And feisty. <\/p>\n<p>The New York Democrat was full of fight, or at least that\u2019s the image the performative politician was attempting to affect to reporters at a press conference. He called Virginia voters\u2019 approval of a <a href=\"https:\/\/thefederalist.com\/2026\/05\/15\/virginia-dems-last-hope-of-saving-rigged-maps-is-dead\/\" target=\"_blank\" rel=\"noreferrer noopener\">rigged referendum<\/a> allowing the state legislature to adopt a politically twisted congressional redistricting proposal a big victory for \u201cdemocracy.\u201d <\/p>\n<p>That \u201cvictory\u201d would quickly collapse, with the Virginia State Supreme Court <a href=\"https:\/\/thefederalist.com\/2026\/05\/08\/virginia-supreme-court-strikes-down-democrat-gerrymander\/\" target=\"_blank\" rel=\"noreferrer noopener\">declaring<\/a> the election unconstitutional. But Jeffries wasn\u2019t worried about that eventuality then. He was a warrior, audaciously declaring to the American people that Democrats would \u201cnot let Donald Trump rig the midterm elections by gerrymandering maps \u2026 without a forceful Democratic Response.\u201d They\u2019d do the rigging themselves, thank you very much. <\/p>\n<p>\u201cWe are in an era of maximum warfare, everywhere, all the time. And we are going to keep the pressure on Republicans at every single state in the union to ensure, at the end of the day, that there is a fair, national map,\u201d the minority leader <a href=\"https:\/\/www.c-span.org\/program\/news-conference\/house-democrats-hold-news-conference-on-virginia-redistricting-vote\/677945\" target=\"_blank\" rel=\"noreferrer noopener\">crowed<\/a> in a response to a reporter\u2019s question. Jeffries was asked what he would do should red state Republicans respond in kind, escalating the redistricting war. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>House Minority Leader Hakeem Jeffries on Wednesday took a victory lap on Democrats\u2019 success in Virginia:<\/p>\n<p>\u201cWe are in an era of maximum warfare, everywhere, all the time, and we&#8217;re going to keep the pressure on Republicans in every single state in the union to ensure, at the end\u2026 <a href=\"https:\/\/t.co\/vJpsfKzod3\">https:\/\/t.co\/vJpsfKzod3<\/a> <a href=\"https:\/\/t.co\/z6JSS5ZdcI\">pic.twitter.com\/z6JSS5ZdcI<\/a><\/p>\n<\/div>\n<p>\u2014 Oren Oppenheim (@OrenOppenheim) <a href=\"https:\/\/x.com\/OrenOppenheim\/status\/2047002483311133068?ref_src=twsrc%5Etfw\">April 22, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Things haven\u2019t gone well for Democrats on the redistricting front since. In fact, tough-talking Jeffries and his party <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/republicans-won-the-redistricting-battle-now-voters-will-decide-whether-they-win-congress\" target=\"_blank\" rel=\"noreferrer noopener\">got their maps handed to them<\/a>. <\/p>\n<p>The Grand Old Party is positioned to pick up <a href=\"https:\/\/www.nbcnews.com\/politics\/2026-election\/house-redistricting-gop-democrats-2026-midterm-elections-rcna348110\" target=\"_blank\" rel=\"noreferrer noopener\">10 or so net House seats<\/a> in the midterms after waking up to the Democrats\u2019 \u201cmaximum warfare\u201d campaign and turning up the heat. <\/p>\n<p>Hilariously, Democrats could well lose one of their redrawn congressional districts, with an independent and a Republican grabbing the most votes thus far in <a href=\"https:\/\/www.kcra.com\/article\/michael-stansfield-california-redistricting-sixth-congressional-district\/71487455\" target=\"_blank\" rel=\"noreferrer noopener\">this week\u2019s California primary.<\/a> Democrats, led by Gov. Gavin Newsom, drove an effort to change the Golden State\u2019s constitution to allow the legislature to gerrymander maps that are supposed to deliver liberals an additional five congressional seats. <\/p>\n<h2>\u2018Race-Based Discrimination\u2019<\/h2>\n<p>The U.S. Supreme Court, too has delivered key victories for Republicans and the republic, particularly in an April ruling that declared unconstitutional a section of the <a href=\"https:\/\/www.archives.gov\/milestone-documents\/voting-rights-act\" target=\"_blank\" rel=\"noreferrer noopener\">Voting Rights Act<\/a> and put an end to racially-gerrymandered districts. <\/p>\n<p>But the war is not over. It\u2019s just entering a new phase. <\/p>\n<p>\u201cMinority Leader Jeffries said this is a time of \u2018maximum warfare, everywhere, all the time,\u2019 and that they were going to \u2018keep maximum pressure\u2019 on Republicans. We want to be the counterbalance to that,\u201d <a href=\"https:\/\/dc.hillsdale.edu\/Profiles\/Marshall-Yates\/\" target=\"_blank\" rel=\"noreferrer noopener\">Marshall Yates,<\/a> who heads up the <a href=\"https:\/\/itsyourgov.org\" target=\"_blank\" rel=\"noreferrer noopener\">Oversight Project\u2019s<\/a> new Redistricting and Election Protection for American Integrity and Representation (REPAIR) Initiative. <\/p>\n<p>It\u2019s a long name for a powerful mission. In an interview this week with The Federalist, Yates said the initiative will be an \u201call-of-the-above approach\u201d to fighting to ensure states \u2014 blue and red \u2014 are no <a href=\"https:\/\/amzn.to\/3YuVZYV\" >longer drawing affirmative action maps tainted<\/a> with the VRA\u2019s stain of discrimination. <\/p>\n<p>That is exactly what the U.S. Supreme Court ordered in <em><a href=\"https:\/\/thefederalist.com\/2026\/04\/29\/supreme-court-smacks-down-rampant-race-based-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">Louisiana v. Callais<\/a><\/em>. The decision specifically dealt with Louisiana\u2019s court-ordered creation of a second <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michael-barone-in-systemically-racist-america-lots-of-whites-vote-for-blacks\/\" title=\"Michael Barone: In \u201cSystemically Racist... America, Lots of Whites Vote for Blacks\">majority-black congressional district<\/a>. That lower court found that Louisiana\u2019s sole race-based district more than likely violated <a href=\"https:\/\/www.justice.gov\/crt\/section-2-voting-rights-act\" target=\"_blank\" rel=\"noreferrer noopener\">Section 2 of the Voting Rights Act<\/a>.<\/p>\n<p>\u201cSection 2 of the Voting Rights Act of 1965 \u2026 was designed to enforce the Constitution \u2014 not collide with it,\u201d Associate Justice Samuel Alito <a href=\"https:\/\/thefederalist.com\/2026\/04\/29\/supreme-court-smacks-down-rampant-race-based-gerrymandering\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote <\/a>in the 6-3 ruling. \u201cUnfortunately, lower courts have sometimes applied this Court\u2019s \u00a72 precedents in a way that forces States to engage in the very race-based discrimination that the Constitution forbids,\u201d <\/p>\n<p>The folks over at the left-leaning Brennan Center have joined a chorus of race-based preference leftists in <a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/after-louisiana-v-callais-heres-proof-just-how-bad-voting-rights-america\" target=\"_blank\" rel=\"noreferrer noopener\">screaming<\/a> that <em>Callais <\/em>will roll back \u201chalf a century of steady progress toward racial equality in voting practices.\u201d In fact, the ruling rolls back a 60-year affront to equality that the Constitution has never countenanced. <\/p>\n<h2>\u2018Not the Time for Half Measures\u2019<\/h2>\n<p>States are beginning to redraw racially gerrymandered maps following the ruling. The Louisiana Legislature last week <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/louisiana-passes-new-congressional-map-to-eliminate-majority-black-district-give-gop-another-seat\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a> an update, extracting one of two majority-black districts. <a href=\"https:\/\/thefederalist.com\/2026\/06\/03\/scotus-swats-down-rogue-courts-block-on-alabamas-congressional-map-again\/\" target=\"_blank\" rel=\"noreferrer noopener\">Alabama<\/a> this week got the go-ahead from the Supreme Court to remove one of its affirmative action districts after another lower court initially blocked the move. <\/p>\n<figure><\/figure>\n<p>But the wins are far from complete. Yates said several states, particularly in the South, are content with holding on to a single racially-gerrymandered district \u2014 clinging to the bad law in the VRA.<\/p>\n<p>\u201cThis is not the time for half measures like we\u2019ve seen in Alabama, Mississippi, Georgia and South Carolina,\u201d he said. <\/p>\n<p>Yates estimates there are somewhere north of 100 race-driven districts across the country. California appears to have more than a dozen alone alone, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25A839\/392124\/20260120124941071_20260120_SCOTUS_Emergency_App_FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Hispanic majority-minority districts <\/a>squeezed together as part of the state\u2019s mid-decade map manipulation. <\/p>\n<p>The REPAIR initiative aims to challenge the extremely vulnerable positions of race-based districts post-<em>Callais<\/em>. Yates and his team are in the process of assembling the legal ammunition to show the constitutional defects of the political boundaries, a priority as the 2030 Census approaches. <\/p>\n<p>REPAIR\u2019s work also will be instrumental in the mission of the <a href=\"https:\/\/massdeportationcoalition.org\/#purpose\" target=\"_blank\" rel=\"noreferrer noopener\">Mass Deportation Coalition,<\/a> of which the Oversight Project is a <a href=\"https:\/\/massdeportationcoalition.org\/#principles\" target=\"_blank\" rel=\"noreferrer noopener\">member.<\/a> Earlier this year the group <a href=\"https:\/\/massdeportationcoalition.org\/#purpose\" target=\"_blank\" rel=\"noreferrer noopener\">released<\/a> a plan for ICE interior removals of 1 million illegal aliens this year \u201cso that by 2027 and 2028 the Trump Administration can build off that logistical, operational, and policy framework to scale deportations to exceed the enforcement <a href=\"https:\/\/origins.osu.edu\/watch\/operation-wetback\" target=\"_blank\" rel=\"noreferrer noopener\">efforts of President Eisenhower,<\/a> as promised.\u201d<\/p>\n<h2>\u2018Skewing the Representation\u2019<\/h2>\n<p>Illegal immigrants are counted in the decennial census, and for congressional district apportionment. States with significant foreign national populations, like California, have bolstered their share of representation in the House and in the Electoral College. While noncitizens registering and voting in U.S. elections is a growing election integrity concern, artificial apportionment has significantly influenced the balance of political power. <\/p>\n<p>\u201cBut even if not a single illegal alien casts a vote, the mere presence of illegal immigrants in the U.S. is having a profound impact on the outcome of elections, skewing the representation of Americans,\u201d Rep. Chuck Edwards, R-N.C. <a href=\"https:\/\/edwards.house.gov\/media\/press-releases\/house-representatives-passes-edwards-bill-only-include-us-citizens\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> as the House passed the <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/151\" target=\"_blank\" rel=\"noreferrer noopener\">Equal Representation Act<\/a> in late 2024. The bill, which Edwards introduced, demands that only American citizens are counted when apportioning congressional seats. Going nowhere in the stalemate Senate then, the Republican-controlled House and Senate <a href=\"https:\/\/www.hagerty.senate.gov\/press-releases\/2025\/06\/30\/hagerty-18-senate-colleagues-reintroduce-legislation-to-end-counting-of-illegal-immigrants-in-determining-electoral-college-votes-and-congressional-district-apportionment\/\" target=\"_blank\" rel=\"noreferrer noopener\">brought the measure back<\/a> this session. <\/p>\n<p>Yates, who previously served as executive director of the <a href=\"https:\/\/www.electionintegritynetwork.org\" target=\"_blank\" rel=\"noreferrer noopener\">Election Integrity Network<\/a>, said the REPAIR initiative will operate under the umbrella of redistricting and election integrity work. He said the two go hand in hand and overlap with another <a href=\"https:\/\/thefederalist.com\/2026\/06\/04\/californias-latest-election-mess-demands-supreme-court-cleanup\/\" target=\"_blank\" rel=\"noreferrer noopener\">highly anticipated<\/a> Supreme Court decision that could end the extended receipt of ballots long after Election Day. <\/p>\n<p>\u201cPeople have to have confidence in the outcome of their elections,\u201d he said. \u201cIf you\u2019re voting in an unconstitutional district and they are allowing votes to be counted long after the election, that delay only deteriorates Americans\u2019 confidence.\u201d <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
