Wes Moore signed the <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/sb0323?ys=2026RS\" target=\"_blank\" rel=\"noopener noreferrer\">Youth Charging Reform Act<\/a> on Tuesday, greatly expanding the crimes to be handled by juvenile court rather than the harsher adult justice system. Maryland has grappled with youth incarceration rates well above national averages for years, including <a href=\"https:\/\/wjla.com\/news\/local\/youth-crime-carjackings-overall-crime-prince-georges-county-police-pgpd-malik-aziz-crime-stats-end-of-the-year-homocide-adults-juveniles-weapons-fire-arms\" target=\"_blank\" rel=\"noopener noreferrer\">particularly harsh spikes<\/a> in highly populated areas <a href=\"https:\/\/www.stattorney.org\/media-center\/in-the-news\/3016-juvenile-crime-arrests-in-baltimore-city-up-146-compared-to-2023-state-s-attorney-says\" target=\"_blank\" rel=\"noopener noreferrer\">such as Baltimore<\/a>, according to <a href=\"https:\/\/djs.maryland.gov\/media\/508\" target=\"_blank\" rel=\"noopener noreferrer\">multiple<\/a> <a href=\"https:\/\/www.wypr.org\/wypr-news\/2025-12-01\/maryland-officials-split-on-ending-automatically-charging-youths-as-adults\" target=\"_blank\" rel=\"noopener noreferrer\">reports<\/a> and government data.<\/p>\n<p>Moore\u2019s office did not respond to the Daily Caller News Foundation\u2019s request for comment.<\/p>\n<p>Maryland\u2019s juvenile courts will now have jurisdiction over child defendants between 14 and 16 who are\u00a0charged with offenses that result in life sentences under the <a href=\"https:\/\/legiscan.com\/MD\/votes\/HB409\/2026\" target=\"_blank\" rel=\"noopener noreferrer\">Democrat-backed law<\/a>, which takes effect in October. Underage arrestees at least 16 years old who are charged with certain abduction, kidnapping, robbery, assault, gun and sex offenses will also automatically face the juvenile system. Those in the 16-or-older group charged with life-sentence crimes will still be prosecuted in adult court.<\/p>\n<p>The state already has a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >system allowing adult courts<\/a> to send severe cases to juvenile court under certain conditions, including when the option is deemed to be \u201cin the interest of the child or society,\u201d according to <a href=\"https:\/\/mgaleg.maryland.gov\/Pubs\/BudgetFiscal\/2026RS-SB0323-REIN.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Maryland\u2019s Department of Legislative Services<\/a>.<\/p>\n<p>Maryland\u2019s child incarceration rate in fiscal year 2023 was 93.26 per 100,000, more than six times the federal standard, and increased to 119.59 the following fiscal year, WYPR News reported. The state\u2019s percentage of inmates jailed for underage crimes was also twice the national average, according to a September 2023 report from the Maryland Department of Juvenile Services.<\/p>\n<p>The new law brings Maryland\u2019s system closer to that of neighboring Washington, D.C., which <a href=\"https:\/\/oag.dc.gov\/about-oag\/our-structure-divisions\/public-safety-division\/juvenile-section\" target=\"_blank\" rel=\"noopener noreferrer\">prosecutes<\/a> many violent and non-violent youth crimes outside of adult court unless the district\u2019s federal prosecutor steps in.
