The piece also cites examples involving groceries (including a dispute described as \u201cOreos meltdown\u201d) to suggest that when manufacturers stop dealing directly with small shops, prices rise for consumers. But now there\u2019s a crazy new antitrust legal theory that could make every day purchases more expensive.<\/p>\n<p>Under this theory it could become illegal for a Walmart, Safeway or Amazon to seek savings from discount purchases of everything from soft drinks, meats, clothing and toothpaste to pass on to consumers. Trial lawyers argue that \u201cvolume purchasing\u201d gives an unfair advantage to the nationwide retailers of the world over smaller retailers and merchants. No more volume discounts.<\/p>\n<p>A new lobbying group called the <a href=\"https:\/\/www.mainstreetcompetition.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Main Street Competition Coalition<\/a> aims to re-weaponize a Depression-era law to do just this. The <a href=\"https:\/\/www.ftc.gov\/advice-guidance\/competition-guidance\/guide-antitrust-laws\/price-discrimination-robinson-patman-violations\" target=\"_blank\" rel=\"noopener noreferrer\">Robinson-Patman Act (RPA)<\/a> should have long ago been repealed but wasn\u2019t because no one took the antiquated relic seriously after courts and regulators abandoned and limited it.<\/p>\n<p>Then came Biden Federal Trade Commission (FTC) Chair Lina Khan \u2014 an Antitrust super-regulator \u2014 who wanted to use that law as a sword against suppliers to big discount retailers. She sued Pepsi for volume discounts selling its soft drinks. Nevermind this turned antitrust law on its head \u2014 after all antitrust protections are supposed to prevent using market power to raise consumer prices, not lower them.<\/p>\n<p>The good news is that Lina\u2019s gone and the Trump administration\u2019s Justice Department and FTC have laughed this legal theory that cutting prices should be illegal out of the building. How can a business practice that benefits consumers be forbidden?<\/p>\n<p>It\u2019s especially nefarious because it will be the most disadvantaged families \u2013 rural Americans, those working paycheck to paycheck, immigrants and minorities \u2014 who depend on volume discounts to keep food on the table, who will be the victims.<\/p>\n<p>The legal argument for RPA is based on the fear that big discount retailers can run the little <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/social-media-blisters-bare-shelves-biden-as-president-struggles-to-manage-supply-chain-crisis\/\" title=\"Social Media Blisters \u2018Bare Shelves Biden... As President Struggles To Manage Supply Chain Crisis\">local stores<\/a> out of business and then raise prices later. But <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/newsom-extends-southern-california-stay-at-home-order-for-at-least-another-three-weeks\/\" title=\"Newsom Extends Southern California Stay-at-Home Order For at Least Another Three Weeks\">box retailers<\/a> are in nearly every town in America today and still reliably provide the lowest cost option, all while smaller local stores haven\u2019t disappeared from the landscape.<\/p>\n<p>Instead, the big box stores compete aggressively against each other to keep pushing prices down for everyone.<\/p>\n<p>Volume discounting isn\u2019t \u201cprice discrimination\u201d as the trial lawyers argue. In reality, big volume purchases are a routine business practice that fights against inflation and drives prices downward. In economics jargon it\u2019s called economies of scale.<\/p>\n<p>With the Trump administration rightly hostile to these cases and with Congress unlikely to pass new attempts to reinvigorate the RPA \u2014 the trial lawyers are now taking their complaints to the courtrooms as their new arena in their fight to define price discount \u201cprice discrimination.\u201d<\/p>\n<p>In the <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2025\/05\/ftc-dismisses-lawsuit-against-pepsico\">FTC\u2019s abusive PepsiCo case<\/a> under Khan, the company was brought to task for making volume deals that let families buy soda 12-packs for a few bucks \u2014 not at a dollar per can. That\u2019s a crime? Who\u2019s the victim?<\/p>\n<p>In a recent case known as \u201cNew York\u2019s Oreos meltdown,\u201d Mondelez, the maker of Oreos, Ritz, and Wheat Thins, quit direct deliveries to 1,000 NYC indie grocers citing parking and delivery woes \u2014 while serving ShopRite and Wegmans.<\/p>\n<p>Indies\u00a0now pay wholesalers extra, jumping <a href=\"https:\/\/nypost.com\/2026\/02\/03\/business\/nyc-grocers-brace-for-price-hikes-on-oreos-wheat-thins-and-more-as-distributor-retreats-from-city\/\">$5.99 Oreos to $6.99<\/a>, which was alleged to be a Robinson-Patman Act violation by the National Supermarket Association. New York Mayor Zohran Mamdani\u2019s <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2025\/S8563\">Consumer Grocery Price Fairness Act<\/a> would ban favoring chains. That will likely mean not lower prices at Indies but higher prices at Wegmans and ShopRite. So everyone\u2019s Oreos will cost more.<\/p>\n<p>A recent <a href=\"https:\/\/cei.org\/studies\/stop-making-sense-reviving-the-robinson-patman-act-and-the-economics-of-intermediate-price-discrimination\/\">study<\/a> estimates the harm from this Robinson-Patman\u00a0type revival.\u00a0 The lawsuits could spike grocery prices 5-10% while gutting affordable options, slamming rural families and low-income communities hardest.\u00a0The study estimates\u00a0$500 extra costs for the typical family\u2019s grocery bill.<\/p>\n<p>This is no prescription to the post-Biden inflation hangover and will surely make the battle over rising prices even harder to win.<\/p>\n<p><em>Stephen Moore is a co-founder of Unleash Prosperity and a senior fellow at America First Policy Institute.
