In 47-year-old Erin Millender\u2019s case, IVF tore her family apart before it even began.<\/p>\n<p>As the <a href=\"https:\/\/www.nytimes.com\/2026\/05\/24\/us\/ivf-embryos-custody.html\" target=\"_blank\" rel=\"noreferrer noopener\">New York Times<\/a> detailed last week, Millender is pregnant with her ex-husband\u2019s child after she secretly implanted one of the couple\u2019s IVF-created embryos before he filed an appeal requesting a court revisit a judgement that awarded his former wife custody of their frozen, unborn children. But the story doesn\u2019t start there.<\/p>\n<p>Deceived by the <a href=\"https:\/\/thefederalist.com\/2025\/11\/21\/anti-natalists-at-nyt-want-you-to-think-ivf-is-the-only-way-to-have-a-career\/\" target=\"_blank\" rel=\"noreferrer noopener\">lies<\/a> sold\u00a0by <a href=\"https:\/\/thefederalist.com\/2025\/11\/10\/kelsea-ballerinis-i-sit-in-parks-exposes-the-heartbreak-of-buying-girl-boss-lies\/\" target=\"_blank\" rel=\"noreferrer noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/life-and-beth-accidentally-underscores-the-failures-of-feminism\/\" title=\"\u2018Life And Beth\u2019 Accidentally Underscores The Failures Of Feminism\">fourth-wave feminism<\/a><\/a> about prioritizing an Ivy League education and career over marriage and kids, Millender ignored her biological clock until 35 \u2014 her so-called \u201cdrop-dead date.\u201d By then, the dating pool was diluted. Most of the men who wanted to settle down and raise a family were already doing so. <\/p>\n<p>At 39, Millender finally found someone she thought fit her bill \u201cas a man she could have a baby with, at least as a co-parent, if not as a husband.\u201d Yet, it took several \u201cclear ultimatums\u201d to get the guy to take the next relationship step and propose. By then, Millender was diagnosed with infertility and immediately pushed by her fertility doctor to start IVF. <\/p>\n<p>When Adam Rubin finally agreed to marry Millender, he did so on the condition that they would not start IVF until after the wedding. So Millender gave marriage a month before she went in for the <a href=\"https:\/\/thefederalist.com\/2022\/08\/05\/when-sperm-and-eggs-are-monetized-human-existence-becomes-transactional\/\" target=\"_blank\" rel=\"noreferrer noopener\">painful, pricey, and sometimes traumatizing procedure<\/a> to retrieve her eggs. <\/p>\n<p>Together, Millender and Rubin rode the IVF roller coaster of harvesting eggs and fertilizing them only to implant an embryo that didn\u2019t stick and start the process all over again. <\/p>\n<p>The NYT reported that Millender became so obsessed with trying to get pregnant that she told her husband he was no longer a \u201cpriority\u201d and \u201casked him to stop attending their I.V.F. appointments so she could better focus on the procreative task at hand.\u201d Millender claimed that Rubin was not pushed away but became \u201cincreasingly uninterested in their pregnancy plans.\u201d<\/p>\n<p>After an unknown number of embryos were created and potentially discarded due to <a href=\"https:\/\/www.nytimes.com\/2022\/04\/20\/health\/pgta-ivf-pregnancy-test.html\" target=\"_blank\" rel=\"noreferrer noopener\">widely-used yet notoriously unreliable embryo grading<\/a>, Millender received word that she and Rubin were the proud parents of two \u201cviable embryos.\u201d <\/p>\n<p>But by then, Rubin was fed up with Millender\u2019s baby-making tunnel vision. He hired a divorce lawyer and contacted the fertility facility in an effort to revoke his consent for Millender\u2019s upcoming embryo transfer. <\/p>\n<p>\u201cI did not endure the I.V.F. process, assist with medical appointments and injections with the intention of being reduced to an anonymous donor,\u201d Rubin allegedly wrote in his divorce affidavit. <\/p>\n<p>Millender, unsure of what the future held for her already created embryos, pivoted. She underwent yet another round of egg retrieval with the hopes of purchasing random sperm and creating new embryos that Rubin played no biological role in creating, but it was too late. At 44, egg quality had <a href=\"https:\/\/www.acog.org\/womens-health\/faqs\/having-a-baby-after-age-35-how-aging-affects-fertility-and-pregnancy#:~:text=A%20woman's%20peak%20reproductive%20years,getting%20pregnant%20naturally%20is%20unlikely.\" target=\"_blank\" rel=\"noreferrer noopener\">significantly declined<\/a>. Millender\u2019s best and only bet would be to use the embryos she already had.<\/p>\n<p>Most state laws are not equipped to handle embryo custody disputes, so when Millender challenged Rubin for custody of their frozen offspring, it was chaotic. A New York judge eventually ruled that Millender\u2019s \u201cinterest in obtaining control over the remaining embryos supersedes\u201d Rubin\u2019s desire that they be discarded or handed over for dissection. <\/p>\n<p>Millender, with the assurance of several lawyers, secretly hustled to implant one of the two embryos before Rubin could file an appeal. At 47 years old, she would be having Rubin\u2019s baby whether he liked it or not.<\/p>\n<p>Embryo custody battles between bickering spouses and even <a href=\"https:\/\/thefederalist.com\/2024\/03\/13\/committing-to-embryo-creation-instead-of-marriage-is-a-recipe-for-death-and-disaster\/\" target=\"_blank\" rel=\"noreferrer noopener\">boyfriends and girlfriends<\/a> are not a new IVF hurdle. They are the logical conclusion of a fertility industry that perpetually prioritizes <a href=\"https:\/\/thefederalist.com\/2023\/08\/14\/its-time-to-stop-treating-assisted-reproductive-technology-as-a-quick-fix-for-infertility\/\" target=\"_blank\" rel=\"noreferrer noopener\">profit over people<\/a>, <a href=\"https:\/\/thefederalist.com\/2021\/06\/22\/abortion-puts-selfish-wants-above-babies-rights-too-often-ivf-does-the-same\/\" target=\"_blank\" rel=\"noreferrer noopener\">adults\u2019 selfish desires<\/a> over children\u2019s natural rights, <a href=\"https:\/\/thefederalist.com\/2024\/03\/25\/what-if-we-can-heal-infertile-women-rather-than-turning-to-expensive-unethical-ivf-treatments-first\/\" target=\"_blank\" rel=\"noreferrer noopener\">quick fixes<\/a> over long-term women\u2019s health solutions, <a href=\"https:\/\/thefederalist.com\/2023\/06\/08\/popular-genetic-testing-pits-unborn-siblings-against-each-other-and-the-highest-scorer-gets-to-live\/\" target=\"_blank\" rel=\"noreferrer noopener\">desirable traits above all<\/a>, <a href=\"https:\/\/thefederalist.com\/2023\/06\/14\/california-bill-would-make-insurance-fund-unlimited-attempts-to-create-motherless-and-fatherless-children\/\" target=\"_blank\" rel=\"noreferrer noopener\">forced orphanhood<\/a>, the <a href=\"https:\/\/thefederalist.com\/2023\/07\/22\/the-global-fertility-industry-seeks-to-erase-women-from-procreation-one-manufactured-egg-at-a-time\/\" target=\"_blank\" rel=\"noreferrer noopener\">erasure of women<\/a> in reproduction, <a href=\"https:\/\/thefederalist.com\/2022\/12\/14\/we-need-to-get-serious-about-meeting-advances-in-reproductive-tech-with-an-actionable-moral-framework\/\" target=\"_blank\" rel=\"noreferrer noopener\">fertility fraud<\/a>, and making <a href=\"https:\/\/thefederalist.com\/2022\/08\/05\/when-sperm-and-eggs-are-monetized-human-existence-becomes-transactional\/\" target=\"_blank\" rel=\"noreferrer noopener\">human existence transactional<\/a>.<\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2025\/11\/07\/this-horror-story-of-an-ivf-addicted-68-year-old-is-everything-wrong-with-big-fertility\/\" target=\"_blank\" rel=\"noreferrer noopener\">[RELATED: This Horror Story Of An IVF-Addicted 68-Year-Old Is Everything Wrong With Big Fertility]<\/a><\/p>\n<p>The biggest loser in this case might look like Rubin, but it\u2019s actually his child. The embryo spared from certain death only by judge\u2019s read on vague and sometimes nonexistent fertility law will still grow up to be a child with wounds only made possible by IVF and adults putting their reproductive desires ahead of kids\u2019 rights and best interests. <\/p>\n<p>Millender\u2019s child is not only at <a href=\"https:\/\/www.escardio.org\/news\/press\/press-releases\/babies-born-after-fertility-treatment-have-higher-risk-of-heart-defects\/\" target=\"_blank\" rel=\"noreferrer noopener\">higher risk for complications like heart defects<\/a>, but he or she will be born virtually fatherless to a mother who will reach retirement age by the time he or she graduates high school. Children who are not raised by their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-left-has-effectively-banned-christian-kids-from-public-pools-libraries-and-summer-camps\/\" title=\"The Left Has Effectively Banned Christian Kids From Public Pools, Libraries, And Summer Camps\">married biological parents<\/a> have clear <a href=\"http:\/\/futureofchildren.princeton.edu\/sites\/futureofchildren\/files\/foc_vol_30_no_1_combined_v6.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">physical, emotional, and educational disadvantages<\/a> that do not systematically affect their peers in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/babies-by-any-means-necessary-wont-fix-the-wests-fertility-woes\/\" title=\"Using Any Means to Boost Western Fertility Won&#039;t Solve Baby Shortage\">stable nuclear family situations<\/a>. Fatherless boys <a href=\"https:\/\/thefederalist.com\/2022\/08\/12\/heres-what-mindy-kaling-gets-wrong-in-her-plea-for-college-girls-to-freeze-their-eggs\/\" target=\"_blank\" rel=\"noreferrer noopener\">specifically<\/a> are\u00a0less likely\u00a0to <a href=\"https:\/\/ifstudies.org\/blog\/life-without-father-less-college-less-work-and-more-prison-for-young-men-growing-up-without-their-biological-father\" target=\"_blank\" rel=\"noreferrer noopener\">graduate and more prone to criminal acts and violence<\/a>.<\/p>\n<p>The fertility industry promotes IVF as a safety net that gives people like Millender the option to delay or outsource childbearing, but it\u2019s really a trap that is <a href=\"https:\/\/www.factsaboutfertility.org\/modeling-the-cumulative-effectiveness-of-fertility-treatments-a-review\/\" target=\"_blank\" rel=\"noreferrer noopener\">far from foolproof<\/a>.
