It states that a grand jury has returned a more detailed superseding indictment alleging SPLC created or used fake businesses to open bank accounts and move money, including claims about falsified records. The author suggests additional indictments against specific SPLC employees or informants are likely as prosecutors uncover more evidence.<\/p>\n<p>It then shifts focus to the defense, describing multiple motions challenging prosecutorial conduct and procedure-ethical concerns, alleged vindictiveness, and an accusation that the superseding indictment was improperly released early. The author highlights that the SPLC has significant assets and can fund a large litigation team,which could make delay advantageous,while also warning that years of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/daily-mail-profile-on-lawyer-stephen-mueller\/\" title=\"Feature on attorney Stephen Mueller in the Daily Mail\">high-profile litigation<\/a> may continue to fuel public controversies about the SPLC\u2019s relationships with extremist groups.<\/p>\n<p>it says the outcome is uncertain and not likely to be resolved soon, noting that the Federalist sent questions to SPLC\u2019s defense team without receiving a response.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>In April, shortly after the indictment of the Southern Poverty Law Center, The Federalist explained <a href=\"https:\/\/thefederalist.com\/2026\/04\/28\/analysts-splc-fraud-money-laundering-charges-could-be-the-tip-of-the-iceberg\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a> that the indictment was probably just a start and should be regarded as the tip of the iceberg. An active investigation continued, we wrote, and more legal developments should be expected. That was correct: A grand jury just returned a more detailed <a href=\"https:\/\/www.cbsnews.com\/news\/southern-poverty-law-center-superseding-indictment\/\" target=\"_blank\" rel=\"noreferrer noopener\">superseding indictment<\/a> alleging that the SPLC has been pouring money into the groups it purports to oppose.<\/p>\n<p>Since that educated guess turned out to be correct, here\u2019s the next one: This new version of the indictment is also probably the tip of the iceberg, and there are still more developments to come. You\u2019re probably going to wait a long time to find out what happens to the SPLC, and there are reasons to expect delay from both sides of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-criticizes-doj-for-speaking-to-media-amid-ongoing-investigation-into-capitol-riot\/\" title=\"Federal Judge Criticizes DOJ For Speaking To Media Amid Ongoing Investigation Into Capitol Riot\">pending criminal case<\/a>.<\/p>\n<p>Start with the prosecution, which will be the easy part. Alleging that the SPLC created fake businesses to open bank accounts and transfer money in the name of those nonexistent entities, the new indictment also contains explicit allegations about details like the creation of fake business records. If federal prosecutors have fake payroll records and checks from businesses that didn\u2019t really exist, they\u2019ll want to know who, specifically, created those documents. Even more clearly than the first indictment, the superseding indictment suggests the possibility of future charges against individual SPLC employees and informants.<\/p>\n<p>William Byrnes, a <a href=\"https:\/\/www.law.tamu.edu\/faculty\/faculty-profiles\/william-byrnes.html\" target=\"_blank\" rel=\"noreferrer noopener\">professor<\/a> at Texas A&#038;M University School of Law who writes about bank regulations and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/crypto-exchange-bittrex-fined-53-million-by-u-s-treasury-dept\/\" title=\"Crypto exchange Bittrex fined  million by U.S. Treasury Dept\">anti-money laundering laws<\/a>, echoed that point this week in a discussion with The Federalist: \u201cMy gut tells me that further indictments will be filed as the case progresses, based on previous cases the government has brought, as it uncovers more information useful to its case and\/or to address deficiencies.\u201d<\/p>\n<p>So expect <em>more<\/em> from federal prosecutors. They have additional work to do.<\/p>\n<p>Then look at the defense. Since the Southern Poverty Law Center was first indicted on April 21, the nine defense lawyers from three law firms that represent the organization have <a href=\"https:\/\/www.courtlistener.com\/docket\/73223865\/united-states-v-southern-poverty-law-center-inc\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> three separate motions challenging the prosecution. Alleging ethical and procedural failures in a series of memoranda and exhibits that now stretch to 449 pages, the defense has attacked everything but the substance of the charges: supposedly dishonest government statements to media, supposedly vindictive prosecution, and now what\u2019s alleged to be an improper early release of a superseding indictment that was filed this week.<\/p>\n<p>On Thursday, three more lawyers asked the court to be recognized to file <a href=\"https:\/\/societyfortheruleoflaw.org\/wp-content\/uploads\/06.05.26-55-1-Exh-1-Brief-of-Amicus-Curiae.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">an amicus brief<\/a> on behalf of the <a href=\"https:\/\/societyfortheruleoflaw.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Society for the Rule of Law,<\/a> which will bring the count to twelve lawyers filing briefs to challenge the prosecution.<\/p>\n<p>With that number in mind, consider how long it typically takes to get a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >normal criminal case alleging multiple felonies<\/a> to trial in federal courts. You can find court data <a href=\"https:\/\/www.uscourts.gov\/data-table-topics\/trials\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>, in data tables that are unpleasant to parse, but a simpler approach is to see what defense lawyers <a href=\"https:\/\/www.nyccriminalattorneys.com\/do-federal-cases-always-go-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">tell their clients<\/a>: \u201cFederal courts typically set trial dates early \u2014 within 12-18 months of indictment \u2014 and they actually stick to them.\u201d<\/p>\n<p>A complex case with a long list of felonies can easily take a year and a half to get to trial, but it can take longer with procedural delays like extended legal combat over <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jury-selection-resumes-in-derek-chauvin-trial-half-chosen\/\" title=\"Jury selection resumes in Derek Chauvin ..., half chosen\">pre-trial motions<\/a>. And we\u2019re having a presidential election in two and a half years, after which we may have a president and an attorney general who are Democrats. <\/p>\n<p>If a trial date can be pushed beyond the next inauguration, the SPLC might beat the charges simply by getting a friendlier administration. <\/p>\n<p>The SPLC \u201chas over $750M in assets,\u201d Byrnes told The Federalist, \u201callowing it the best litigation\u00a0team money can buy.\u201d With money for a giant and aggressive legal team, he concluded, \u201cdelay\u00a0may work.\u201d <\/p>\n<p>But a legal strategy of delay also threatens to extend the political crisis for the SPLC, as a years-long courtroom battle keeps generating headlines about allegations that an anti-hate organization paid for Klan robes and cross-burning materials and kept Klansmen and neo-Nazis on a shadow payroll.<\/p>\n<p>As Byrnes asked The Federalist this week, \u201cWhat are the outcomes?\u201d The SPLC <a href=\"https:\/\/www.youtube.com\/watch?v=25dlBorkAy4&#038;t=60s\" target=\"_blank\" rel=\"noreferrer noopener\">says<\/a> <a href=\"https:\/\/apnews.com\/article\/southern-poverty-law-center-criminal-investigation-db7fdcf9baa0d1b24b8f1e1f2cebc0be\" target=\"_blank\" rel=\"noreferrer noopener\">explicitly<\/a> in its own defense that it has been paying extremist groups for years so it can infiltrate them and break them up, but toward what end? As Byrnes noted, \u201cSPLC has no prosecutorial authority. The Klan and Nazi groups seem to be doing just fine.\u201d<\/p>\n<p>An extended legal controversy might serve the SPLC in federal court and damage it in the court of public opinion.
