u00a0\u2014\u00a0have told us\u00a0that legal immigration is about the\u00a0\u201cbest\u00a0and brightest\u201d\u00a0coming to America, the land of opportunity. Yet the reality looks much more like Americans ending up dead in part because our government has\u00a0\u201cnaturalized\u201d\u00a0people who never should have been eligible for citizenship.  <\/p>\n<p>  Trucking as a key front of the immigration battle has even reached the Supreme\u00a0Court in several recent decisions,\u00a0although the results have been mixed.\u00a0In <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-1238_1b7d.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Montgomery v. Caribe Transport II, LLC<\/em><\/a>,\u00a0as recently reported by Danielle Chaffin <a href=\"https:\/\/thefederalist.com\/2026\/05\/25\/scotus-case-makes-freight-brokers-responsible-for-crashes-caused-by-commercial-immigrant-drivers\/\" target=\"_blank\" rel=\"noreferrer noopener\">in these pages<\/a>, the\u00a0<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/conservative-groups-rejoice-over-substantial-win-for-religious-freedom-in-supreme-court-ruling-on-catholic-adoption\/\" title=\"Conservative Groups Rejoice Over \u2018Substantial Win For Religious Freedom\u2019 In Supreme ... Ruling On Catholic Adoption\">court\u00a0unanimously ruled<\/a> that freight brokers can be held legally responsible\u00a0if\u00a0they hire truckers from companies with a record of unsafe drivers. This\u00a0means\u00a0freight brokers are legally incentivized to perform greater scrutiny when hiring trucking companies and not\u00a0cut\u00a0corners to save costs.\u00a0Any step that\u00a0increases\u00a0scrutiny\u00a0for\u00a0hiring truckers is a good one at this point, and freight brokers should\u00a0be\u00a0required\u00a0to perform their due diligence \u2014 especially if that means the difference between\u00a0life and death\u00a0for unsuspecting victims on the interstate.<\/p>\n<p>The other recent Supreme Court ruling on trucking\u00a0\u2014 <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/162orig_8n6a.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Florida v. California<\/em><\/a><em> <\/em>\u2014\u00a0proved\u00a0disappointing.\u00a0The state of Florida sued California and Washington for those blue states\u2019\u00a0lax issuance of CDLs to illegal alien truckers, resulting in\u00a0the\u00a0deaths of Florida residents on the interstate, such as the crash caused by <a href=\"https:\/\/x.com\/captive_dreamer\/status\/1956901210860212431\" target=\"_blank\" rel=\"noreferrer noopener\">Harjinder Singh<\/a> on August 12, 2025.\u00a0The Supreme Court issued no\u00a0opinion but\u00a0released an order dismissing the case.  <\/p>\n<p>Notably, Justices\u00a0Clarence\u00a0Thomas and\u00a0Samuel\u00a0Alito dissented, indicating\u00a0they wanted to hear the case.\u00a0As Justice Thomas wrote:\u00a0\u201cAn illegal alien who cannot read English road signs cannot drive an 80,000-pound tractor-trailer. Federal law and regulations prohibit States from providing commercial driver\u2019s licenses to applicants unless they pass a driver\u2019s test, sufficiently understand the English language, and show\u00a0appropriate immigration\u00a0status.\u201d\u00a0Thus, Florida had legitimate grievance to sue California and Washington over these states\u2019\u00a0failure\u00a0to\u00a0comply with\u00a0federal\u00a0laws.  <\/p>\n<p>Thomas expressed frustration that SCOTUS\u00a0\u201cdeclines to even hear Florida\u2019s claims, even though it has nowhere else to bring them.\u201d\u00a0As Thomas argued, a suit between states is one of the few kinds of cases over which the Supreme Court possesses\u00a0original\u00a0(as opposed to\u00a0appellate) jurisdiction, and Thomas doubted whether\u00a0\u201cthis Court has discretion to refuse to hear cases within its exclusive original jurisdiction.\u201d  <\/p>\n<p>State\u00a0governments ought to protect their citizens, and if Florida cannot sue other states whose negligence or corruption is wreaking havoc in Florida, then what legal recourse do states like Florida have?\u00a0Must responsible states\u00a0be doomed to reap the consequences of other states\u2019\u00a0negligence,\u00a0even when it results in deaths on\u00a0their\u00a0highways?   <\/p>\n<p>Even as SCOTUS gives ambiguous signals, the Trump administration has relentlessly been moving on this issue.\u00a0On April 28, 2025, President Trump issued <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/enforcing-commonsense-rules-of-the-road-for-americas-truck-drivers\/\" target=\"_blank\" rel=\"noreferrer noopener\">an executive order<\/a> in which he instructed the Department of Transportation\u00a0and\u00a0Federal Motor Carrier Safety Administration (FMCSA) to enforce the English-proficiency requirement for truckers and investigate and curtail the issuance of CDLs to non-domiciled aliens.\u00a0Under Secretary Sean Duffy, DOT has rolled out several <a href=\"https:\/\/www.transportation.gov\/briefing-room\/trumps-transportation-secretary-sean-p-duffy-puts-safety-first-finalizes-rule-stop\" target=\"_blank\" rel=\"noreferrer noopener\">new regulations<\/a> to close loopholes and mandate that states verify eligibility of foreign drivers.  <\/p>\n<p>Further, the DOT has begun to audit systematic non-compliance in multiple states, including New York, California, Pennsylvania, North Carolina, Minnesota, and Colorado.\u00a0State non-compliance\u00a0can result in <a href=\"https:\/\/www.transportation.gov\/briefing-room\/trumps-transportation-secretary-sean-p-duffy-takes-emergency-action-protect-americas\" target=\"_blank\" rel=\"noreferrer noopener\">withholding of federal highway funds<\/a>.\u00a0It should\u00a0not be controversial\u00a0that every step possible should be taken to put legal pressure on the state governments to force their compliance with these\u00a0commonsense\u00a0regulations.  <\/p>\n<p>Also, under President Trump, U.S. Citizenship and Immigration Services\u00a0has <a href=\"https:\/\/www.uscis.gov\/newsroom\/news-releases\/uscis-unveils-first-changes-to-naturalization-test-in-multi-step-overhaul-of-american-citizenship\" target=\"_blank\" rel=\"noreferrer noopener\">overhauled and tightened the requirements for naturalization<\/a>, such as more rigorously scrutinizing the character and English language competency of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/potential-us-citizens-must-be-screened-for-moral-character\/\" title=\"Potential US ...s Must Be Screened For &#039;Moral Character&#039;\">immigrants seeking naturalization<\/a>.\u00a0Significantly, this has resulted in\u00a0a <a href=\"https:\/\/x.com\/AF_Insight\/status\/2044130585556201919\" target=\"_blank\" rel=\"noreferrer noopener\">drop in naturalizations<\/a> over recent months.  <\/p>\n<p>Trucking is a key front of the immigration battle since it\u00a0intimately touches the lives of most Americans.\u00a0All Americans are at risk\u00a0if\u00a0\u00a0unsafe\u00a0truckers and bus drivers are\u00a0permitted\u00a0on the highways, and the death toll is already far too high.\u00a0Ultimately, the\u00a0goal should be <a href=\"https:\/\/x.com\/SamuelMKimzey\/status\/2027370069706101156\" target=\"_blank\" rel=\"noreferrer noopener\">legal and regulatory reform<\/a>.  <\/p>\n<p>Only\u00a0native-born or fully naturalized U.S. citizens\u00a0should be\u00a0permitted\u00a0to obtain CDLs. Since justice requires we <a href=\"https:\/\/x.com\/SamuelMKimzey\/status\/2003469619479146522\" target=\"_blank\" rel=\"noreferrer noopener\">prosecute<\/a> those responsible as severely as possible, <a href=\"https:\/\/www.ice.gov\/news\/releases\/ex-dmv-employee-14-others-charged-drivers-license-fraud-scheme\" target=\"_blank\" rel=\"noreferrer noopener\">criminal or civil cases\u00a0should be\u00a0brought<\/a> against state officials for their complicity in these actions that have resulted in deaths of Americans on the highways.<\/p>\n<p>The reforms\u00a0that\u00a0President Trump,\u00a0Duffy, and the rest of the administration\u00a0have\u00a0undertaken\u00a0are long overdue and urgently needed.\u00a0If we are to save America and curb the problems of legal and illegal immigration, we cannot neglect our highways. <\/p>\n<hr>\n<p>      Samuel Kimzey is a doctoral student at Hillsdale College and a 2025 Publius Fellow at the Claremont Institute.
