While the Biden rule (effective July 1, 2025) aimed to expand access and fast-track transplants, it also pushed participating hospitals to develop \u201cHealth Equity Plans\u201d and target selected populations-claims critics say effectively introduced non-medical, race-based preferences into transplant decisions.<\/p>\n<p>CMS says the new Trump-era final rule (set to take affect July 1, 2026) will require allocation to rely on objective, measurable medical criteria consistent with OPTN guidance, and not on race or other factors outside those medical goals. return false;\" title=\"Printer Friendly, PDF &#038; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>The Centers for Medicare and Medicaid Services (CMS) ended a Biden administration policy that required racial considerations be made to determine who was eligible to get a kidney transplant.<\/p>\n<p>CMS published a final rule Monday governing the Increasing Organ Transplant Access (IOTA) Model, a mandatory, six-year <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/12\/04\/2024-27841\/medicare-program-alternative-payment-model-updates-and-the-increasing-organ-transplant-access-iota\" target=\"_blank\" rel=\"noreferrer noopener\">program<\/a> that ostensibly sought to \u201cincrease access to kidney transplants for patients with <a href=\"https:\/\/amzn.to\/3YuVZYV\" >end-stage renal disease<\/a>.\u201d However, the Biden rule, which took effect July 1, 2025, also required participating hospitals to consider race, ethnicity, and \u201cequity\u201d in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/listen-elon-musk-presses-robinhood-ceo-about-gamestop-fiasco-restricted-trading\/\" title=\"LISTEN: Elon Musk Presses Robinhood CEO About GameStop Fiasco, Restricted Trading\">decision-making process<\/a> for allocating organs to patients.<\/p>\n<div id=\"fdrlst__b89e9-1996704848\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>\u201cCMS also wants to reiterate that allocation and transplantation decisions should be made based on objective and measurable medical criteria through the framework set up by the [Organ Procurement and Transplantation Network] OPTN \u2026 and should not be made on the basis of race or other criteria not laid out by the goals described in this section of the [Code of Federal Regulations],\u201d the Trump CMS <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/06\/01\/2026-10890\/medicare-program-alternative-payment-model-updates-and-the-increasing-organ-transplant-access-iota?utm_medium=email&#038;utm_source=ncl_amplify&#038;utm_campaign=260602-afl_email_533_cms_removes_biden_era_dei_framework_from_kidney_transplant_program_following_america_first_legals_rulemaking_petition_no_donate_6226&#038;utm_content=ncl-VCsgUByCDV&#038;utm_term=&#038;_nlid=VCsgUByCDV&#038;_nhids=ncNMviLzh48Rels\" target=\"_blank\" rel=\"noreferrer noopener\">final rule<\/a>, set to take effect July 1, 2026, states.<\/p>\n<p>The rule came in response to <a href=\"https:\/\/aflegal.org\/press-release\/america-first-legal-demands-repeal-of-biden-era-rule-that-uses-race-to-determine-kidney-transplant-recipients\/\" target=\"_blank\" rel=\"noreferrer noopener\">public comment<\/a> made by America First Legal (AFL) and others arguing that \u201ctransplant allocation decisions should remain grounded in objective medical criteria,\u201d the rule states.<\/p>\n<p>As AFL <a href=\"https:\/\/aflegal.org\/press-release\/cms-removes-biden-era-dei-framework-from-kidney-transplant-program-following-america-first-legals-rulemaking-petition\/\" target=\"_blank\" rel=\"noreferrer noopener\">pointed out<\/a>, the Biden rule encouraged transplant hospitals to \u201cidentify disparities among racial and demographic groups, develop Health Equity Plans, conduct resource gap analyses, establish equity-focused goals, and implement targeted interventions designed to preference selected populations.\u201d<\/p>\n<p>The Biden CMS said that \u201cHealth Equity Plans,\u201d which were meant to determine areas where hospitals were not meeting its equity goals and then recommend remedial action, were \u201cvoluntary,\u201d but AFL stated that they were actually embedded into the IOTA Model.<\/p>\n<p>\u201cThe Biden Administration designed the IOTA Model to advance its <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/loudoun-county-is-forcing-parents-to-sign-form-promising-not-to-show-anyone-their-crt-based-curriculum\/\" title=\"Loudoun County Is Forcing Parents to Sign Form Promising Not to Show Anyone Their CRT-Based Curriculum\">broader equity agenda<\/a> within the nation\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-announces-major-planned-overhaul-of-organ-transplant-network\/\" title=\"... announces major planned overhaul of organ transplant network\">organ transplant system<\/a>,\u201d AFL attorney Megan Redshaw said in a press release. \u201cLife-saving transplant decisions should be guided by medical criteria and clinical urgency \u2014 not race. We applaud CMS for removing this framework and restoring a transplant system grounded in medical need and clinical urgency.\u201d<\/p>\n<p>The Biden IOTA Model also sought to fast-track transplants and increase their raw number by paying hospitals to do more, while penalizing hospitals that are not performing to their specifications.<\/p>\n<p>\u201cTying institutional revenue to transplant counts encourages aggressive procurement and transplant practices in a system already marred by ethical failures, oversight breakdowns, and <a href=\"https:\/\/www.hhs.gov\/press-room\/hrsa-to-reform-organ-transplant-system.html\">documented patient-safety concerns<\/a>,\u201d AFL stated.<\/p>\n<p>The Biden rule was an outgrowth of an executive order \u2014 \u201c<a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/01\/25\/2021-01753\/advancing-racial-equity-and-support-for-underserved-communities-through-the-federal-government\" target=\"_blank\" rel=\"noreferrer noopener\">Advancing Racial Equity and Support for Underserved Communities Through the Federal Government<\/a>\u201d \u2014 that claimed the \u201cunbearable human costs of systemic racism\u201d and <a href=\"https:\/\/www.presidency.ucsb.edu\/documents\/fact-sheet-the-biden-harris-administration-advances-equity-and-opportunity-for-black-0\" target=\"_blank\" rel=\"noreferrer noopener\">forced government programs<\/a> to have non-white racial preferences for program allocation across numerous initiatives, including in business, federal contracting, housing, <a href=\"https:\/\/thefederalist.com\/2021\/10\/11\/your-race-might-determine-whether-you-get-lifesaving-medical-care\/\" target=\"_blank\" rel=\"noreferrer noopener\">health care<\/a>, and much more.<\/p>\n<p>The Biden administration even went as far as to <a href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/health-worker-wellbeing-advisory.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">suggest<\/a> the necessity of \u201cracial concordance\u201d between health care workers and patients. \u201cRacial concordance\u201d is the <a href=\"https:\/\/thefederalist.com\/2025\/08\/07\/harvard-continues-race-based-admissions-even-after-scotus-affirmative-action-decision-complaint\/\" target=\"_blank\" rel=\"noreferrer noopener\">theory<\/a> that health outcomes are worse when the race of the doctor is different than the race of the patient, and that therefore patients should be race-matched with a doctor. It is also an artificial way of shoehorning tacit racial quotas into the medical profession, which was the goal of the Biden administration and many medical schools.<\/p>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Breccan F.
